Nelson Circuit Court Indictments-Nov. 5, 2014

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentFriday, Nov. 7, 2014 – The following people were indicted by a Nelson County grand jury on Wednesday, Nov. 5, 2014. They are scheduled for arraignment Thursday, Nov. 20, 2014, unless otherwise indicated.

14-CR-246. James Kevin Muncy, 53, Bardstown, complicity to cultivating marijuana, five or more plants; complicity to possession of drug paraphernalia.

According to the amended indictment, on Aug. 19, 2014, Muncy — acting alone or in concert with Dewayne N. Bartley and Olivia Nicole Muncy — allegedly was in possession of drug paraphernalia while also cultivating five or more marijuana plants with the intent to see or transfer them. Bail was set at the same as primary charges from the original indictment.

14-CR-130. Lance Glaser, 33, Mount Washington, persistent felony offender, first-degree.

According to the amended indictment, Glaser was previous convicted of felony offenses in 2004 and 2008. Bail is the same as the primary charges in the original indictment.

14-CR-273. Melanie Elaine Masden, 35, Bardstown, tampering with physical evidence; possession of marijuana; possession of drug paraphernalia.

According to the indictment, on Oct. 23, 2014, Masden allegedly placed a pipe in a child’s high chair with the intent to impair its availability in an official proceeding while in possession of marijuana and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

14-CR-274. Olivia Nicole Muncy, 23, Bardstown, cultivating marijuana, five or more plants and complicity to the same; possession of drug paraphernalia and complicity to the same; endangering the welfare of a minor.

According to the indictment, on Aug. 19, 2014, Muncy — acting alone or in concert with Dewayne N. Bartley and James Kevin Muncy, possessed drug paraphernalia and cultivated five or more marijuana plants with the intent to sell or transfer the marijuana and failing to exercise reasonable diligence to prevent a child from becoming neglected. Bail was set at $9,500 cash only, plus conditions.

14-CR-275. Matthew A. Lewis, 32, Bardstown, possession of a controlled substance, first-degree (heroin) and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Aug. 27, 2014, Lewis — acting alone or in concert with Tosha M. Bartley — possessed heroin and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

14-CR-276. Dewayne N. Bartley, 26, Bardstown, cultivating marijuana, five or more plants and complicity to the same; possession of drug paraphernalia and complicity to the same; endangering the welfare of a minor (2 counts).

According to the indictment, on Aug. 19, 2014, Bartley — acting alone or in concert with Olivia Nicole Muncy and James Kevin Muncy, cultivated five or more marijuana plants with the intent to sell or transfer it while in possession of drug paraphernalia. The indictment also alleges Bartley failed to exercise reasonable diligence to prevent a child from becoming neglected. Bail was set at $9,500 cash only, plus conditions.

14-CR-277. Tosha M. Bartley, 30, Bardstown, possession of a controlled substance, first-degree (heroin) and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Aug. 27, 2014, Bartley — acting alone or in concert with Matthew A. Lewis — allegedly possessed heroin and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

14-CR-278. Kristopher Chase Fields, 31, Bardstown, possession of a controlled substance, first-degree (heroin); possession of drug paraphernalia.

According to the indictment, on Aug. 27, 2014, Fields allegedly was found in possession of heroin and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

14-CR-279. Joseph D Wade, 36, Bardstown, theft by unlawful taking/disposition-auto.

According to the indictment between Aug. 9-12, 2014, Wade allegedly took a 1997 Toyota T-100 pickup truck belonging to another person having a value of $500 or more. Bail was set at $9,500 cash only, plus conditions.

14-CR-280. John Barnett, 46, Jackson, theft by deception, $10,000 or more; persistent felony offender, first-degree.

According to the indictment, on May 15, 2014, Barnett is allegedly to knowing passed a check on a closed First National Bank account for $55,280. The persistent felony offender charge is based on previous felony convictions. Bail was set at $50,000 cash only, plus conditions.

14-CR-281. Donald J. Hedges, 53, Boston, manufacturing methamphetamine; possession of drug paraphernalia.

According to the indictment, on Oct. 30, 2014, Hedges allegedly manufactured methamphetamine and possessed drug paraphernalia. Bail was set at $50,000 cash only, plus conditions.

14-CR-282. Michael L. Light, 41, Johnson City, Tenn., flagrant non-support; persistent felony offender, second-degree.

According to the indictment, from Oct. 1, 2000 through Sept. 30, 2014, Light allegedly failed to provide support he was ordered to pay, resulting in an arrearage of $8,016.92. The indictment cites Light’s prior felony conviction as the basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

14-CR-283. Brian J. Manz, 41, Springfield, Ohio, flagrant non-support; persistent felony offender, second-degree.

According to the indictment, from April 15, 2000 through Sept. 30, 2014, Manz allegedly failed to pay support he knew he was ordered to pay, resulting in an arrearage of $10,925.29. The incident cites Manz’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

14-CR-284. Bobby Smith, 30, Mount Vernon, flagrant non-support.

According to the indictment, from Nov. 18, 2009 through April 30, 2014, Smith allegedly failed to pay support he was ordered to pay, resulting in an arrearage of $10,525.32. Bail was set at $5,000 cash only, plus conditions.

14-CR-285. Nathan T. Carter, 36, Lafayette, Ind., flagrant non-support.

According to the indictment, from Feb. 1, 2008 through Sept. 30, 2014, Carter allegedly failed to pay support he was ordered to pay, resulting in an arrearage of $6,347.34. Bail was set at $5,000 cash only, plus conditions.

14-CR-286. David Parker, 27, Bardstown, failure to comply with sex offender registry; sex offender IM/chat/social network use (3 counts); persistent felony offender, second-degree.

According to the indictment, between Feb. 1, – Sept. 24, 2014, Parker allegedly failed to register with the local probation and parole office that he had an email account. The indictment alleges that Parker also failed to register his Facebook identity of “Ben Franks,” his Playstation identity of “LilDave502,” and an Xbox Live identity of “Head Bussa” with the local probation and parole office. The indictment cites Parkers’ previous felony conviction as the basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

14-CR-287. Terri M. Garrido, 39, Bardstown, theft by unlawful taking/disposition, all others, $500 or more but under $10,000.

According to the indictment, on July 29, 2014, Garrido allegedly took a Samsung Galaxy Note 2 cellphone belonging to another person having the value of $500 or more but less than $10,000. Bail was set at $5,000 unsecured, plus conditions.

14-CR-288. Richard A. Lancaster, 38, Bardstown, possession of a controlled substance, first-degree (cocaine); possession of drug paraphernalia.

According to the indictment, on Aug 24, 2014, Lancaster allegedly possessed cocaine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

14-CR-289.  Isaac Wayne Bodine, 54, Bardstown, cultivating marijuana, five plants or more; trafficking in marijuana, five pounds or more; possession of drug paraphernalia.

According to the indictment, on Oct. 2, 2014, Bodine allegedly possessed drug paraphernalia and cultivated and possessed five pounds of marijuana with the intent to sell or transfer it. Bail was set at $9,500 cash only, plus conditions.
