Tampering with physical evidence is a Class D felony, punishable by 1 to 5 years in prison.

According to the indictment, on Dec. 22, 2014, French allegedly attempted to use the “Whizzinator” and was found in possession of a Smith & Wesson .45 caliber handgun, a Colt model CC5140 and a Davis Industries Model D-32 derringer. The indictment further alleges French — acting alone or in concert with Shannon Marie Kays — possessed more than two grams of heroin and 8 ounces or less of marijuana with the intent to sell or transfer it; possessed marijuana, drug paraphernalia, several handguns, the controlled substances methadone, fentynal, suboxone, tramodol pills and xanax pills, and the legend drug Viagra.
