Nelson Circuit Court Indictments–Jan. 7, 2015

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentFriday, Jan. 9, 2015 – The following people were indicted by a Nelson County grand jury on Wednesday, Jan. 7, 2015. They are scheduled for arraignment Thursday, Jan. 22, 2015, unless otherwise indicated.

15-CR-001. William C. Smith, 37, Bardstown, possession of a controlled substance, first-degree, heroin; trafficking in controlled substances, first-degree, less than 2 grams heroin; possession of drug paraphernalia; possession of a firearm at the commission of an offense.

According to the indictment, on Nov. 4, 2014, Smith allegedly possessed less than two grams of heroin with the intent to sell or transfer it, drug paraphernalia and a handgun. Bail was set at $9,500 cash only, plus conditions.

15-CR-002. Shannon Marie Kays, 35, Bardstown, trafficking in marijuana, less than 8 ounces and complicity to the same; possession of a firearm while committing an offense; possession of drug paraphernalia and complicity to the same; trafficking in controlled substances, first-degree, more than 2 grams heroin and complicity to the same; possession of a controlled substance, second-degree and complicity to the same; possession of a controlled substance, first-degree and complicity to the same (2 counts); possession of a controlled substance, second-degree and complicity to the same; possession of a controlled substance, third-degree and complicity to the same (2 counts); possession of marijuana and complicity to the same; possession of legend drugs and complicity to the same; failure to notify address change to Department of Transportation.

According to the indictment, on Dec. 22, 2014, Kays — acting alone or in concert with Jesse Layne French — possessed more than two grams of heroin and 8 ounces or less of marijuana with the intent to sell or transfer it; possessed marijuana, drug paraphernalia, several handguns, the controlled substances methadone, fentynal, suboxone, tramodol pills and xanax pills, and the legend drug Viagra. Bail was set at $5,000 cash only, plus conditions.

15-CR-003. Travis S. Hill, 25, Bloomfield, failure to comply with sex offender registration; sex offender IM/chat/social network use; persistent felony offender, second-degree.

According to the indictment, on Oct. 30, 2014, Hill allegedly failed to register with the local probation and parole office within five days of relocating as required by the Sex Offender Registration, and opened a Facebook account under his name. The indictment cites Hill’s previous conviction as basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

15-CR-004. Jesse Layne French, 26, Bardstown, tampering with physical evidence, possession of a handgun by a convicted felon; trafficking in marijuana, less than 8 ounces and complicity to the same; possession of a firearm while committing an offense; possession of drug paraphernalia and complicity to the same; trafficking in controlled substances, first-degree, more than 2 grams heroin and complicity to the same; possession of a controlled substance, second-degree and complicity to the same; possession of a controlled substance, first-degree and complicity to the same (2 counts); possession of a controlled substance, second-degree and complicity to the same; possession of a controlled substance, third-degree and complicity to the same (2 counts); possession of marijuana and complicity to the same; possession of legend drugs and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Dec. 22, 2014, French allegedly attempted to use a “Whizzinator” during a drug screening and was found in possession of a Smith & Wesson .45 caliber handgun, a Colt model CC5140 and a Davis Industries Model D-32 derringer. The indictment further alleges French — acting alone or in concert with Shannon Marie Kays — possessed more than two grams of heroin and 8 ounces or less of marijuana with the intent to sell or transfer it; possessed marijuana, drug paraphernalia, several handguns, the controlled substances methadone, fentynal, suboxone, tramodol pills and xanax pills, and the legend drug Viagra. The indictment cites French’s prior felony conviction as the basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

15-CR-005. James M. Clark, 35, Bardstown, failure to comply with Sex Offender Registry; sex offender IM/chat/social network use; persistent felony offender, first-degree.

According to the indictment, between Oct. 16 and Oct. 31, 2014, Clark allegedly failed to register with the local probation and parole office within five working days as required by the Sex Offender Registry. The indictment further alleges Clark opened a Facebook account and created a Playstation Network account in his name without registering the identity and email with the probation and parole office. The indictment cites Clark’s prior felony conviction as the basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus condition.

15-CR-006. Timothy D. Hamilton, 34, Bardstown, assault, first-degree; persistent felony offender, first-degree.

According to the indictment, on Dec. 12, 2014, Hamilton allegedly stabbed another person with a knife causing serious physical injury. The indictment cites Hamilton’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-007. Dana Linton, 44, Bardstown, receiving stolen property (firearm) and complicity to the same; possession of marijuana; possession of drug paraphernalia.

According to the indictment, on Dec. 16, 2014, Linton — acting alone or in concert with Quacy L. Sheckles — possessed marijuana, drug paraphernalia, and received, retained or disposed of a stolen Beretta .25 caliber pistol belonging to another person. Bail was set at $9,500 cash only, plus conditions.

15-CR-008. Jeanna M. Thompson, 27, Bardstown, tampering with physical evidence (2 counts); possession of controlled substances, first-degree; possession of controlled substances, third-degree; possession of synthetic drugs; possession of drug paraphernalia.

According to the indictment, on Dec. 4, 2014, Thompson was allegedly found in possession of the synthetic drug “spice,” Alprazolam pills and oxycodone and when believing that an official proceeding was pending, concealed them in her bra. The indictment further alleges Thompson was in possession of drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

15-CR-009. Quacy L. Sheckles, 20, Bardstown, receiving stolen property (firearm) and complicity to the same; trafficking in marijuana (less than 8 ounces); possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Dec. 16, 2014, Sheckles — acting alone or in concert with Dana Linton — allegedly received, retained or disposed of a stolen Beretta .25 caliber handgun, possessed marijuana and drug paraphernalia. The indictment further alleges Sheckles possessed less than 8 ounces of marijuana with the intent to sell it. Bail was set at $9,500 cash only, plus conditions.

15-CR-010. Jamie Stanley, 41, Clarksville, Tenn., possession of a controlled substance, first-degree (heroin); possession of drug paraphernalia; careless driving.

According to the indictment, on Nov. 4, 2014, Stanley allegedly possessed heroin and drug paraphernalia and operated her motor vehicle in a careless manner. Bail was set at $5,000 cash only, plus conditions.

15-CR-011. Quacy L. Sheckles, 20, Bardstown, burglary, first-degree.

According to the indictment, on Dec. 14, 2014, Sheckles entered another person’s residence with the intent to commit a crime while armed with a deadly weapons. Bail was set at $50,000 cash only, plus conditions.

15-CR-012. William B. Bennington, 51, Bardstown, trafficking in controlled substances, first-degree (less than 2 grams heroin); possession of a firearm while committing an offense; possession of a controlled substance, first-degree (heroin); receiving stolen property (firearm); possession of marijuana and drug paraphernalia.

According to the indictment, on Nov. 8, 2014, Bennington allegedly sold less than two grams of heroin while also in possession of marijuana, drug paraphernalia and several firearms. The indictment further alleges Bennington received, retained or disposed of several firearms, including a Ruger MkIII Hunter semiautomatic pistol; a Marlin Firearms Model 88355; and bolt action rifle with bayonet. Bail was set at $25,000 cash only, plus conditions.

15-CR-013. Jason Forsee Diaz, 35, Bardstown, cultivating marijuana, five plants or more and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same; endangering the welfare of a minor and complicity to the same.

According to the indictment, on Dec. 16, 2014, Diaz — acting alone or in concert with Merim Hannah Diaz — allegedly possessed marijuana, drug paraphernalia, and cultivated five or more marijuana plants with the intent to sell or transfer the marijuana while failing to exercise reasonable diligence to prevent a child from becoming neglected. Bail was set at $9,500 cash only, plus conditions.

15-CR-014. Sarah A. Baise, 31, Campbellsville, possession of controlled substances, first-degree (heroin).

According to the indictment, on Nov. 8, 2014, Baise allegedly was found in possession of heroin. Bail was set at $5,000 cash only, plus conditions.

15-CR-015. Merim Hannah Diaz, 34, Bardstown, cultivating marijuana, five or more plants and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of a controlled substance, third-degree; endangering the welfare of a minor and complicity to the same.

According to the indictment, on Dec. 16, 2014, Diaz — acting alone or in concert with Jason Forsee Diaz — allegedly possessed marijuana, drug paraphernalia, and cultivated five or more marijuana plants with the intent to sell or transfer the marijuana while failing to exercise reasonable diligence to prevent a child from becoming neglected. The indictment further alleges Diaz unlawfully possessed Alprazolam pills. Bail was set at $5,000 cash only, plus conditions.

15-CR-016. Joseph K. Ballard, 28, Bardstown, possession of controlled substances, first-degree (heroin); possession of controlled substances, second-degree; possession of marijuana; possession of drug paraphernalia.

According to the indictment, on Nov. 3, 2014, Ballard was found in possession of heroin, Alprazolam pills, marijuana and drug paraphernalia. Bail was set at $5,000 unsecured, plus conditions.

15-CR-017. David Hood, 34, Bardstown, failure to comply with sex offender registry; sex offender IM/chat/social network use.

According to the indictment, on Oct. 30, 2014, Hood allegedly failed to register with the local probation and parole office within five working days of relocation as required by the Sex Offender Registration, and failed to register his social media identity with the same office. Bail was set at $20,000 cash only, plus conditions.

15-CR-018. Barbara L. Cawthorn, 37, Fort Meyers, Fla., flagrant non-support.

According to the indictment, from Aug. 1, 2011, through Nov. 30, 2014, Cawthorn allegedly failed to provide support she knew she was ordered to pay, resulting in an arrearage of $3,005.37. Bail was set at $5,000 cash only, plus conditions.

15-CR-019. Timothy D. Crook, 36, Corpus Cristi, Texas, flagrant non-support; persistent felony offender, first-degree.

According to the indictment, from May 1, 2004, through Nov. 30, 2014, Crook allegedly failed to pay support he was ordered to pay, resulting in an arrearage of $13,573.36. The indictment cites Crook’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.
