Nelson Circuit Court Indictments, Sept. 4, 2013

Friday, Sept. 13, 2013 – The following people were indicted by a Nelson County grand jury on Wednesday, Sept. 4, 2013. They are set for arraignment on Thursday, Sept. 19, 2013, unless otherwise indicated.
13-CR-203. Kristin E. Newton, 22, Bardstown, possession of a controlled substance, first-degree and complicity to the same; possession of drug paraphernalia and complicity to the same.
According to the indictment, on Feb. 15, 2013, Newton — acting alone or in concert with Dewey Burnett — was allegedly found in unlawful possession of cocaine and drug paraphernalia. Bail was set at $9,500 cash only plus conditions.
13-CR-204. Justin David Borders, 24, Bardstown, possession of a forged instrument, second-degree (2 counts); possession of a controlled substance, first-degree and complicity to the same; possession of a firearm while committing an offense; possession of drug paraphernalia and complicity to the same.
According to the indictment, on Jan. 14, 2013, Borders allegedly was in possession of two forged checks in the amount of $89.89 and $30 on the account of another person with the intent to defraud, deceive or injure another. On Feb. 5, 2013, Borders — acting alone or in concert with Jessica Johnson — was allegedly in possession of heroin and drug paraphernalia. The indictment further states that Border was allegedly in possession of a .357 caliber revolver at the time he possessed drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.
13-CR-205. Dewey A. Burnett, 29, Bardstown, possession of a controlled substance, first-degree and complicity to the same; possession of drug paraphernalia and complicity to the same. persistent felony offender, first-degree.
According to the indictment, on Feb. 15, 2013, Burnett — acting alone or in concert with Kristin Newton — unlawfully possessed cocaine and drug paraphernalia. The indictment cites Burnett’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
13-CR-206. Jessica N. Johnson, 31, Bardstown, possession of a controlled substance, first-degree, and complicity to the same; possession of a firearm while committing an offense; possession of drug paraphernalia and complicity to the same.
According to the indictment, on Feb. 5, 2013, Johnson — acting alone or in concert with Justin Borders — allegedly possessed heroin and drug paraphernalia while in possession of a .357 caliber revolver. Bail was set at $9,500 cash only, plus conditions.
13-CR-207. Maceo Lee Tucker, 27, Bardstown, rape, third-degree, (6 counts); persistent felony offender, first-degree.
According to the indictment, sometime between June 7 and Aug. 16, 2013, Tucker allegedly engaged in sexual intercourse with another person less than 16 years old on six occasions. The indictment cites Tucker’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
13-CR-208. Kalin Markess Williams, 24, Bardstown, intimidating a participant in a legal process; persistent felony offender, second-degree.
According to the indictment, sometime between July 30 and Aug 1, 2013, Williams allegedly attempted to intimidate, threaten and scare individuals Williams believed to be involved in a legal proceeding. The indictment cites Williams’ prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
13-CR-209. James Selvey Vittitoe III, 34, Bardstown, burglarly, third-degree; criminal mischief, first-degree; theft by unlawful taking; persistent felony offender, first-degree.
According to the indictment, on July 5, 2013, Vittitoe allegedly entered someone’s garage unlawfully with the intent to commit a crime creating $1,000 or more in damage and attempting to take two vehicles valued at less than $300. The indictment cites Vittitoe’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
13-CR-210. Justin Michael Browning, 22, Bardstown,1 assault, third-degree; criminal mischief, first-degree; fleeing and evading police, second-degree (on foot); resisting arrest; persistent felony offender, first-degree.
According to the indictment, on Aug. 8, 2013, Browning allegedly disobeyed a peace officer’s direction to stop and attempted to elude police. Browning allegedly fought with Deputy Michael Clark of the Nelson County Sheriff’s Office while being arrested, striking him in the chest, kicking and throwing his arms wildly while resisting arrest and causing damage to property belonging to the sheriff’s office having a value of $1,000 or more. The indictment cites Browning’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
13-CR-211. Jacob A. Jury, 22, Bardstown, trafficking in controlled substances, first-degree, less than 2 grams of heroin; tampering with physical evidence; possession of drug paraphernalia; operating a motor vehicle while under the influence of alcohol/drugs/etc.
According to the indictment, on May 16, 2013, Jury allegedly was in possession of drug paraphernalia and less than two grams of heroin with the intent to sell or transfer it. When Jury believed an official proceeding was pending, he allegedly hid several syringes under the driver’s seat. He is also charged with allegedly operating a motor vehicle under the influence of alcohol and/or drugs. Bail was set at $9,500 cash only, plus conditions.
13-CR-212. Brandon Eugene Humphrey, 31, Bardstown, trafficking in controlled substances, first-degree; trafficking in controlled substances, second-degree; trafficking in controlled substances within 1,000 feet of a school; possession of drug paraphernalia (2 counts); persistent felony offender, first-degree.
According to the indictment, on Oct. 18, 2012, Humphrey allegedly sold less than four grams of cocaine to a confidential informant while in possession of drug paraphernalia. On Nov. 12, 2012, Humphrey allegedly sold hydrocodone pills to a confidential informant within 1,000 feet of Bethlehem High School while in possession of drug paraphernalia. The indictment cites Humphrey’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
13-CR-213. Chad E. Nix, 32, Boston, possession of a controlled substance, first-degree.
According to the indictment, on July 5, 2013, Nix is alleged to have unlawfully possessed cocaine. Bail was set at $5,000 cash only, plus conditions.
13-CR-214. Larry Carnes, 41, Bardstown, trafficking in controlled substances, first-degree, 10 or more dosage units (2 counts) and complicity to the same; possession of drug paraphernalia (2 counts) and complicity to the same.
According to the indictment, on Sept. 26, 2012, Carnes — acting alone or in concert with Angela Carnes — allegedly sold 10 or more dosage units of morphine pills to a confidential source while in possession of drug paraphernalia. On Dec. 18, 2012, Carnes — acting alone or in concert with Angela Carnes — sold 10 or more dosage units of morphine pills while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.
13-CR-215. Coy Lee Tucker, 26, Louisville, assault, second-degree; persistent felony offender, second-degree.
According to the indictment, on Aug. 28, 2013, Tucker allegedly struck a woman knocking her to the ground and then struck her repeatedly. The indictment cites Tucker’s prior felony conviction as basis for the persistent felony offender charge.
13-CR-216. Angela Carnes, 41, Bardstown, trafficking in controlled substances, first-degree, 10 or more dosage units (3 counts); complicity to trafficking in controlled substances, first-degree, 10 or more dosage units (2 counts); possession of drug paraphernalia (2 counts) and complicity to the same.
According to the indictment, on Aug. 29, 2012, Carnes allegedly sold 10 or more dosage units of morphine bills to a confidential source. On Sept. 26, 2012, Carnes — acting alone or in concert with Larry Carnes — allegedly sold 10 or more dosage units of morphine pills to a confidential source while in possession of drug paraphernalia. On Dec. 18, 2012, Carnes — acting alone or in concert with Larry Carnes — sold 10 or more dosage units of morphine pills while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.
13-CR-217. Timothy Aaron Ball, 28, New Haven, manufacturing methamphetamine, first-degree; possession of drug paraphernalia.
According to the indictment, on May 16, 2013, Ball allegedly manufactured methamphetamine while in possession of drug paraphernalia. Bail was set at $50,000 cash only, plus conditions.
