Nelson Circuit Court Indictments — Oct. 1, 2014

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentThursday, Sept. 4, 2014 – The following people were indicted by a Nelson County grand jury on Wednesday, Oct. 1, 2014. They are scheduled for arraignment Thursday, Oct. 16, 2014, unless otherwise indicated.

14-CR-230. Austin W. Lavorn, 18, Bardstown, burglary, first-degree and complicity to the same; theft by unlawful taking or disposition – firearm and complicity to the same; theft by unlawful taking/disposition, all others, $500 or more but less than $10,000 and complicity to the same.

According to the indictment, on July 24, 2014, Lavorn — acting alone or in concert with Skylar D. Blaine, Brandon M. Rogers and Donovan Pitmon — allegedly entered a person’s residence with the intent to commit a crime, taking a Glock 9 mm pistol, a Winchester 30-30 rifle, jewelry, cameras, a crossbow and other items. Bail was set at $25,000 unsecured, plus conditions.

14-CR-242. Skylar D. Blaine, 19, Chaplin, burglary, first-degree and complicity to the same; theft by unlawful taking or disposition – firearm and complicity to the same; theft by unlawful taking/disposition, all others, $500 or more but less than $10,000 and complicity to the same.

According to the indictment, on July 24, 2014, Blaine — acting alone or in concert with Austin W. Lavorn, Brandon M. Rogers and Donovan Pitmon — allegedly entered a person’s residence with the intent to commit a crime, taking a Glock 9 mm pistol, a Winchester 30-30 rifle, jewelry, cameras, a crossbow and other items. Bail was set at $25,000 cash only, plus conditions.

14-CR-234. Donovan Pitmon, 18, Bardstown, burglary, first-degree and complicity to the same; theft by unlawful taking or disposition – firearm and complicity to the same; theft by unlawful taking/disposition, all others, $500 or more but less than $10,000 and complicity to the same.

According to the indictment, on July 24, 2014, Blaine — acting alone or in concert with Austin W. Lavorn, Skylar D. Blaine and Brandon M. Rogers — allegedly entered a person’s residence with the intent to commit a crime, taking a Glock 9 mm pistol, a Winchester 30-30 rifle, jewelry, cameras, a crossbow and other items. Bail was set at $25,000 cash only, plus conditions.

14-CR-236. Brandon M. Rogers, 18, Chaplin, burglary, first-degree and complicity to the same; theft by unlawful taking or disposition – firearm and complicity to the same; theft by unlawful taking/disposition, all others, $500 or more but less than $10,000 and complicity to the same.

According to the indictment, on July 24, 2014, Rogers — acting alone or in concert with Austin W. Lavorn, Skylar D. Blaine and Donovan Pitmon — allegedly entered a person’s residence with the intent to commit a crime, taking a Glock 9 mm pistol, a Winchester 30-30 rifle, jewelry, cameras, a crossbow and other items. Bail was set at $25,000 cash only, plus conditions.

14-CR-238. John O’Neal Shelton, 42, Bardstown, burglary, second-degree and complicity to the same; theft by unlawful taking or disposition, all others, $500 or more but less than $10,000 and complicity to the same.

According to the indictment, on Sept. 13, 2014, Shelton — acting alone or in concert with Rebecca Cassity — allegedly entered a residence with the intent to commit a crime and took an iPad, jewelry, tools and other items having a value of $500 or more but less than $10,000. Bail was set at $20,000 cash only, plus conditions.

14-CR-240. Rebecca Cassity, 23, Bardstown, burglary, second-degree and complicity to the same; theft by unlawful taking or disposition, all others, $500 or more but less than $10,000 and complicity to the same.

According to the indictment, on Sept. 13, 2014, Cassity — acting alone or in concert with John O’Neal Shelton — allegedly entered a residence with the intent to commit a crime and took an iPad, jewelry, tools and other items having a value of $500 or more but less than $10,000. Bail was set at $20,000 cash only, plus conditions.

14-CR-242. Helmer Duverge, 51, Bardstown, assault, second-degree.

According to the indictment, on Sept. 5, 2014, Duverge allegedly stabbed another person in the arm and back areas with a 13-inch black handled kitchen knife. Bail was set at $50,000 cash only, plus conditions.

14-CR-244. Donald B. Lewis, 37, Bardstown, manufacturing methamphetamine; possession of drug paraphernalia; persistent felony offender, first-degree.

According to the indictment, on Aug. 16, 2014, Lewis allegedly manufactured methamphetamine while in possession of drug paraphernalia. The indictment cites his prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $100,000 cash only, plus conditions.

14-CR-246. James Kevin Muncy, 53, Bardstown, cultivating marijuana, 5 or more plants; trafficking in marijuana (less than 8 ounces); possession of marijuana; possession of drug paraphernalia; cruelty to animals, second-degree.

According to the indictment, on Aug. 19, 2014, Muncy allegedly cultivated more than five marijuana plants and possessed less than 8 ounces of marijuana with the intent to sell it while in possession of drug paraphernalia. The indictment further alleges Muncy subjected animals in his custody to cruel neglect. Bail was set at $25,000 cash only, plus conditions.

14-CR-248. Sierra N. Nester, 23, Nicholasville, burglary, second-degree; theft by unlawful taking, $500 or more but less than $10,000; persistent felony offender, second-degree.

According to the indictment on June 19, 2014, Nester allegedly entered another person’s residence with the intent to commit a crime, taking medication and jewelry having a value of $500 or more but less than $10,000. The indictment cites Nester’s prior felony conviction as the basis for the persistent felony offender charge. Bail was $25,000 cash only, plus conditions.

14-CR-250. Jeremy Jarman, 39, Fayette County Jail, burglary, third-degree; criminal mischief, third-degree; persistent felony offender, first-degree.

According to the indictment, on Jan. 24, 2014, Jarman allegedly entered the Dollar General Store with the intent to commit a crime and causing less than $500 damage in the process. The indictment cites Jarman’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

14-CR-252. Edgar J. Norton,27, Bardstown, bail jumping, first-degree.

According to the indictment, on Sept. 19, 2014, Norton, who had been released from custody on the condition he would appear at a specified time and place failed to appear for his pretrial conference in Nelson Circuit Court. Bail was set at $50,000 cash only, plus conditions.

14-CR-253. Michael N. Crume, 26, Bardstown, abandonment of a minor; unlawful access to a computer, first-degree; persistent felony offender, first-degree.

According to the indictment, on Sept. 12, 2014, Crume allegedly used another person’s debit/credit card without their consent, and abandoned a minor child. The indictment cites Crume’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

14-CR-254. Joseph Cody Auberry, 20, Bardstown, burglary, third-degree; theft by unlawful taking/disposition all others, $500 or more but under $10,000.

According to the indictment, between Aug. 8 -11, 2014, Auberry allegedly entered Bardstown Middle School with the intent to commit a crime and took iPads having a value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.

14-CR-255. John Wesley Jackson, 44, Louisville, fleeing and evading police, first-degree (motor vehicle); resisting arrest; operating a motor vehicle with a suspended operators license; operating a motor vehicle under the influence of alcohol/drugs/etc.; persistent felony offender, first-degree.

According to the indictment, on Sept. 6, 2014, Jackson allegedly operated a motor vehicle under the influence of alcohol/drugs/etc. with a suspended license and attempted to flee or elude police and attempted to intentionally prevent an office from arresting him. Jackson’s earlier felony convictions were the basis for the felony offender conviction. Bail was set at $50,000 cash only, plus conditions.

14-CR-256. William Keith Janes, 58, Bardstown, cultivating marijuana, 5 or more plants; trafficking in marijuana, 8 ounces to 5 pounds; possession of a firearm by a convicted felony (21 counts); possession of a handgun by a convicted felon; possession of marijuana; and possession of drug paraphernalia.

According to the indictment, on July 23, 2014, Janes allegedly cultivated five or more marijuana plants with the intent to sell and possessed drug paraphernalia and more than 8 ounces of marijuana but less than five pounds. The indictment alleges Janes was in possession of a 21 firearms that included shotguns, muzzle loaders, handguns and rifles. Bail was set at $50,000 cash only, plus conditions.
