Nelson County Circuit Court Indictments–March 21, 2012

Friday, March 23, 2012, 11 p.m. – The following people were indicted by a Nelson County grand jury on Wednesday, March 21, 2012. They are set for arraignment on Thursday, April 5, 2012, unless otherwise indicated.
12-CR-82. Travis Smith, 37, Columbia, Miss., flagrant non-support.
According to the indictment, between May 1, 2009 and Feb. 29, 2012, Smith allegedly failed to provide support which he was ordered to pay, resulting in an arrearage of $1,128.79. Bail was set at $5,000 cash only, plus conditions
12-CR-83. Timothy “Timmy” Keith Johnson, 30, address unknown. Failure to complay with sex offender registry; persistent felony offender, first-degree.
According to the indictment, between Oct. 1, 2011, and March 8, 2012, Johnson allegedly failed to comply with the Sex Offender Registry by failing to complete the address verification form as required. The indictment cited Johnson’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $100,000 cash only, plus conditions.
12-CR-84. Shane D. Showalter, 22, Louisville, theft by unlawful taking over $10,000 and complicity to same, two counts each; receiving stolen property and complicity to same, two counts each.
According to the indictment, on Jan. 21, 2012 and again on Jan. 28, 2012, Showalter, acting alone or in concert with Brandon Armstrong and others, allegedly took aluminum valued at more than $16,540 from Synergy Tool and Gauge. The indictment further alleges on the same dates, Showalter, acting alone or in concert with Brandon Armstrong and others, received, retained or disposed of aluminum and other metals belonging to the same company. Bail was set at $9,500 cash only, plus conditions.
12-CR-85. Christopher D. Hardin, 25, Bardstown, second-degree burglary and complicity to same.
According to the indictment, on Jan. 12, 2012, Hardin, acting alone or in concert with Venus Thomas and Jerry Hardin Jr, allegedly entered another person’s residence with the intent to commit a crime. Bail was set at $9,500 cash only, plus conditions.
12-CR-86. Brandon Lee Armstong, 23, Louisville, theft by unlawful taking over $10,000 and complicity to same, two counts each; receiving stolen property and complicity to same, two counts each.
According to the indictment, on Jan. 21, 2012 and again on Jan. 28, 2012, Armstrong, acting alone or in concert with Shane Showalter and others, allegedly took aluminum valued at more than $16,540 from Synergy Tool and Gauge. 12-CR-87. Venus Marie Thomas, 27, Bardstown, second-degree burglary and complicity to same.
According to the indictment, on Jan. 12, 2012, Thomas, acting alone or in concert with Christopher D. Hardin and Jerry Hardin Jr, allegedly entered another person’s residence with the intent to commit a crime. Bail was set at $9,500 cash only, plus conditions.
12-CR-88. Melanie Sue Arnold-Zeitz, 18, Bardstown, second-degree burglary and complicity to same; theft by unlawful taking and complicity to same; criminal mischief, third-degree and complicity to same.
According to the indictment, on Feb. 14, 2012, Arnold-Zeitz, acting along or in concert with Joshua Levi Gritton, unlawfully entered another’s residence with the intent to commit a crime and took a computer, video camera and other household items with a value of $500 or more but less than $10,000. The indictment further alleges on the same date, Arnold-Zeitz, acting along or inconert with Joshua Levi Gritton, damaged property belonging to another individual having a value of less than $500. Bail was set at $9,500 cash only, plus conditions.
12-CR-89. Jerry Lynn Hardin Jr., 19, Bloomfield, second-degree burglary and complicity to same; persistent felony offender, second-degree.
According to the indictment, on Jan. 12, 2012, Hardin, acting alone or in concert with Christopher D. Hardin and Venus Thomas, allegedly entered another person’s residence with the intent to commit a crime. The indictment cited Hardin’s earlier felony conviction as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.
12-CR-90. Joshua Levi Gritton, 29, Bardstown, second-degree burglary and complicity to same; theft by unlawful taking and complicity to same; criminal mischief, third-degree and complicity to same; persistent felony offender, first-degree.
According to the indictment, on Feb. 14, 2012, Gritton, acting along or in concert with Melanie Sue Arnold-Zeitz, unlawfully entered another’s residence with the intent to commit a crime, and allegedly took a computer, video camera and other household items with a value of $500 or more but less than $10,000. The indictment further alleges on the same date, Arnold-Zeitz, acting along or inconert with Joshua Levi Gritton, damaged property belonging to another individual having a value of less than $500. The indictment cited Gritton’s earlier felony convictions as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
12-CR-91. Jerry Lynn Hardin Jr., 19, Bloomfield, possession of a forged instrument, second-degree (six counts); theft by deception; persistent felony offender, second-degree.
According to the indictment, between Dec. 19-22, 2012, Hardin allegedly possessed six forged checks belonging to another person and passed them at Thompson’s Food Mart. The indictment cited Hardin’s earlier felony conviction as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.
12-CR-92. Michael J. Marino, 48, Bardstown, first-degree rape.
According to the indictment, on July 31, 2000, Marino allegedly engaged in sexual intercourse with another person by use of forcible compulsion. Bail was set at $250,000 cash only, plus conditions.
12-CR-93. Claude Owen McMakin, 23, Bloomfield, theft by unlawful taking.
According to the indictment, between Sept. 13-Oct. 4, 2011, McMakin allegedly took various electronic items belonging to Walmart having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only, plus conditions.
12-CR-94. Stephanie Rose Rogers, 30, Bloomfield, flagrant non-support.
According to the indictment, between Sept. 1, 2011 and March 15, 2012, Rogers allegedly failed to provide support which she was ordered to pay, resulting in an arrearage of $1,293.60. Bail was set at $5,000 cash only, plus conditions.
12-CR-95. Donald Brian Lewis, 34, Bloomfield, burglary, second-degree; unlawful imprisonment, second-degree; violation of a Kentucky EPO/DVO; persistent felony offender, first-degree.
According to the indictment, on Feb. 8, 2012, Lewis allegedly entered the residence of another individual with the intent to commit a crime and knowingly and unlawfully restrained an occupant of the residence and violated a Domestic Violence Order. The indictment cited Lewis’ earlier felony convictions as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.
12-CR-96. Justin Michael Adams, 25, burglary, second-degree; receiving stolen property; persisntent felony offender, second-degree.
According to the indictment, on Feb. 22, 2012, Adams allegedly entered the residence of another individual with the intent to commit a crime, and received, retained or disposed of electronic gaming devices having a value of $500 or more but less than $10,000. The indictment cited Adams’ earlier felony convictions as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.
12-CR-097. Anthony Richard Broaddus, 26, Bardstown, criminal possession of a forged instrument (11 counts); falsely reporting an incident; theft by unlawful taking under $500.
According to the indictment, on Feb. 21, 2012, Broaddus allegedly possessed 11 forged $20 bills and contacted the Nelson County Sheriff’s Office to report a burglary at his residence knowing that it did not occur. The indictment alleges Broaddus unlawfully took a 19-inch Sanyo television belonging to another person. Bail was set at $9,500 cash only, plus conditions.
12-CR-98. Christopher B. Yaden, 44, Bardstown, obtaining controlled substances by fraud; persistent felony offender, second-degree.
According to the indictment, on Dec. 19, 2012 and Jan. 23, 2012, Yaden allegedly obtained Hydrocodone and Oxycondone by knowning misrepresenting to or withholding information from a medical practitioner. The indictment cites Broaddus’ earlier felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
12-CR-99. Richard L. Keene, 44, Bardstown, possession of matter portraying a sexual performance by a minor (10 counts); distribution of matter portraying sexual performance by a minor (11 counts).
According to the indictment, between Sept. 4, 2011, and Jan. 15, 2012, Keene allegedly possessed and distributed matter portraying a sexual performance by a minor. Bail was set at $25,000 cash only, plus conditions.
12-CR-100. Breon Tyree Maddox, 28, Bardstown, trafficking in controlled substances, first-degree (2 counts); trafficking in marijuana (less than 8 oz.).
According to the indictment, on Dec. 30, 2011, and Jan. 6, 2012, Maddox allegedly sold crack cocaine in an amount equal to or less than 4 grams. On Oct. 20, 2011 he was allegedly in possession of less than 8 ounces of marijuana with the intent to sell it. Bail was set at $25,000 cash only, plus conditions.
12-CR-101. Monique Yolanda Bybee, 41, Bardstown, trafficking in controlled substances, second-degree and complicity to same (2 counts each).
According to the indictment Nov. 18, 2011, Bybee, acting alone or in concert with Deaundre Brand, allegedly sold Hydrocodone pills, a Schedule III controlled substance, to another person. On Dec. 1, 2011, Bybee, acting alone or in concert with Iris Missy Phillps Burton, allegedly sold Hydrocodone pills, a Schedule III controlled substance, to another person. Bail was set at $9,500 cash only, plus conditions.
12-CR-102. Edward Lee Graham, 37, Bardstown, trafficking in controlled substances, first-degree (2 counts); trafficking in controlled substances within 1,000 feet of a school (2 counts); persistent felony offender, first-degree.
According to the indictment, on Jan. 11 and Feb. 6, 2012, Graham allegedly sold an amount of crack cocaine equal to or less than 4 grams within 1,000 feet of the Bardstown City Schools. The indictment cites Graham’s previous felony convictions as basis for the persistent felony offender charge. Bail was set at $100,000 cash only, plus conditions.
12-CR-103. Deaundre Antoine Brand, 31, Radcliff, trafficking in controlled substances, second-degree and complicity to same.
According to the indictment, on Nov. 18, 2011, Brand, acting alone or in concert with Monique Bybee, sold Hydrocodone pills, a Schedule III controlled substance, to another individual. Bail was set at $9,500 cash only, plus conditions.
12-CR-104. Stephonie Williams, 25, New Haven, welfare fraud (over $100), (2 counts).
According to the indictment, from Aug. 1, 2009 through July 31, 2011, Williams allegedly failed to advice the Dept. for Community Based Services of her correct household circumstances and received $4,406 in food stamp benefits to which she was not legally entitled. From Oct. 1, 2009 through Jan. 31, 2010, Williams allegedly received $148 in KTAP benefits to which she was not legally entitled. Bail was set at $5,000 cash only, plus conditions.
12-CR-105. Iris Missy Phillips, aka Missy Burton, 43, Bardstown, trafficking in controlled substances, second-degree and complicity to same; trafficking in controlled substances, second-degree; tampering with physical evidence and complicity to same; trafficking in controlled substances, third-degree and complicity to same.
According to the indictment, on Dec. 1, 2011, Phillips, acting alone or in concert with Monique Bybee, allegedly sold hydrocodone pills, a Schedule III controlled substance, to another person. On Dec. 1, 2011, Phillips, acting alone or in concert with Chris Phillips, allegedly sold alprazolam pills, a Schedule IV controlled substance, to another person. Phillips, acting alone or in concert with Chris Phillips, allegedly tore off the label on a pill bottle when she believed an official preceeding was pending. On Dec. 7, 2011, Phillips allegedly sold hydrocodone pills, a Schedule III controlled substance, to another person. Bail was set at $9,500 cash only, plus conditions.
12-CR-106. Kara Lynette Hinton, 32, Bardstown, theft by unlawful taking.
According to the indictment, between April 1, 2011 and Jan. 12, 2012, Hinton, allegedly took cash belonging to Cub Scout Pack 721 with a value of $500 or more but less than $10,000. Bail was set at $2,500 cash only, plus conditions.
12-CR-107. Christopher Garrett Phillips, 27, Cox’s Creek, tampering with physical evidence and complicity to same; trafficking in controlled substances, third-degree and complicity to same; persistent felony offender, second-degree.
According to the indictment, Dec. 1, 2011, Phillips, acting alone or in concert with Iris Phillips Burton, sold alprazolam pills, a Schedule IV controlled substance, to another person. Believing an official proceeding was pending, Phillips, acting alone or inconcer with Iris Phillips Burton, tore the label on a pill bottle. Phillips’ previous felony conviction was the basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
