Nelson Circuit Court Indictments, July 17, 2013

Friday, July 19, 2013 – The following people were indicted by a Nelson County grand jury on Wednesday, July 17, 2013. They are set for arraignment on Thursday, Aug. 8, 2013, unless otherwise indicated.

13-CR-130. Wasika Bernice Duque, 29, Bardstown, wanton endangerment, first-degree and complicity; assault fourth-degree.

According to the indictment, on June 11, 2013, Duque — acting alone or in concert with Julie Gonzales and Julie Gonzales — allegedly pushed a large piece of furniture onto a woman who at the time was holding a two-year-old child. The indictment further alleges Duque allegedly kicked and pulled the hair of the same woman, causing minor injuries. Bail was set at $2,500 cash only, plus conditions.

13-CR-161. Robert Franklin Garrett, 20, Bardstown, possession of a handgun by a convicted felon; unlawful transaction with a minor, second-degree (2 counts); theft by unlawful taking-firearm (2 counts) and complicity to the same; theft by unlawful taking, from auto, and complicity to same.

According to the indictment, on June 11, 2013, Garrett — acting alone or in concert with two juveniles — allegedly stole a Raven Arms .25 caliber handgun, and a Davis Industries .380 caliber handgun, as well as various electronics, clothing, coins, purses and knives belonging to six other people with a value of more than $500 but less than $10,000. Due to the involvement of the two juveniles, Garrett was charged for causing two minors to knowingly engage in a felony. Bail was set at $50,000 cash only, plus conditions.

13-CR-163. John Carlos Lewis, 26, Bardstown, possession of controlled substance, first-degree; tampering with physical evidence; trafficking in marijuana (less than 8 ounces); possession of drug paraphernalia; persistent felony offender, second-degree.

According to the indictment, on June 6, 2013, Lewis allegedly possessed 8 ounces or less of marijuana with intent to sell. He was also allegedly found in possession of cocaine and drug paraphernalia, and tried to hid money under a towel that a police evidence dog indicted on, and /or hid marijuana on his person with the intent to impair its verity or availability in an official proceeding. The indictment cited Lewis’ prior felony convictions as the basis for the persistent felony offender, second-degree charge. Bail was set at $9,500 cash only, plus conditions.

13-CR-165. Stephanie Lashay Hodges, 30, Boston, Ky., trafficking in controlled substances, first-degree, less than 4 grams cocaine and complicity to the same; possession of drug paraphernalia and complicity to same.

According to the indictment, on Jan. 10, 2013, Hodges — acting along or in concert with Brandie Hahn, sold cocaine in an amount less than 4 grams to a confidential source while in possession of drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

13-CR-166. Jarvis Wayne Madison, 54, Georgetown, Ind., unlawful imprisonment, first-degree; wanton endangerment, first-degree; theft by unlawful taking; assault, fourth-degree; violation of a Kentucky EPO/DVO.

According to the indictment, Madison unlawfully restrained a Bardstown woman in a residence; grabbed her by the arm and caused bruising; pointed a gun at her and took household items having a value of $500 or more but less than $10,000 while in violation of an existing Emergency Protective Order. Bail was set at $5,000 cash only, plus conditions.

13-CR-167. Brandie Michelle Hahn, 28, Bardstown, trafficking in controlled substances, first-degree, less than 4 grams cocaine, plus complicity to same; possession of drug paraphernalia and complicity to same.

According to the indictment, on Jan. 10, 2013, Hahn — acting along or in concert with Stephanie Hodges, sold cocaine in an amount less than 4 grams to a confidential source while in possession of drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

13-CR-168. Kevin T. Hellard, 38, Bardstown, receiving stolen property.

According to the indictment, on July 10, 2013, Hellard allegedly received, retained or disposed of a Canon T3i camera belonging to another person, knowing it was stolen or having reason to believe it was, having a value of more than $500 but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

13-CR-169. William Troy Kays, 32, Bardstown, flagrant non-support.

According to the indictment, Kays allegedly failed to provide support he was order to pay, resulting in an arrearage of $2,018.82. Bail was set at $2,500 cash only, plus conditions.

13-CR-170. Julie Gail Vatter, 48, New Haven, welfare fraud (over $100).

According to the indictment, from May 1, 2011, through Aug. 20, 2012, Vatter allegedly failed to advise the Department for Community Based Services of her correct household circumstances and received $4,688 in Supplemental Nutrition Assistance Program (SNAP) benefits to which she was not legally entitled. Bail was set at $2,500 cash only, plus conditions.
