Nelson Circuit Court Indictments–April 1, 2015

Monday, April 13, 2015 – The following people were indicted by a Nelson County grand jury on Wednesday, April 1, 2015. They are scheduled for arraignment Thursday, April 15, 2015, unless otherwise indicated.
14-CR-300 (AMENDED). Jesse Layne French, 26, Bardstown, possession of a controlled substance, first-degree (heroin) and complicity to the same; possession of drug paraphernalia and complicity to the same.
According to the indictment, on Oct. 31, 2014, French — acting alone or in concert with Shannon Marie Kays — was allegedly found in possession of heroin and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.
15-CR-002 (AMENDED). Shannon Marie Kays, 35, Bardstown, receiving stolen property (firearm) and complicity to the same (2 counts).
According to the indictment, between Dec. 20-22, 2014, Kays — acting alone or in concert with Jesse Layne French and Ashley Nicole Fogle — allegedly received, retained or disposed of a stolen chrome .22 Long Colt revolver and a .32 caliber Derringer belonging to another person. Bail was set at $5,000 cash only, plus conditions.
15-CR-004 (AMENDED). Jesse Layne French, 26, Bardstown, receiving stolen property (firearm) and complicity to the same (2 counts).
According to the indictment, between Dec. 20-22, 2014, French — acting alone or in concert with Shannon Marie Kays and Ashley Nicole Fogle — allegedly received, retained or disposed of a stolen chrome .22 Long Colt revolver and a .32 caliber Derringer belonging to another person. Bail was set at $5,000 cash only, plus conditions.
15-CR-073. William Cody Smith, 24, Bardstown, tampering with physical evidence; promoting contraband, first-degree; possession of drug paraphernalia; possession of marijuana; persistent felony offender, first-degree.
According to the indictment, on March 5, 2015, Smith allegedly attempted to conceal a bag of marijuana in his pants when he believed an official proceeding was pending. The indictment states that Smith also allegedly possessed marijuana and drug paraphernalia and introduced marijuana into the Nelson County Jail. The indictment cites Smith’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
15-CR-074. Ashley Nicole Fogle, 27, Taylorsville, theft by unlawful taking/disposition-firearm and complicity to the same.
According to the indictment, between Dec. 20-22, 2014, Fogle — acting alone or in concert with Jesse Layne French and Shannon Marie Kays — allegedly took a .22 Long Colt chrome revolver and a .32. caliber Derringer belonging to another person. Bail was set at $5,000 cash only, plus conditions.
15-CR-075. Shannon Bartley, 35, Loretto, complicity to robbery, first-degree.
According to the indictment, on March 13, 2015, Bartley allegedly aided Demetruis D. Watkins who threatened physical force while armed with a knife in order to take money from another person. Bail was set at $20,000 cash only, plus conditions.
15-CR-076. Shannon Marie Kays, 35, Bardstown, possession of controlled substance, first-degree (heroin) and complicity to the same; possession of drug paraphernalia and complicity to the same.
According to the indictment, on Oct. 31, 2014, Kays — acting alone or in complicity with Jesse Layne French, possess heroin and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.
15-CR-077. Demetrius D. Watkins, 37, Bloomfield, robbery, first-degree and complicity to the same; assault, second-degree (2 counts); wanton endangerment (5 counts), first-degree; unlawful imprisonment, first-degree (5 counts); persistent felony offender, first-degree.
According to the indictment, on March 13, 2015, Watkins — acting alone or in concert with Shannon Bartley — allegedly threatened to use physical force while armed with a knife in order to take money from another person. The indictment further states that Watkins allegedly stabbed two people, unlawfully restrained five individuals and created a substantial danger of death or serious injury to the same five. The indictment cites Watkins’ prior felony convictions as basis for the persistent felony offender charge. Bail was set at $100,000 cash only, plus conditions.
15-CR-078. Steven J. Perkins, 24, Bardstown, possession of controlled substance, first-degree (heroin); possession of drug paraphernalia.
According to the indictment, on Sept. 18, 2014, Perkins was allegedly found in possession of heroin and drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.
15-CR-079. Robert W. Murphy, 23, Lebanon Junction, rape, third-degree; possession of marijuana; possession of drug paraphernalia;
According to the indictment, on March 6, 2015, Murphy allegedly engaged in sexual intercourse with another person under 16 years of age. The indictment further alleges Murphy was found in possession of marijuana and drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.
15-CR-080. Cortney Simon, 38, Rosendale, NY, flagrant non-support.
According to the indictment, from April 1, 2010 through Feb. 28, 2015, Simon failed to provide support he knew he was ordered to pay, resulting in an arrearage of $27,135.20. Bail was set at $5,000 cash only, plus conditions.
15-CR-081. Michael C. Burgan, 31, Bardstown, possession of a handgun by a convicted felon; falsely reporting an incident; persistent felony offender, second-degree.
According to the indictment, on March 14, 2015, Burgan falsely reported he had been shot to the Nelson County Sheriff’s Office, and was found in possession of a Smith & Wesson .38 caliber handgun. The indictment cites Burgan’s prior conviction as basis for the persistent felony offender charge. Bail will be set at arraignment.
