Nelson Circuit Court Indictments – March 4, 2015

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentThursday, March 5, 2015 – The following people were indicted by a Nelson County grand jury on Wednesday, March 4, 2015. They are scheduled for arraignment Thursday, March 19, 2015, unless otherwise indicated.

15-CR-043. Amanda Neafus, 38, Bloomfield, fraudulent use of a credit or debit cards; theft by unlawful taking; knowingly exploit an adult over $300.

According to the indictment, sometime between May 29-July 7, 2014, Neafus allegedly used a credit card belonging to another person to obtain money and took several pieces of jewelry having a total value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.

15-CR-044. Joseph Cody Auberry, 20, burglary, third-degree; theft by unlawful taking.

According to the indictment, sometime between Nov. 21-26, 2012, Auberry allegedly entered Bardstown High School and taking two iPads having a value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.

15-CR-045. Conor W. Creekmore, 19, Sonora, burglary, second-degree and complicity to the same; theft by unlawful taking or disposition and complicity to the same.

According to the indictment, on April 20, 2014, Creekmore — acting alone or in concert with a juvenile — allegedly entered another person’s home and took jewelry having a value of less than $500. Bail was set at $25,000 cash only, plus conditions.

15-CR-046. Kevin Carter, 43, Mount Washington, theft by deception, $500 or more but less than $10,000.

According to the indictment, on Aug. 14, 2014, Carter allegedly obtained property or services having a value of $500 or more but less than $10,000 by knowingly issuing a bad check to Buzick Lumber and Home Center. Bail will be set at the arraignment. on March 19, 2015.

15-CR-047. William Cody Smith, 24, Bardstown, burglary, third-degree; criminal mischief, third-degree; theft by unlawful taking or disposition, all others; persistent felony offender, first-degree.

According to the indictment, on Jan. 5, 2015, Smith allegedly entered another person’s home, damaging property in the process, and unlawfully took a 10k gold necklace having a value of less than $500. The indictment cites Smith’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-048. James-Arnold Thomas Karr, 36, Bardstown, rape, first-degree (victim under 12) (4 counts); sodomy, first-degree (victim under 12) (4 counts); sexual abuse, first-degree (victim under 12) (7 counts); incest (victim under 12) (4 counts); use of a minor in a sexual performance.

According to the indictment, between 2008 and March 9, 2014, Karr allegedly engaged in sexual intercourse, deviant sexual intercourse and incest with a person under the age of consent and causing a minor under the age of 16 to engage in a sexual performance.
Bail was set at $250,000 cash only, plus conditions.

15-CR-049. Gary Bates, 42, West Liberty, theft by failure to make required disposition of property, $500 or more.

According to the indictment, on Oct. 1, 2014, Bates allegedly accepted $8,000 from an individual to build a garage but failed to make the required disposition, having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

15-CR-050. Westley Adams Mathis, 33, Shelbyville, manufacturing methamphetamine and complicity to the same; receiving stolen property and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender.

According to the indictment, on Jan. 28, 2015, Mathis — acting alone or in concert with Nichole L. Mathis, manufactured methamphetamine while in possession of drug paraphernalia. The indictment further states that on Jan. 24, 2015, Mathis — acting alone or in concert with Nichole L. Mathis and Trevor Shane Ballard, received, retained or disposed of two 40-inch televisions and an HP All-in-one personal computer belonging to Wal-Mart knowing it was stolen, the items having a value of $500 or more but less than $10,000. The indictment cites Mathis’ previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-051. Kenneth Mattingly, 49, Bardstown, promoting contraband, first-degree; persistent felony offender, first-degree.

According to the indictment, on Feb. 22, 2015, Mattingly allegedly introduced tobacco and a cigarette lighter into the Nelson County Jail. The indictment cites Mattingly’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $5,000 cash only, plus conditions.

15-CR-052. Nichole Leanne Mathis, 29, Shelbyville, manufacturing methamphetamine and complicity to the same; receiving stolen property and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Jan. 28, 2015, Mathis — acting alone or in concert with Westley A. Mathis — manufactured methamphetamine while in possession of drug paraphernalia. The indictment further states that on Jan. 24, 2015, Mathis — acting alone or in concert with Westley A. Mathis and Trevor Shane Ballard, received, retained or disposed of two 40-inch televisions and an HP All-in-one personal computer belonging to Wal-Mart knowing it was stolen, the items having a value of $500 or more but less than $10,000. The indictment cites Mathis’ previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-053. Jonathan Christopher Burba, 34, address unknown, possession of controlled substances, first-degree (cocaine); tampering with physical evidence; trafficking in marijuana (less than 8 ounces); possession of a controlled substance, second-degree (2 counts); possession of drug paraphernalia; possession of marijuana; persistent felony offender, first-degree.

According to the indictment, on Feb. 3, 2015, Burba allegedly possessed cocaine, amphetamines, alprazolam and drug paraphernalia. The indictment further alleges Burba possessed 8 ounces or less of marijuana with the intent to sell it, and attempted to conceal several pills, cocaine, baggies of marijuana and other items with the intent to impair their availability when he believed an official proceeding was pending. The indictment cites Burba’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-054. Michael Q. Blaine, 19, Bardstown, manufacturing methamphetamine; possession of a controlled substance, first-degree (heroin); possession of a controlled substance, first-degree (methamphetamine); assault, third-degree; possession of drug paraphernalia; resisting arrest; fleeing and evading police, second-degree (on foot).

According to the indictment, on Jan. 30, 2015, manufactured and possessed methamphetamine; possessed heroin,
