Nelson Circuit Court Indictments-Dec. 17, 2014

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentFriday, Dec. 19, 2014 – The following people were indicted by a Nelson County grand jury on Wednesday, Dec. 17, 2014. They are scheduled for arraignment Thursday, Jan. 8, 2015, unless otherwise indicated.

14-CR-317. Ray A. Calbert, aka Twan Calbert, 37, Bardstown, trafficking in controlled substances, first-degree (less than 4 grams cocaine) and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Oct. 25, 2013, Calbert — acting alone or in concert with Tonya M. Johnson — allegedly sold less than four grams of cocaine to a confidential informant. The indictment cites Calbert’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $25, 000 cash only, plus conditions.

14-CR-318. Kimberly A. Phillips aka Kim A. Phillips, 31, Bardstown, trafficking in controlled substances, first-degree (less than 4 grams cocaine) (2 counts); possession of drug paraphernalia.

According to the indictment, on March 14 and April 4, 2014, Phillips allegedly sold less than four grams of cocaine to a confidential informant. On March 14, 2014, the indictment alleges Phillips was in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

14-CR-319. Tonya M. Johnson, 35, Bardstown, trafficking in controlled substances, first-degree (less than four grams cocaine) and complicity to the same.

According to the indictment, on Oct. 25, 2013, Johnson — acting alone or in concert with Ray A. Calbert — allegedly sold less than four grams of cocaine to a confidential informant. Bail was set at $9,500 cash only, plus conditions.

14-CR-320. Brittany R. Caldwell, 28, Elizabethtown, trafficking in controlled substances within 1,000 feet of a school and complicity to the same; trafficking in marijuana and complicity to the same; possession of drug paraphernalia; endangering the welfare of a minor.

According to the indictment, on Aug. 11, 2014, Caldwell — acting alone or in concert with someone else — allegedly sold marijuana to a confidential informant within 1,000 feet of the Boston School and possessed less than 8 ounces of marijuana and drug paraphernalia. The indictment also alleges Caldwell failed to exercise reasonable diligence to prevent a child from becoming neglected. Bail was set at $9,500 cash only, plus conditions.

14-CR-321. Timothy W. Bellendier II, 24, Bardstown, promoting contraband, first-degree; persistent felony offender, first-degree.

According to the indictment, on Nov. 8, 2014, Bellendier allegedly introduced various pills, tobacco and a lighter into the Nelson County Jail. The indictment cites Bellendier’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

14-CR-322. Zachary S. Pranger, 20, Bardstown, tampering with physical evidence; possession of a controlled substance, first-degree (drug unspecified); public intoxication; possession of drug paraphernalia; possession of a controlled substance, second-degree.

According to the indictment, on Nov. 28, 2014, Pranger possessed methamphetamine, codeine and drug paraphernalia while under the influence of a controlled substance or other intoxicating substance. The indictment further alleges Pranger, when believing an official proceeding was pending, attempted to conceal a syringe containing an unknown substance. Bail was set at $5,000 cash only, plus conditions.

14-CR-323. Kristen Elizabeth Newton, 24, Bardstown, trafficking in controlled substances, second-degree (fewer than 20 dosage units of an unspecified Schedule III drug) (3 counts).

According to the indictment on Sept. 22, Sept. 25, and Sept. 29, Newton allegedly sold fewer than 20 dosage units of hydrocodone each day to a confidential informant. Bail was set at $9,500 cash only, plus conditions.

14-CR-324. Ronald G. Newberry, 61, Bardstown, burglary, first-degree; possession of controlled substance, first-degree (cocaine); criminal mischief, first-degree.

According to the indictment, on Dec. 1, 2014, Newberry allegedly entered into the Lincoln National Bank in Bardstown with the intent to commit a crime while armed with a deadly weapon, causing property damage of $1,000 or more while in possession of cocaine. Bail was set at $100,000 cash only, plus conditions.

14-CR-325. Brandon Yates, 20, Bardstown, theft by unlawful taking and complicity to the same; criminal mischief, second-degree, and complicity to the same.

According to the indictment on Nov. 14, 2014, Yates — acting alone or in concert with Ryan Joseph Malinkey — allegedly took a 2004 Chevrolet 2500 pickup truck belonging to 44 Auto Mart having a value of $10,000 or more, and damaged property with a value of $500 or more. Bail was set at $9,500 cash only, plus conditions.

14-CR-326. Margaret A. Crowe, 34, Bardstown, trafficking in controlled substances, first-degree (less than 4 grams cocaine) (2 counts) and complicity to the same; possession of drug paraphernalia and complicity to the same (2 counts).

According to the indictment, on Oct. 18 and Oct. 25, 2014, Crowe — acting alone or in concert with Kelvin S. Smith — allegedly sold less than 4 grams of cocaine to a confidential informant while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

14-CR-327. Justin Tyler Rogers, 18, Bardstown, receiving stolen property and complicity to the same; failure of non-owner operator to maintain required insurance; no operators license; speeding; reckless driving; no/expired Kentucky registration plates of receipt.

According to the indictment, on Nov. 23, 2014, Rogers — acting alone or in concert with Ryan Joseph Malinkey — allegedly received, retaining or disposed of a 2007 Pontiac G6 belonging to another person knowing it was stolen and having a value of $500 or more. On the same day, Rogers was found without his driver’s license, proof of insurance, no registration plate or registration receipt, and was operating a motor vehicle over the posted speed limit. Bail was set $9,500 cash only, plus conditions.

14-CR-328. Kelvin S. Smith, 36, Bardstown, trafficking in controlled substances, first-degree (less than 4 grams cocaine) (2 counts) and complicity to the same; possession of drug paraphernalia and complicity to the same (2 counts); persistent felony offender, second-degree.

According to the indictment, on Oct. 18 and Oct. 25, 2014, Smith — acting alone or in concert with Margaret A. Crowe — allegedly sold less than 4 grams of cocaine to a confidential informant while in possession of drug paraphernalia. The indictment cites Smith’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

14-CR-329. Justin T. Rogers, 18, Bardstown, theft by unlawful taking and complicity to the same.

According to the indictment, on Nov. 16, 2014, Rogers — acting alone or in concert with Ryan Joseph Malinkey — allegedly received, retaining or disposed of a 2006 Pontiac Grand Prix belonging to another person knowing it was stolen and having a value of $500 or more but less than $10,000. Bail was set $9,500 cash only, plus conditions.

14-CR-330. Robert W. Moore, 34, Boston, manufacturing methamphetamine and complicity to the same; controlled substance endangerment to a child, fourth-degree and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Oct. 30, 2014, Moore — acting alone or in concert with Tabitha Davis — allegedly manufactured methamphetamine while permitting a child to be present at the same time while in possession of marijuana and drug paraphernalia. The indictment cites Moore’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

14-CR-331. Ryan Joseph Malinkey, 18, Bardstown, theft by unlawful taking and complicity to the same.

According to the indictment, on Nov. 16, 2014, Malinkey — acting alone or in concert with Justin T. Rogers – allegedly took a 2006 Pontiac Grand Prix belonging to another person having a value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.

14-CR-332. Tabitha Davis, 24, Boston, manufacturing methamphetamine and complicity to the same; controlled substance endangerment to a child, fourth-degree and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Oct. 30, 2014, Davis — acting alone or in concert with Robert W. Moore — allegedly manufactured methamphetamine while permitting a child to be present at the same time while in possession of marijuana and drug paraphernalia. Bail was set at $50,000 cash only, plus conditions.

14-CR-333. Ryan Joseph Malinkey, 18, Bardstown, receiving stolen property and complicity to the same.

According to the indictment, on Nov. 23, 2014, Malinkey — acting alone or in concert with Justin Tyler Rogers — allegedly received, retained or disposed of a 2007 Pontiac G6 belonging to another person having a value of $500 or more but less than $10,000 knowing it was stolen. Bail was set at $9,500 cash only, plus conditions.

14-CR-334. Christopher N. Lyvers, 39, New Hope, forgery, second-degree (5 counts).

According to the indictment, between Oct. 14 and Oct. 19, 2014, Lyvers allegedly falsely completed five checks on the account of another person totaling $185 and passed to at a Five Star Food Mart. Bail was set at $9,500.

14-CR-335. Ryan Joseph Malinkey, 18, Bardstown, theft by unlawful taking or complicity to the same; criminal mischief, second-degree, and complicity to the same.

According to the indictment, on Nov. 14, 2014, Malinkey — acting alone or in concert with Brandon Yates — allegedly took a 2004 Chevrolet 2500 pickup truck belonging to 44 Auto Mart having a value of $10,000 or more, and caused damage of $500 or more. Bail was set at $9,500 cash only, plus conditions.

14-CR-336. Charles L. Miller,26, Germansville, Pa., flagrant non-support.

According to the indictment, from June 1, 2010, through Nov. 30, 2014, Miller allegedly failed to provide support he knew he was ordered to pay resulting in an arrearage of $11,399.50. Bail was set at $5,000 cash only, plus conditions.

14-CR-337. Christopher M. Scott, 36, Bardstown, flagrant non-support.

According to the indictment, from April 3, 2012 through Nov. 30, 2014, Scott allegedly failed to provide support he knew he was ordered to pay resulting in an arrearage of $7,314.81. Bail was set at $5,000 cash only, plus conditions.
