Nelson Circuit Court Indictments, Sept. 18, 2013

Editor’s Note: The indictment of a person by a grand jury or otherwise is an indictmentaccusation only and that person is presumed innocent until and unless proven guilty.

Tuesday, Sept. 24, 2013 – The following people were indicted by a Nelson County grand jury on Wednesday, Sept. 18, 2013. They are set for arraignment on Thursday, Oct. 3, 2013, unless otherwise indicated.

13-CR-218. Joshua Chad Mattingly, 22, Bardstown, receiving stolen property.

According to the indictment, on March 24, 2013, Mattingly allegedly received, retained or disposed of two hydraulic clamping plates belonging to Wilberts Plastics with a value of more than $10,000. Bail was set at $9,500 cash only, plus conditions.

13-CR-219. Melanie Elaine Masden, 34, Bardstown, manufacturing methamphetamine and complicity to the same; possession of controlled substances, first-degree, and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Aug. 4, 2013, Masden — acting alone or in concert with Michael Shaun Parkerson and William Andy Wathen, manufactured and possessed methamphetamine while also in possession of drug paraphernalia. Bail was set at

13-CR-220. Thomas Frank Hawkins, 26, Bardstown, burglary, second-degree; persistent felony offender, first-degree.

According to the indictment, on Aug. 6, 2013, Hawkins allegedly entered the residence of another person with the intent to commit a crime. The indictment cites his prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

13-CR-221. William Andrew Wathen, 34, Bardstown, manufacturing methamphetamine and complicity to the same; possession of controlled substances, first-degree, and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Aug. 4, 2013, Wathen — acting alone or in concert with Michael Shaun Parkerson and Melanie Elaine Masden, manufactured and possessed methamphetamine while also in possession of drug paraphernalia. The indictment cites Wathen’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

13-CR-222. James Lawrence “Larry” Clan, 35, Bardstown, manufacturing methamphetamine; possession of precursors with the intent to manufacture methamphetamine; possession of a controlled substance, first-degree (2 counts); wanton endangerment, first-degree; illegal possession of a food stamp card; possession of controlled substance, third-degree; possession of drug paraphernalia; fleeing and evading police, second-degree; resisting arrest; operating a motor vehicle while license suspended; criminal mischief, third-degree; reckless driving; disregarding stop sign; persistent felony offender, first-degree.

According to the indictment, on Aug. 20, 2013, Clan was allegedly manufacturing methamphetamine while in possession of methamphetamine, meth precursors, oxycodone, diazepam pills, and drug paraphernalia. He was also charged with possession of a food stamp card that did not belong to him. The indictment alleges that on the same date, Clan ran a stop sign as he operating a motor vehicle recklessly while fleeing or evading police on a suspended license, speeding and subsequently crashing into a police cruiser occupied by two police officers. Clan allegedly threatened Officer Ray Lewis with physical force or violence while Lewis arrested him and then caused less than $500 damage to the police cruiser. The indictment cites Clan’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

13-CR-223. Michael Shaun Parkerson, 33, Bardstown, manufacturing methamphetamine and complicity to the same; possession of controlled substances, first-degree, and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Aug. 4, 2013, Parkerson — acting alone or in concert with William Andy Wathen and Melanie Elaine Masden, manufactured and possessed methamphetamine while also in possession of drug paraphernalia. The indictment cites Parkerson’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $100,000 cash only, plus conditions.

13-CR-224. Matthew David Douglas, 31, New Haven, cultivating marijuana, five or more plants; trafficking in marijuana; possession of drug paraphernalia; possession of controlled substance, third-degree; possession of legend drugs; possession of prescription not in proper container.

According to the indictment, on July 10, 2013, Douglas allegedly cultivated more than five marijuana plants and possessed marijuana with the intent to sell it. The indictment alleges that on the same date he was in possession of drug paraphernalia; an unspecified drug; multiple legend drugs; and a prescription not in its proper container. Bail was set at $9,500 cash only, plus conditions.

13-CR-225. Corey Hamilton Hood, 28, Bardstown, theft by unlawful taking.

According to the indictment, sometime between Aug. 28-29, 2013, Hood allegedly took various tools belonging to another individual having a value of more than $500 but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

13-CR-226. Timothy Matthew Maddox, 24, Louisville, theft by unlawful taking; theft by unlawful taking/disposition-firearm; possession of a firearm by a convicted felon.

According to the indictment, between June 1-30, 2013, Maddox, a convicted felony, allegedly took items from another person having a value of $500 or more but less than $10,000, including a Marlin 30-30 rifle. Bail was set at $20,000 cash only, plus conditions.

Tonya Lynn Unseld, 37, Bardstown, possession of a forged instrument, second-degree.

According to the indictment, on Dec. 6, 2012, Unseld was in possession of a forged check in the amount of $100 which she passed at Kentucky Home Bank knowing it was forged. Bail was set at $1,500 cash only, plus conditions.

13-CR-228. Samantha Marie Curci, 23, Bardstown, fraudulent use of a credit card or debit card; forgery, second-degree (5 counts).

According to the indictment, between Aug. 5-7, 2013, Curci allegedly used a state-issued credit card belonging to My Old Kentucky Home State Park to obtain money in an amount that was more than $500 but less than $10,000 without authorization and signed the name of park manager Alice Heaton in order to do so. Bail was set at $9,500 cash only, plus conditions.

13-CR-229. Kayla Marie Boone, 24, New Hope, possession of controlled substance, first-degree; operating a motor vehicle with a suspended license.

According to the indictment, on Aug. 12, 2013, Boone allegedly was found in possession of heroin while driving on a suspended license. Bail was set at $5,000 cash only, plus conditions.

13-CR-230. Samantha Kay Yocum, 22, Bardstown, receiving stolen property an complicity to the same.

According to the indictment, sometime between May 1-31, 2013, Yocum — acting alone or in concert with Kalin M. Williams, allegedly received or disposed of four 22-inch rims with tires belonging to another individual knowing they were stolen with a value of more than $500 but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

13-CR-231. Chadwick Allen Hamilton, 29, Bardstown, flagrant non-support.

According to the indictment, between Feb. 1, 2005 and Aug. 31, 2013, Hamilton allegedly failed to provide support he was ordered to pay, resulting in an arrearage of $5,855.79. Bail was set at $5,000 cash only, plus conditions.

13-CR-232. Joseph Wade Rogers, 62, wanton endangerment, first-degree; menacing.

According to the indictment, on Aug. 28, 2013, Rogers allegedly discharged a gun in the direction of another person, cursing and acting disorderly toward the same individual and/or neighbors. Bail was set at $9,500 cash only, plus conditions.

13-CR-233. Tracy L. Humphrey, 41, Bardstown, possession of a controlled substance, first-degree; possession of drug paraphernalia.

According to the indictment, on Aug. 21, 2013, Humphrey allegedly was found in possession of cocaine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.
