Nelson County Circuit Court Indictments, Oct. 21, 2015

Monday, Nov. 2, 2015 – The following people were indicted by a Nelson County grand jury on Wednesday, Oct. 21, 2015. They are scheduled for arraignment Thursday, Nov. 5, 2015, unless otherwise indicated.
15-CR-153 (AMENDED). DALE FRANCIS O’BRYAN, 55, New Hope, possession of a handgun by a convicted felon.
According to the indictment, on Nov. 16, 2014, O’Bryan was allegedly found in possession of a Ruger pistol having previously been convicted of a felony. Bail was set as the same as the primary charge.
15-CR-284. DWAYNE PHILLIPS, 33, Murrells Intl, S.C., flagrant non-support.
According to the indictment, from Aug. 29, 2008 through Aug. 31, 2015, Phillips allegedly failed to provide support he knew he was ordered to pay, resulting in an arrearage of $1,731.60. Bail was set at $2,500 cash only, plus conditions.
15-CR-285. MICHAEL LASLEY, 29, Boston, possession of a controlled substance, first-degree (drug unspecified); possession of drug paraphernalia.
According to the indictment, on Aug. 29, 2015, Lasley was allegedly found in possession of methamphetamine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.
15-CR-286. MICHAEL W. RHODES, 54, Bardstown, cultivating marijuana (5 or more plants) and complicity to the same; trafficking in marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, second-degree.
According to the indictment, on July 21, 2015, Rhodes — acting alone or in concert with Katherine M. Bruner — allegedly grew five or more marijuana plants with the intent to sell and possessed drug paraphernalia. The indictment cites Rhodes’ prior felony conviction as basis for the persistent felony offender charge. Bail was set at $5,000 cash only, plus conditions.
15-CR-287. JOSEPH MATTHEW VARBLE, 24, Elizabethtown, robbery, first-degree and complicity to the same; assault, second-degree, and complicity to the same.
According to the indictment, on Sept. 19, 2015, Varble — acting alone or in concert with Dustin L. Hubbell, threatened to use physical force in order to take a man’s handgun, truck keys, his wife’s purse and cell phones and grabbed the gun and struck the victim in the head with the weapon causing serious injury. Bail was set at $50,000 cash only, plus conditions
15-CR-288. KATHERINE M. BRUNER, 41, Bardstown, cultivating marijuana (5 or more plants) and complicity to the same; trafficking in marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.
According to the indictment, on July 21, 2015, Bruner — acting alone or in concert with Michael W. Rhodes — allegedly grew five or more marijuana plants with the intent to sell and possessed drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.
15-CR-289. DUSTIN L. HUBBELL, 21, Elizabethtown, robbery, first-degree and complicity to the same; assault, second-degree, and complicity to the same.
According to the indictment, on Sept. 19, 2015, Hubbell — acting alone or in concert with Joseph Matthew Varble, threatened to use physical force in order to take a man’s handgun, truck keys, his wife’s purse and cell phones and grabbed the gun and struck the victim in the head with the weapon causing serious injury. Bail was set at $50,000 cash only, plus conditions
15-CR-290. TYLER D. MOCK, 29, Lebanon, burglary, first-degree; assault, second-degree.
According to the indictment, on Aug. 28, 2015, Mock allegedly entered another person’s residence with the intent to commit a crime and kicked the victim in the face, causing serious physical injury. Bail was set at $50,000 cash only, plus conditions.
15-CR-291. WALTER RAY SCHOOLING JR. 53, Bardstown, possession of handgun by a convicted felon; wanton endangerment, first-degree; persistent felony offender, second-degree.
According to the indictment, on Oct. 7, 2015, Schooling allegedly possessed a Hi Point C9 9mm handgun after having previously been convicted of a felony and pointed a gun in a person’s direction, creating a substantial danger of death or serious injury. The indictment cites’ Schooling’s previous felony conviction as basis for the persistent felony offender charge. Bail was set at $5,000 cash only, plus conditions
15-CR-292. THOMAS HARDIN, 34, Louisville, burglary, second-degree; receiving stolen property.
According to the indictment, on June 9, 2015, Hardin allegedly entered another person’s residence with the intent to commit a crime and received, detained or disposed of two laptops and one tablet belonging to another person knowing the items were stolen and having a value of more than $500 but less than $10,000. Bail was set at $9,500 cash only, plus conditions.
15-CR-293. MARK CHRISTOPHER FERGUSON, 18, Columbus, Ohio, robbery, second-degree, and complicity to the same; receiving stolen property; wanton endangerment, first-degree, police officer(11 counts); wanton endangerment, first-degree (8 counts); fleeing and evading police, first-degree; tampering with physical evidence; failure to maintain required insurance; no operators license; endangering the welfare of a minor; reckless driving; speeding, 26 mph or more over limit; disregarding stop sign (4 counts).
According to the indictment, on Sept. 18, 2015, Ferguson — acting alone or in concert with Devin Michael Tirey — threatened to use physical force on another person in the Bardstown Wal-Mart and fled the scene in a stolen 2004 Mercedes having a value of $10,000 or more.
The indictment further alleges Ferguson operated his vehicle in a reckless manner, endangering the safety of 11 police officers and 8 other individuals; ran four stop signs; and endangered the welfare of a minor while fleeing police at speeds greater than 26 mph over the speed limit. The indictment alleges Ferguson threw a purse from the vehicle to impair its availability in an official proceeding and had no operators license or insurance. Bail was set at $50,000 cash only, plus conditions
15-CR-294. JEFFERY SCOTT MARTIN, 37, address unknown, assault, second-degree; persistent felony offender, first-degree.
According to the indictment, on April 26, 2015, Martin alleged hit another individual and put the victims head through a wall breaking his nose. The indictment cites Martin’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
15-CR-295. GARRETT LEE MULLINS, 38, Louisville, trafficking in a controlled substance, first-degree (2 or more grams crystal methamphetamine) (2 counts) ; persistent felony offender, second-degree.
According to the indictment, on March 18, 2015, Mullins allegedly sold more than 2 grams methamphetamine to a confidential information. The indictment cites Mullins’ prior felony convictions as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.
15-CR-296. AARON TODD DANNER, 36, Shepherdsville, flagrant non-support.
According to the indictment, from March 20 through Sept. 25, 2015, Danner allegedly failed to provide support he was ordered to pay, resulting in an arrearage of $1,005.37. Bail was seat at $2,500 cash only, plus conditions.
15-CR-297. JOSHUA A. BENNINGTON, 28, Jeffersonville, Ind., flagrant non-support; persistent felony offender, second-degree.
According to the indictment, from March 1, 2010 through Aug. 31, 2015, Bennington allegedly failed to provide support he was ordered to pay, resulting in an arrearage of $8,911.07. The indictment cites Bennington’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500.
15-CR-298. ZACHARY FREY, 28, Bardstown, theft by unlawful taking; possession of a forged instrument, second-degree (19 counts).
According to the indictment, Frey allegedly passed 19 checks forged on another person’s account without permission, taking money having the value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.
15-CR-299. CLARISSA DOUGLAS, 40, Bardstown, forgery, second-degree (4 counts).
According to the indictment, between June 1, 2015, and June 15, 2015, Douglas allegedly passed four forged checks on another person’s account. Bail was set at $5,000 cash only, plus conditions.
15-CR-300. ZACHARY FREY,28, Bardstown, burglary, first-degree; burglary, second-degree; receiving stolen property (firearm); receiving stolen property.
According to the indictment, on July 18, ,2015, Frey allegedly entered another person’s residence armed with a deadly weapon with the intent to commit a crime, receiving, retaining or disposing of a stolen Remington rifle. The indictment further states that between July 18 and Aug. 31, 2015, Frey allegedly received, retained or disposed of a stolen of a Play Station Vista System, a 40-inch flat-screen TV, an iPhone 5C, and a Kodak Z915 digital camera. Bail was set at $25,000 cash only, plus conditions.
15-CR-301. JAMES BRADLEY OLIVER, 25, address unknown, possession of a forged instrument, second-degree (9 counts).
According to the indictment, between Sept. 2 and Sept. 14, 2015, Oliver allegedly passed nine forged checks on another person’s account without their permission. Bail was set at $5,000 cash only, plus conditions.
