Thursday, Aug. 2, 2012, 5 p.m. — Nelson County Attorney John S. Kelley Jr. announced today he will resign as county attorney if his son is elected to the position of district judge in November.

His son, John S. “Jack” Kelley V, has filed to run for judge in the state’s 57th judicial district — the seat formerly held by Judge Robert W. “Bob” Heaton, who died last month.

“There would be too many insurmountable conflicts for me to continue to serve as County Attorney if my son is elected district judge,” the senior Kelley said in a press release. “It is time to turn over the legal leadership positions to the next generation.”

John Kelley began practicing law October 20, 1981.  He is in his 14th year as Nelson County Attorney.

“My son is qualified for the position of Nelson District Judge.  He has spent the last three years practicing in all aspects of District Court.  Over the time period he has probably spent more time involved in District Court matters than any other attorney.”

Former District Judge Tom Dawson has also filed for the position. The filing deadline is 4 p.m. Tuesday, Aug. 14.
