City council OK’s zoning change for new downtown restaurant

Wednesday, July 11, 2012, 11:55 p.m. — The Barsdtown City Council met Tuesday evening and other than a discussion at the meeting’s end (see related story, “Hagan: City Council was never informed of AG’s Open Meetings ruling”), addressed an agenda of mostly routine business.

ZONING CHANGES, AMENDMENTS. The council approved first reading on a zoning change for 111 North Third St. — part of the Crystal Building that recently was home to Hospice of Nelson County. The request asked to change the zoning to B-2/Professional, Option 2, Central Business District. The zoning request by Kreso Properties, LLC., will allow the sale of liquor at a new restaurant that will open at that address. The zoning change was approved 5-0. Councilman Tommy Reed was absent from Tuesday’s council meeting.

The council also approved first reading on three changes to the planning and zoning regulations. The regulation updates included Section 8.44 dealing with Conservation Subdivisions; Section 3.1 Administration, and Section 14.1, Violations & Remedies.

The change to Section 14.1 came about after constituents alerted Fourth District Magistrate Jeff Lear of the ordinance’s apparent conflict with the Fourth Amendment of the U.S. Constitution.

The ordinance originally stated that planning and zoning officials could enter any premises covered by their regulations at any reasonable hour. The revised ordinance requires the approval of the property owner; if the property owner refuses to grant access, a court order will be required.

According to Jan Johnston, director of the Joint City-County Planning Commission, the changes affect only the planning and zoning office. The change does not extend to code enforcement, building inspection, PVA or other city or county agences.

CHANGE ORDER. City engineer Jessica Filiatreau told the council about a change order submitted by the contractors who installed the new water line for the Nelson County Industrial Park.

The change order totaling $1,298 covers the actual cost of the material used, Filiatreau said. Once the line was completed, the contractor completed an inventory of the actual materials used in construction. If materials were not used, the city received a credit; if additional materials were needed, the city was billed for them.

Some of the additional expense was the addition of some values. While the line was being built, Filiatreau said the engineering staff asked the contractor to install three valves that would allow the addition of new connections without interrupting service to existing customers.

In other business:

  • heard Bobby Simpson’s report on the Safety Committee (See related story, “Hagan: City Council was never informed of AG’s Open Meetings ruling” ).
  • the council approved a request to close streets as required for the Cox’s Creek Elementary School Bulldog 5K walk/run. The event was canceled and rescheduled for Sept. 29;
  • the council authorized the mayor to renew the city’s agreement to follow the county’s housing, building and construction codes;
  • the council approved Mary Keene’s appointment to the Historical Review Board. She will fill the unexpired term of Mary Carey through Jan. 10, 2014.
  • the council approved the minutes of its June 26, 2012 meeting;
  • recongized Joe Cecil for his 10 years of service at the water treatment plant.

The Bardstown City Council will meet next at 7 p.m. July 24, 2012.
