Nelson County Circuit Court Indictments, Sept. 16, 2015

indictmentMonday, Sept. 21, 2015 – The following people were indicted by a Nelson County grand jury on Wednesday, Sept. 16, 2015. They are scheduled for arraignment Thursday, Oct. 8, 2015, unless otherwise indicated.

15-CR-260. DAVID L. COX, 27, Bardstown, trafficking in controlled substances (more than 2 grams heroin) and complicity to the same; possession of controlled substances (heroin) and complicity to the same; possession of controlled substances (drug unspecified) and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of controlled substances, third-degree and complicity to the same; possession of a prescription not in a proper container and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Aug. 18, 2015, Cox — acting alone or in concert with Joshua Reishauan Downs — allegedly was found in possession of oxycodone, hydrocodone, drug paraphernalia and a prescription not in its proper container; and that he possessed more than two grams of heroin with the intent to sell or transfer it. The indictment cites Cox’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-261. CHARLES A. BLAKE, 53, Bardstown, trafficking in controlled substances, first-degree (less than 2 grams methamphetamine) and complicity to the same; possession of controlled substances (methamphetamine) and complicity to the same; possession of controlled substances (drug unspecified) and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Sept. 8, 2015, Blake — acting alone or in concert with Michael R. McClellan and Melissa F. Mclntosh, possessed hydrocodone and drug paraphernalia; and possessed less than 2 grams of methamphetamine with the intent to sell or transfer it. The indictment cites Blake’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $20,00 cash only, plus conditions.

15-CR-262. DAVID L. COX 27, Bardstown, trafficking in controlled substances, first-degree (more than 2 grams heroin); persistent felony offender, second-degree.

According to the indictment, on Aug. 18, 2015, Cox allegedly possessed more than two grams of heroin with the intent to sell or transfer it. The indictment cites Cox’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

15-CR-263. Melissa F. McIntosh, 35, Bardstown, trafficking in controlled substances, first-degree (less than 2 grams methamphetamine) and complicity to the same; possession of controlled substances (methamphetamine) and complicity to the same; possession of controlled substances, first-degree (drug unspecified) and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Sept. 8, 2015, McIntosh — acting alone or in concert with Charles A. Blake and Michael R. McClellan — allegedly possessed more than two grams methamphetamine with the intent to sell or transfer it; possessed hydrocodone and drug paraphernalia. Bail was set at $20,000 cash only, plus conditions.

15-CR-264. DAVID L. COX 27, Bardstown, possession of a handgun by a convicted felon (2 counts); receiving stolen property; persistent felony offender, second-degree.

According to the indictment, on Aug. 18, 2015, Cox allegedly received, retained or disposed of a a pair of Nike Lebron James tennis shoes, an iPhone 5S and several video games belonging to another person knowing the items were stolen, said items having a value of more than $500 but less than $10,000. The indictment further alleges Cox was found in possession of a Taurus PT111 G2 9mm handgun and a revolver. The indictment cites Cox’s prior felony conviction as the basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

15-CR-265. MICHAEL R. MCCLELLAN, 35, Bardstown trafficking in controlled substances, first-degree (less than 2 grams methamphetamine) and complicity to the same; possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of controlled substances, first-degree (drug unspecified) and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Sept. 8, 2015, McClellan, acting alone or in concert with Charles A. Blake and Melissa F. Mclntosh, possessed less than two grams methamphetamine with the intent to sell or transfer it; possessed hydrocodone and drug paraphernalia. The indictment cites McClellan’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

15-CR-266. JOSHUA DOWNS, 34, Bardstown, trafficking in controlled substances, first-degree (less than 2 grams heroin) and complicity to the same; possession of controlled substances, first-degree (heroin) and complicity to the same; possession of controlled substances, first-degree (drug unspecified) and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of controlled substances, third-degree and complicity to the same; possession of prescription not in proper container and complicity to the same; disregarding traffic control device; persistent felony offender, second-degree.

According to the indictment, on Aug. 18, 2015, Downs — acting alone or in concert with David Cox — unlawfully possessed hydrocodone, oxycodone and drug paraphernalia; less than two grams heroin with the intent to sell or transfer it; and a prescription not in its proper container. The indictment further alleges Downs ran the red light at an intersection near Wee Care Day Care. The indictment cites Downs’ prior felony conviction as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions

15-CR-267. MICHAEL T. GREATHOUSE, 22, Bardstown, trafficking in synthetic drugs; possession of a handgun by a convicted felon; possession of drug paraphernalia; possession of marijuana; possession of synthetic drugs; persistent felony offender, second-degree.

According to the indictment, on Aug. 29, 2015, Greathouse unlawfully possessed synthetic drugs with the intent to sell them while in possession of a Llama 9mm pistol, marijuana and drug paraphernalia. The indictment cites Greathouse’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

15-CR-268. JEFFREY A. MATTOX, 32, Bardstown, manufacturing methamphetamine and complicity to the same; possession of controlled substances, first-degree, and complicity to the same; wanton endangerment, first-degree (2 counts) and complicity to the same; possession of drug paraphernalia and complicity to the same; endangering the welfare of a minor (2 counts) and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on July 28, 2015, Mattox — alone or in concert with Tara G. Mattox — allegedly manufactured methamphetamine and created a substantial danger of death or serious injury by leaving drug paraphernalia and pills in easy access to two minor children. The indictment cites’ Maddox’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-269. JOSHUA RAY MERRITT HARDIN, 21, Taylorsville, burglary, first-degree and complicity to the same; robbery, first-degree, and complicity to the same; assault, second-degree and complicity to the same; wanton endangerment, first-degree (3 counts) and complicity to the same.

According to the indictment, on Aug. 18, 2015, Hardin — acting alone or in concert with Matthew Ryan Waits — entered another person’s residence armed with a deadline weapon with the intent to commit a crime and caused physical injury to a person, threatening to use physical force to take a person’s smartphone; pointed a gun at two adults and one minor and struck one of the adults in the head with a pistol. Bail was set at $50,000 cash only, plus conditions.

15-CR-270. TARA G. MATTOX, 32, Bardstown, manufacturing methamphetamine and complicity to the same; possession of controlled substances, first-degree and complicity to the same; wanton endangerment, first-degree (two counts) and complicity to the same; possession of drug paraphernalia and complicity to the same; endangering the welfare of a minor (2 counts) and complicity to the same.

According to the indictment on July 28, 2015, Mattox — acting alone or in concert with Jeffrey A. Mattox — possessed drug paraphernalia and manufactured methamphetamine and created substantial danger of death or physical injury to two minors by leaving drug paraphernalia and pills in easy access to the minors. Bail was set at $50,000 cash only, plus conditions.

15-CR-271. MATTHEW RYAN WAITS, 28, Taylorsville, burglary, first-degree and complicity to the same; robbery, first-degree, and complicity to the same; assault, second-degree and complicity to the same; wanton endangerment, first-degree (3 counts) and complicity to the same; possession of a firearm by a convicted felon; persistent felony offender, first-degree.

According to the indictment, on Aug. 18, 2015, Hardin — acting alone or in concert with Joshua Ray Merritt Hardin — entered another person’s residence armed with a deadly weapon with the intent to commit a crime and caused physical injury to a person; threatened violence in taking a smartphone belonging to another person; pointed and/or fired a gun at two adults and one minor and struck one of the adults in the head with a pistol. Waits, convicted of an earlier felony, was found in possession of a Blazer 9mm Luger. The indictment cites Waits’ prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-272. CHARLES A. ARMSTRONG, 42, Bardstown, sodomy, first-degree (victim under 12 years of age); sexual abuse, first-degree (victim under 12 years of age);

According to the indictment, between July 7-27, 2015, Armstrong allegedly engaged in deviant sexual intercourse with another person incapable of consent because she was under 12 years of age. Bail was set at $100,000 cash only, plus conditions.

15-CR-273. BILLY E. TAFT, 43, Bardstown, assault, second-degree.

According to the indictment, on April 25, 2015, Taft allegedly struck another person in the face with a beer bottle causing serious physical injury. Bail was set at $9,500 cash only, plus conditions.

15-CR-274. PIYUSCH GANDHI, 45, Crestwood, theft by unlawful taking, $10,000 or more.

According to the indictment, sometime between Dec. 10, 2014 and April 8, 2015, Gandhi is alleged to have unlawfully taking more than $27,896.58 in cash from the Subway restaurant belonging to Nishit Patel. Bail will be set at arraignment.

15-CR-275. JEFFREY W. BUSBY. 49, Bardstown, possession of a handgun by a convicted felon (4 counts).

According to the indictment between June 2011 and March 23, 2015, Busby — who had been convicted of a felony — was allegedly found in possession of a Smith & Wesson 9mm pistol; a Star Model Firestar 9mm pistol; a Jennings Nickel 9mm pistol; and a Jennings J22 .22 pistol. Bail was set at $9,500 cash only, plus conditions.

15-CR-276. JAMES I. KEENE, III, 27, Bardstown, making a false statement to obtain increase of benefit, $100 or more.

According to the indictment, between May 5, 2012 and Sept. 8, 2012, Keene allegedly made false statements to receive unemployment benefits he was not entitled to receive in the amount of $7,885.00. Bail was set at $5,000 cash only, plus conditions.

15-CR-277. DUSTIN D. NELSON, 29, Boston, failure to comply with sex offender registry; sex offender use of a social/IM/chat network.

According to the indictment, between July 2, 2015 and Aug. 31, 2015, Nelson allegedly failed to register a Facebook identity as required by the state sex offender registry. Bail was set at $9,500 cash only, plus conditions.

15-CR-278. STEVEN S. HAYES, 25, Mount Washington, receiving stolen property (firearm); wanton endangerment, first-degree (3 counts); persistent felony offender, second-degree.

According to the indictment, on July 3, 2015, Hayes allegedly received, retained or disposed of a Smith & Wesson 9mm pistol that was stolen and defaced and created substantial danger of death or injury by pointing a gun at two adults and one minor child. The indictment cites Hayes’ prior felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

15-CR-279. DENNIS B. HICKS , 29, New Haven, possession of a controlled substance (heroin); carrying a concealed deadly weapons; possession of drug paraphernalia; public intoxication.

According to the indictment, on July 27, 2015, Hicks was found in possession of heroin, brass knuckles and drug paraphernalia while appearing intoxicated in a public place. Bail was set at $9,500 cash only, plus conditions.

15-CR-280. JOSEPH SHANE LYVERS, 35, Cox’s Creek, wanton endangerment, first-degree; fleeing and evading police (motor vehilce), first-degree; leaving the scene of an accident; operating a motor vehicle under the influence of alcohol/drugs/etc.; speeding, 26 mph or more over limit.

According to the indictment, on July 12, 2015, Lyvers alleged operating his vehicle under the influence of alcohol, creating a substantial danger of death or injury while fleeing or evading police while speeding more than 26 mph over the limit and leaving the scene of an accident. Bail was set at $9,500 cash only, plus conditions.

15-CR-281. DANIAL SAWILLICH, 46, Travers, Mich., theft by failure to make required disposition of property, $500 or more.

According to the indictment, on Aug. 2, 2015, Sawillich allegedly accepted $1,000 for a concrete job and failed to make required disposition of the property. Bail was set at $5,000 cash only, plus conditions.
