Nelson Circuit Court Indictments — July 3, 2013

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

Saturday, July 6, 2013 – The following people were indicted by a Nelson County grand jury on Wednesday, July 3, 2013. They are set for arraignment on Thursday, July 18, 2013, unless otherwise indicated.

 

13-CR-142. Steven Lawrence Edelen, 36, Bardstown, trafficking in controlled substances, first-degree, and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Oct. 1, 2012, Edelen, acting alone or in concert with Terry Souleotes, allegedly sold less than 10 units of morphine to a confidential source. The indictment cites Edelen’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000, cash only plus conditions.

13-CR-143. Samuel Coner Mays, 19, Louisville, burglary, third-degree (2 counts); tampering with physical evidence; possession of controlled substances, third-degree; criminal mischief, first-degree; possession of a prescription not in a proper container; persistent felony offender, second-degree.

According to the indictment, between June 15 and June 16, 2013, Mays allegedly entered Bloomfield Fertilizer and Whites Auction House with the intent to commit a crime, damaging property belonging to Bloomfield Fertilizer having the value of more than $1,000. On June 17, 2013, the indictment alleges Mays, while in possession of Xanax pills not in their proper container, stepped on a bag of pills crushing them in an attempt to impair its availability in an official proceeding. The indictment cites Mays’ prior felony convictions as basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

13-CR-144. Terry Dale Souleotes, 62, Bardstown, trafficking in controlled substances, first-degree (4 counts) and complicity to the same (4 counts); possession of drug paraphernalia (4 counts) and complicity to the same (4 counts).

According to the indictment, between Oct. 1 and Oct. 22, 2012, Souleotes, acting alone or in concert with Steve Edelen, sold more than 10 dosage units of morphine to a confidential source while in possession of drug paraphernalia. On Oct. 12 and Oct. 17, 2012, the indictment alleges that Souleotes, acting alone or in concert with Sally Barnes, sold 10 or more dosage units of morphine to a confidential source while in possession of drug paraphernalia. The indictment further alleges that on Oct. 22, 2012, Souleotes, acting alone or in concert with Sally Barnes and Paul Barnes possessed drug paraphernalia; and on Jan. 21, 2013, Souleotes, acting alone or in concert with Paul Barnes, possessed drug paraphernalia and sold 10 or more dosage units of morphine to a confidential source. Bail was set at $25,000 cash only, plus conditions.

13-CR-145. Courtney Lynn Louden Clark, 19, Christmas, Fla., theft by unlawful taking and complicity to same; theft of a controlled substance and complicity to the same; criminal mischief, third-degree and complicity to the same.

According to the indictment, on June 11, 2013, Clark, acting alone or in concert with Andrew Clark, allegedly took various household items, jewelry and prescription medicines tramadol and oxycodone belonging to other individuals and having a value of $500 or more but less than $10,000 and damaging property belonging to others having a value of less than $500. Bail was set at $20,000 cash only, plus conditions.

13-CR-146. Sally Christine Barnes, 33, Bardstown, trafficking in controlled substances, first-degree, less than 10 dosage units, drug unspecified, schedule 1 and 2, and complicity to the same; trafficking in controlled substances, first-degree, 10 or more dosage units, drug unspecified, schedule 1 and 2, and complicity to the same (2 counts); endangering the welfare of a minor; possession of drug paraphernalia and complicity to the same (3 counts); falsely reporting an incident; trafficking in marijuana, less than 8 ounces, and complicity to the same; persistent felony offender, second-degree.

According to the indictment:

On Oct. 12, 2012, Barnes, acting alone or in concert with Terry Souleotes, allegedly sold 10 or more dosage units of morphine to a confidential source while in the possession of drug paraphernalia; failed to exercise reasonable diligence to prevent a child from becoming neglected; and reported she was driving a vehicle involved in a traffic accident when she was not the driver;

On Oct. 17, 2012, Barnes, acting alone or in concert with Terry Souleotes and Paul Barnes, allegedly sold 10 or more dosage units of morphine to a confidential source while in possession of drug paraphernalia

Oct Oct. 22, 2012, Barnes, acting alone or in concert with Terry Souleotes and Paul Barnes, allegedly sold less than 10 dosage units of morphine to a confidential source while in the possession of drug paraphernalia;

On Oct. 22, 2012, Barnes, acting along or in concert with Paul Barnes, allegedly possessed less than 8 ounces of marijuana with the intent to sell.

The indictment cites Barnes’ prior felony conviction as the basis for the persistent felony offender, second-degree charge. Bail was set at $25,000 cash only, plus conditions.

13-CR-147. Andrew Ellis Clark, 25, theft by unlawful taking and complicity to same; theft of a controlled substance and complicity to the same; criminal mischief, third-degree and complicity to the same.

According to the indictment, on June 11, 2013, Clark, acting alone or in concert with Courtney Clark, allegedly took various household items, jewelry and prescription medicines tramadol and oxycodone belonging to other individuals and having a value of $500 or more but less than $10,000 while damaging property belonging to others having a value of less than $500. Bail was set at $20,000 cash only, plus conditions.

13-CR-148. Paul Jarrod Barnes, 32, Bardstown, trafficking in controlled substances, first-degree, less than 10 dosage units, drug unspecified, schedule 1 and 2, and complicity to the same; trafficking in controlled substances, first-degree, 10 or more dosage units, drug unspecified, schedule 1 and 2, and complicity to the same (2 counts); possession of drug paraphernalia and complicity to the same (3 counts); falsely reporting an incident; trafficking in marijuana, less than 8 ounces, and complicity to the same; persistent felony offender, second-degree.

According to the indictment:

On Oct. 17, 2012, Barnes, acting alone or in concert with Terry Souleotes and Sally Barnes, allegedly sold 10 or more dosage units of morphine to a confidential source while in possession of drug paraphernalia;

Oct Oct. 22, 2012, Barnes, acting alone or in concert with Terry Souleotes and Sally Barnes, allegedly sold less than 10 dosage units of morphine to a confidential source while in the possession of drug paraphernalia;

On Oct. 12, 2013, Barnes, acting alone or in concert with his wife, Sally Barnes, falsely reported that his wife was driving a vehicle involved in a traffic accident on Sept. 24, 2012, when she was not the driver;

On Oct. 22, 2012, Barnes, acting along or in concert with Sally Barnes, allegedly possessed less than 8 ounces of marijuana with the intent to sell;

On Jan. 21, 2013, Barnes, acting alone or in concert with Sally Barnes, sold 10 or more dosage units of morphine to a confidential source while in the possession of drug paraphernalia;

The indictment cites Barnes’ prior felony conviction as the basis for the persistent felony offender, second-degree charge. Bail was set at $25,000 cash only, plus conditions.

13-CR-149. Randall Woosley aka Michael Dewayne Willis, 53, Louisville, receiving stolen property; theft of identity of another without consent; giving police officer false name or address; no operators license.

According to the indictment, on April 23, 2013, Woosley allegedly received, retained or disposed of a 2000 Dodge Van belonging to another person having reason to believe it was stolen and having a value of $500 or more but less than $10,000. The indictment alleges that Woosley stole another person’s identity and gave another person’s name and Social Security card to a police officer when stopped for a traffic offense, and that he had no valid operators license. Bail was set at $20,000 cash only, plus conditions.

13-CR-150. Jeffrey M. Johnson, 50, Cox’s Creek, possession of controlled substance, first-degree; tampering with physical evidence; possession of drug paraphernalia.

According to the indictment, on June 25, 2013, Johnson allegedly possessed methamphetamine and drug paraphernalia, and threw an aluminum boat commonly used for meth on the ground to impair its verity or availability in an official proceeding. Bail was set $5,000 cash only, plus conditions.

13-CR-151. Linda Joyce Carrier, 65, Bardstown, trafficking in controlled substances, first-degree, and complicity to the same; tampering with physical evidence; trafficking in controlled substances, third-degree; possession of drug paraphernalia and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Nov. 29, 2012, Carrier, acting alone or in concert with Elbert Carrier, sold 10 or more dosage units of oxycodone to a confidential source while in the possession of drug paraphernalia. The indictment further alleges that on Oct. 3, 2012, Carrier sold alprazolam to a confidential source, and removed a label from a prescription pill bottle with the intent to impair its verity or availability in an official proceeding. The indictment cites Carrier’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

13-CR-152. Kalin Markess Williams, 23, Bardstown, burglary, second-degree; theft by unlawful taking; persistent felony offender, second-degree.

According to the indictment, on May 2 or 3, 2013, Williams allegedly entered a residence belonging to another person with the intent to commit a crime, taking four 22-inch rims with tires having a value of $500 or more but less than $10,000. The indictment cites Williams’ prior felony convictions as basis for the persistent felony offender charge. Bail was set at $25,000 cash only plus conditions.

13-CR-153. Elbert W. Carrier, 59, Bardstown, trafficking in controlled substances, 10 or more dosage units opiates and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Nov. 29, 2012, Carrier, acting along or in concert with Linda Carrier, allegedly sold 10 or more dosage units of oxycodone to a confidential sources while in possession of drug paraphernalia. Bail was set at $20,000 cash only, plus conditions.

13-CR-154. Joseph “Josey” W. Martin, 28, attempted murder; wanton endangerment, first-degree; possession of drug paraphernalia; operating a motor vehicle under the influence of alcohol/drugs/etc.; possession of open alcohol beverage container in a motor vehicle.

According to the indictment, on May 27, 2013, Martin attempted to murder a man by running over him with his vehicle while operating the vehicle under the influence of alcohol/drugs/etc., and in possession of drug paraphernalia and possession of an open alcohol beverage container in his motor vehicle. Bail was set at $100,000 cash only, plus conditions.

13-CR-155. Tabitha Sue Becker, 45, theft by unlawful taking; unlawful access to a computer, second-degree.

According to the indictment, between June 2012 and March 31, 2013, Becker allegedly took various items belonging to another person, and unlawfully used a computer to access a computer network resulting in the loss or damage of $300 or more without the consent of the victim. Bail was set at $5,000.

13-CR-156. Amanda Lucille Swift, 25, Bardsdtown, theft of identity of another without consent (4 counts); false statement as to identity of financial condition; forgery, second-degree (4 counts); receiving stolen property.

According to the indictment, between May 29, 2013 and June 18, 2013, Swift allegedly stole the identify of another person, obtained a driver’s license and made false statements to obtain a credit or debit card and loan checks from World Finance Corp., First Financial Credit. The indictment further states between May 6, 2013 and June 20, 2013, Swift allegedly received, retained or disposed of various household items, including jewelry, a guitar, a Nikon camera and electronics belonging to another person, having the value of $500 or more but less than $10,000. Bail was set at $20,000 cash only, plus conditions.

13-CR-157. Brian Scott Downs, 35, Bardstown, robbery, first-degree; theft by unlawful taking under $500.

According to the indictment, on June 16, 2013, Downs allegedly threatened physical force while armed with a gun in order to take from the less than $500 from Domino’s Pizza. Bail was set at $50,000 cash only, plus conditions.

13-CR-158. Lauren Marie Gardner, 26, possession of a controlled substance, first-degree; possession of drug paraphernalia.

According to the indictment, on May 2, 2013, Gardner allegedly possessed cocaine and drug paraphernalia. Bail was set at $2,500 cash only, plus conditions.

13-CR-159. Christopher Dale Farnsley, 31, Lanesville, Ind., promoting contraband, first-degree; possession of controlled substances, first-degree; possession of a prescription not in proper container; possession of marijuana.

According to the indictment, on May 11, 2013, Farnsley was allegedly found in possession of marijuana; a prescription not in its proper container; and an unspecified drug. The indictment further alleges on the same date Farnsley knowingly introduced xanas and valium into the Nelson County Jail. Bail was set at $9,500 cash only, plus conditions.
