Nelson Circuit Court Indictments-May 1, 2013

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

Thursday, May 2, 2013 – The following people were indicted by a Nelson County grand jury on Wednesday, May 1, 2013. They are set for arraignment on Thursday, May 16, 2013, unless otherwise indicated.

13-CR-77. Jeffrey Franklin Gehlbach, 39, Cox’s Creek, possession of a controlled substance, first-degree (2 counts); possession of controlled substance, third-degree (2 counts); possession of drug paraphernalia; possession of marijuana; possession of prescription not in a proper container.

According to the indictment, on April 7, 2013, Gehlbach was allegedly in unlawful possession of oxycodone, marijuana, and an unspecified drug. The indictment also states he was allegedly in possession of drug paraphernalia and a prescription medication not in the proper container. Bail was set at $5,000 cash only, plus conditions.

13-CR-90. Breon Tyree Maddox, 29, Bardstown, trafficking in marijuana (less than 8 oz.); tampering with physical evidence; possession of drug paraphernalia; endangering the welfare of a minor (2 counts); persistent felony offender, second-degree.

According to the indictment, on April 12, 2013, Maddox was allegedly in unlawful possession of less than 8 ounces of marijuana with the intent to sell. The indictment further alleges Maddox was in possession of drug paraphernalia, and believing an official proceeding was pending, hid marijuana in his shoes. The indictment cites Maddox’s previous felony conviction as the basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

13-CR-91. Susan Collette Marlow, 48, Bardstown, murder.

13-CR-92. Kevin D. Kerner, 42, Bardstown, theft by deception, $500 or more (2 counts); persistent felony offender, second-degree.

According to the indictment, on the Nov. 13, 2012, and Nov. 29, 2012, Kerner allegedly passed checks at Five Star and Thompson Food Mart knowing they would not be honored by Fort Knox Credit Union and Kentucky Home Bank, with a value of more than $500 but less than $10,000. The indictment cites Kerner’s previous felony conviction as the basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

13-CR-93. Joseph Alen Hartlage,33, Shepherdsville, receiving stolen property and complicity to the same.

According to the indictment, on April 18, 2013, Hartlage, either acting alone or in concert with Carl Joiner III, allegedly received, retained or disposed of a Sycamore Apex 3 generator knowing or having reason to believe it was stolen, having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

13-CR-94. Dylan Lee Hahn, 19, New Haven, assault, first-degree.

According to the indictment, on April 20, 2013, Hahn allegedly stabbed an individual in the stomach. Bail was set at $100,000 cash only, plus conditions.

13-CR-95. Carl Edward Joiner III, 32, Shepherdsville, receiving stolen property and complicity to the same.

According to the indictment, on April 18, 2013, Joiner, acting alone or in concert with Joseph Alen Hartlage, allegedly received, retained or disposed of a Sycamore Apex 3 generator knowing or having reason to believe it was stolen, having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

13-CR-96. Cory Steven Marshall, 28, Bardstown, obtaining a controlled substance by fraud (3 counts); persistent felony offender, second-degree.

According to the indictment, on Feb. 22, Feb. 25 and March 1, 2013, Marshall allegedly obtained Hydrocodone pills by knowingly making a false statement regarding a prescription filled at Krogers’ pharmacy. The indictment cites Marshall’s previous felony conviction as the basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

12-CR-092 (amended indictment). Michael J. Marino, 49, Bardstown, first-degree burglary.

According to the indictment, on July 31, 2000, Marino allegedly unlawfully entered or remained in Federal Hill Nursing Home with the intent to commit a crime and cause injury. Bail was set at $50,000 cash only, plus conditions.
