Nelson Circuit Court Indictments, Jan. 8, 2014

Editor’s Note: The indictment of a person by a grand jury or otherwise is an indictmentaccusation only and that person is presumed innocent until and unless proven guilty.

Thursday, Jan. 9, 2014 – The following people were indicted by a Nelson County grand jury on Wednesday, Jan. 8, 2014. They are schedule for arraignment Jan. 23, 2014, unless otherwise indicated

14-CR-001. James Travis Mattingly, 36, Bardstown, possession of controlled substances, first-degree; possession of a controlled substance, second-degree; possession of drug paraphernalia; failure to give turn signal.

According to the indictment, on Sept. 27, 2013, Mattingly allegedly possessed heroin, buprenorphine (a Schedule III narcotic) and drug paraphernalia. The indictment state he also failed to give a turn signal while operating his motor vehicle. Bail was set at $9,500 cash only plus conditions.

14-CR-002. Mack Thomas St. Clair III, 31, Cox’s Creek, theft by unlawful taking and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Nov. 28, 2013, St. Clair, acting alone or in concert with others, allegedly took cash belonging to another person having the value of $10,000 or more. The indictment cites St. Clair’s previous felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only plus conditions.

14-CR-003. John Wesley Scott Monin, 30, Bardstown, burglary, second-degree; persistent felony offender, first-degree.

According to the indictment, on Oct. 12, 2013, Monin allegedly entered the residence of another person unlawfully with the intent to commit a crime. The indictment cites Monin’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only plus conditions.

14-CR-004. Tyrose Monique Montgomery, 33, Bardstown, trafficking in controlled substances, first-degree; persistent felony offender, first-degree.

According to the indictment, on March 14, 2012, Montgomery allegedly sold crack cocaine to a confidential informant after having previously been convicted of trafficking in a controlled substance. The indictment cites Montgomery’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only plus conditions.

14-CR-005. Amanda Lenore Neafus, 37, Bloomfield, manufacturing methamphetamine and complicity to the same.

According to the indictment, on June 4, 2013, Neafus, acting alone or in concert with Richard Bernal, manufactured methamphetamine in Nelson County. Bail was set at $50,000 cash only plus conditions.

14-CR-006. Patrick Thomas Hamilton, 35, Bardstown, trafficking in controlled substances, first-degree and complicity to the same.

According to the indictment, on Oct. 19, 2013, Hamilton, acting alone or in concert with Brian Gilbert, sold four or more grams of cocaine to a confidential informant. Bail was set at $9,500 cash only plus conditions.

14-CR-007. Richard Lawrence Bernal, 37, Bloomfield, manufacturing methamphetamine and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on June 4, 2013, Bernal, acting alone or in concert with Amanda Neafus, manufactured methamphetamine in Nelson County. The indictment cites Bernal’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $50,000 cash only plus conditions.

14-CR-008. Jennifer Lynn Walling, 33, New Haven, controlled substance endangerment to a child, fourth-degree, and complicity to the same (3 counts); manufacturing methamphetamine and complicity to the same; possession of a controlled substance, second-degree, and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of a prescription not in proper container and complicity to the same; possession of marijuana and complicity to the same.

According to the indictment, on Nov. 23, 2013, Walling, acting alone or in concert with Roy Cottongim, manufactured methamphetamine while permitting a child to be in the home; possessed an unknown type of controlled substance; and possessed drug paraphernalia, marijuana, and prescription medicine not in the proper container. Bail was set at $50,000 cash only plus conditions.

14-CR-009. Jennifer Lynn Humphrey, 33, Bloomfield, possession of a controlled substance, first-degree; trafficking in controlled substances, second-degree; receiving stolen property; unlawful transaction with a minor, third-degree; theft by unlawful taking over $500 but less than $10,000; complicity to theft by unlawful taking-shoplifting; possession of drug paraphernalia; failure to notify address change to Department of Transportation; failure of owner to maintain required insurance/security; failure to register transfer of a motor vehicle; expired Kentucky registration plates; persistent felony offender, first-degree.

According to the indictment, on Dec. 28, 2013, Humphrey allegedly took items from Wal-Mart having a value of more than $500 and less than $10,000; acting alone or in concert with Kimberly Newton, Humphrey allegedly took items belonging to Wal-Mart having a value of more than $500 and induced a minor to engage in criminal activity; and received stolen checks having a value of less than $500. The indictment further alleges Humphrey was found in possession of an unknown controlled substance and drug paraphernalia, and that she possessed suboxone films with the intent to sell or transfer them. The indictment also alleges Humphrey was operating a motor vehicle without insurance and current registration plates, failed to register that transfer of a motor vehicle and failed to notify the Department of Transportation of her address change. The indictment cites Humphrey’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only plus conditions.

14-CR-010. Roy Allen Cottongim, 39, New Haven, controlled substance endangerment to a child, fourth-degree, and complicity to the same (3 counts); manufacturing methamphetamine and complicity to the same; possession of a controlled substance, second-degree, and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of a prescription not in proper container and complicity to the same; possession of marijuana and complicity to the same.

According to the indictment, on Nov. 23, 2013, Cottongim, acting alone or in concert with Jennifer Walling, manufactured methamphetamine while permitting a child to be in the home; possessed an unknown type of controlled substance; and possessed drug paraphernalia, marijuana, and prescription medicine not in the proper container. Bail was set at $50,000 cash only plus conditions.

14-CR-011. Kimberly Michelle Newton, 21, Bardstown, unlawful access to a computer, second-degree; theft by unlawful taking-shoplifting and complicity to the same.

According to the indictment, on Dec. 11, 2013, Newton allegedly accessed a computer data network resulting in the loss or damage of $300 or more without the consent of the victim. On Dec. 28, 2013, Newton, acting alone or in concert with Kimberly Newton, unlawfully took items belonging to Wal-Mart having a value of less than $500. Bail was set at $9,500 cash only plus conditions.

14-CR-012. William Matthew Romine, 43, Mount Washington, possession of a controlled substance, first-degree; possession of drug paraphernalia; operating a motor vehicle while under the influence of alcohol or drugs; possession of marijuana.

According to the indictment, on Oct. 20, 2013, Romine allegedly possessed methamphetamine, drug paraphernalia and marijuana while operating a motor vehicle under the influence of alcohol or drugs. Bail was set at $9,500 cash only plus conditions.

14-CR-13. Roseanna Lee Woolett, 35, Culvertown, possession of a controlled substance and complicity to the same; possession of precursors with the intent to manufacture methamphetamine and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of a controlled substance, third-degree and complicity to the same; possession of a prescription not in proper container and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Nov. 4, 2013, Woolett, acting along or in concert with Joseph Wimsett, is alleged to have unlawfully possessed an unspecified controlled substance; unlawfully possessed meth precursors with the intent to manufacture methamphetamine; and was found in possession of drug paraphernalia, a prescription not in the container in which it was delivered, and alprazolam pills. The indictment cites Woolett’s prior felony conviction as the basis of the persistent felony offender charge. Bail was set at $9,500 cash only plus conditions.
