Nelson Circuit Court Indictments — Aug. 20, 2014

indictmentThursday, Aug. 21, 2014 – The following people were indicted by a Nelson County grand jury on Wednesday, Aug. 20, 2014. They are scheduled for arraignment Thursday, Sept. 4, 2014, unless otherwise indicated.

14-CR-199.  Joseph Darrell Wade Jr., 36, Cox’s Creek, manufacturing methamphetamine; tampering with physical evidence; possession of a controlled substance, first-degree; possession of drug paraphernalia; possession of marijuana.

According to the indictment, on Feb. 7, 2014, Wade allegedly possessed and manufactured methamphetamine while in possession of drug paraphernalia and marijuana. The indictment further states that when Wade believed an official proceeded was eminent, he allegedly hid a smoker bottle in a toilet. Bail was set at $50,000 cash only, plus conditions.

14-CR-200. Jolene L. Gerald, 30, Bardstown, possession of controlled substances, first-degree; promoting contraband, first-degree; tampering with physical evidence.

According to the indictment, on July 28, 2014, Gerald allegedly was in possession of oxycodone, and knowingly introduced oxycodone into the Nelson County Jail. The indictment further states that when Gerald believed an official proceeding was eminent, she allegedly hid a small plastic bag insider her vagina with the intent to impair its availability. Bail was set at $9,500 cash only, plus conditions.

14-CR-201. Nancye B. Avis, 39, Bardstown, theft by deception, $500 or more; endangering the welfare of a minor.

According to the indictment, between Jan. 1, 2012 and Dec. 30, 2013, Avis allegedly falsely informed St. Joseph School and other professionals in the community that her son had cancer and benefited from several fundraisers having the value of $500 or more but less than $10,000. The indictment further alleges Avis failed a minor in her custody from becoming neglected. Bail was set at $25,000 cash only, plus conditions.

14-CR-202. Johnny Dean Johnson, 50, Bardstown, stalking, first-degree; persistent felony offender, first-degree.

According to the indictment, on Aug. 7, 2014, Johnson allegedly followed a female victim at her workplace, attempted to follow her after work and intentionally stalking her for weeks, intentionally placing her in reasonable fear of physical injury or death. The indictment cited Johnson’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

14-CR-203. Douglas C. Tucker, 40, Bardstown, possession of controlled substance, first-degree (cocaine); tampering with physical evidence; possession of an open alcohol beverage container in a motor vehicle; failure to wear seat belt; persistent felony offender, second-degree.

According to the indictment, on May 24, 2014, Tucker allegedly possessed cocaine and threw a bag containing cocaine to impair its availability in an official proceeding. The indictment further alleges Tucker was in possession of an open alcohol beverage in his vehicle while not wearing a seat belt. The indictment cites Tucker’s prior felony conviction as the basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

14-CR-204. James D. Leslie, 51, Bardstown, possession of matter portraying a sexual performance by a minor (466 counts).

According to the indictment, between Aug. 15, 2012 and Nov. 8, 2012, Leslie allegedly possessed matter that visually depicted an actual sexual performance by a minor. Bail was set at $50,000 cash only, plus conditions.

14-CR-205. Brian G. Hipps, 41, Roanoke, Texas, flagrant non-support.

According to the indictment, from June 1, 2004 and July 31, 2014, Hipps allegedly failed to provide support he was ordered to pay, resulting in an arrearage of $16,682.92. Bail was set at $5,000 cash only, plus conditions.
