Nelson County Circuit Court Indictments, Nov. 14, 2015

indictmentSunday, Nov. 29, 2015 – The following people were indicted by a Nelson County grand jury on Wednesday, Nov. 14, 2015. They are scheduled for arraignment Thursday, Dec. 3, 2015, unless otherwise indicated.

15-CR-310. JOSEPH W. HAMILTON, 37, Bardstown, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of legend drugs and complicity to the same; possession of synthetic drugs and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Sept. 3, 2015, Hamilton – acting alone or in concert with Amanda L. Hagan – was found in possession of methamphetamine, Maxalt (a legend drug), synthetic marijuana, marijuana and drug paraphernalia. The indictment cites Hamilton’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

15-CR-311. OWEN LEE “PETIE” MADDOX, 37, New Haven, rape, first-degree; sodomy, first-degree; persistent felony offender, first-degree.

According to the indictment, on Oct. 6, 2015, Maddox allegedly engaged in sexual intercourse and deviate sexual intercourse with a person incapable of consent because she was physically helpless. The indictment cites Maddox’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $500,000 cash only, plus conditions.

15-CR-312. AMANDA L. HAGAN, 32, Bardstown, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of legend drugs and complicity to the same; possession of synthetic drugs and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Sept. 3, 2015, Hagan – acting alone or in concert with Joseph W. Hamilton – was found in possession of methamphetamine, Maxalt (a legend drug), synthetic marijuana, marijuana and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

15-CR-313. MICHAEL P. COLLINS, 23, Manchester, burglary, second-degree; theft by unlawful taking; unlawful access to a computer, second-degree.

According to the indictment, between Sept. 5-7, 2015, Collins allegedly entered another person’s hotel room with the intent to commit a crime and unlawfully took a bank credit card and accessed a computer network with it without the consent of the victim. Bail was set at $5,000 cash only, plus conditions.

15-CR-314. JOHN T. BURBA, 33, New Haven, assault, first-degree; operating a motor vehicle under the influence of alcohol/drugs/etc.

According to the indictment, on Sept. 22, 2015, operated his motor vehicle recklessly while under the influence of alcohol/drugs/etc., creating a substantial danger of death or injury to a minor child inside the vehicle. Bail was set at $50,000 cash only, plus conditions.

15-CR-315. JACKIE E. ALLEN, 35, Bardstown, possession of controlled substances, first-degree (drug unspecified); resisting arrest; fleeing or evading police, second-degree (on foot).

According to the indictment, on April 16, 2015, Allen was allegedly found in possession of Clanazepam, and resisted arrest by threatening to use physical force against a peace officer after he disobeyed direction to stop. Bail was set at $5,000 cash only, plus conditions.

15-CR-316. CAMBRON J. GREENWELL, 34, Bardstown, trafficking in controlled substances, second-degree (less than 20 drug units of an unspecified Schedule III drug) (2 counts) and complicity to the same; possession of drug paraphernalia and complicity to the same (2 counts); persistent felony offender, first-degree.

According to the indictment, on Dec. 15, 2014 and Jan. 14, 2015, Greenwell – acting alone or in concert with Joseph R. Greenwell — allegedly sold less than 20 drug units Bufotenine to a confidential informant while in possession of drug paraphernalia. The indictment cites Greenwell’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

15-CR-317. HALI M. FARMER, 31, New Haven, cultivating marijuana, five or more plants and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Sept. 15, 2015, Farmer – acting alone or in concert with Daniel M. Norris – unlawfully cultivated five or more marijuana plants with the intent to sell or transfer it while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

15-CR-318. JOSEPH R. GREENWELL, 56, Bardstown, trafficking in controlled substances, second-degree (less than 20 drug units of an unspecified Schedule III drug) (2 counts) and complicity to the same; possession of drug paraphernalia and complicity to the same (2 counts.

According to the indictment, on Dec. 15, 2014 and Jan. 14, 2015, Greenwell – acting alone or in concert with Cambron J. Greenwell — allegedly sold less than 20 drug units Bufotenine to a confidential informant while in possession of drug paraphernalia.Bail was set at $9,500 cash only, plus conditions.

15-CR-319. DANIEL M. NORRIS, 31, New Haven, cultivating marijuana, five or more plants and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Sept. 15, 2015, Norris – acting alone or in concert with Halli M. Farmer – unlawfully cultivated five or more marijuana plants with the intent to sell or transfer it while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

15-CR-320. LAROONE TONGE, 26, Bardstown, tampering with physical evidence; persistent felony offender, second-degree.

According to the indictment, on May 19, 2015, Tonge allegedly attempted to flush an unknown substance down the toilet in order to impair its availability to police. The indictment cites Tonge’s prior felony conviction as basis for the persistent felony offender charge.

15-CR-321. DARRELL A. OWEN, 45, Cox’s Creek, cultivating marijuana, five plants or more and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Oct. 6, 2015, Chesser – acting alone or in concert with Cheryl L. Chesser – unlawfully cultivated five or more marijuana plants with the intent to sell them while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

15-CR-322. CHARLES E. JOHNSON, 37, New Haven, wanton endangerment, first-degree (3 counts).

According to the indictment, on Oct. 11, 2015, Johnson allegedly pointed a gun at three individuals, thereby causing a substantial danger of death or serious injury. Bail was set as the same district court, plus conditions.

15-CR-323. CHERYL L. CHESSER, 46, Cox’s Creek, cultivating marijuana, five plants or more and complicity to the same; possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Oct. 6, 2015, Chesser – acting alone or in concert with Darrell A. Owen – unlawfully cultivated five or more marijuana plants with the intent to sell them while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

15-CR-324. JUSTIN D. MILLIMAN, 22, Loretto, fraudulent use of a credit/debit card (3 counts); receiving stolen property; persistent felony offender, second-degree.

According to the indictment, between Sept. 1, 2015, and Oct. 16, 2015, Milliman unlawfully used a credit card belonging to another person to obtain money in the amount of $500 or more but less than $10,000 without authorization and received or retained three laptops, an Apple iPad, Beats headphones and an Xbox 360 belonging to another person. The indictment cites Milliman’s previous felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

15-CR-325. ALLEN JOSEPH BALLARD, 31, Bardstown, failure to comply with sex offender registry; persistent felony offender, first-degree.

According to the indictment, on July 13, 2015, Ballard failed to complete the address verification form as required by the sex offender registry. The indictment cites Ballard’s prior felony convictions as basis for the persistent felony offender charge. Bail was set as the same as the district court charges.

15-CR-326. RANDALL S. MILLER, 39, Bardstown, possession of controlled substances, first-degree (methamphetamine); giving police officer a false name or address; possession of drug paraphernalia; fleeing or evading police, second-degree (on foot).

According to the indictment, on Sept. 17, 2015, Miller allegedly possessed methamphetamine and drug paraphernalia; ran from police on foot and gave Officer Jeremy Cauley a false name or address. Bail was set at $5,000 cash only, plus conditions.

15-CR-327. WILLIAM C. LUTES, 48, Bloomfield, cultivating marijuana, five plants or more; possession of controlled substances, first-degree; possession of destructive device or booby trap device; trafficking in marijuana (less than 8 ounces); possession of marijuana; possession of drug paraphernalia.

According to the indictment, on Sept. 8, 2015, Lutes allegedly cultivated more than five plants marijuana with the intent to sell or distribute it, had a sharp-bladed knife that was partially buried, and possessed marijuana and drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

15-CR-328. NELSON GOMEZ, 21, Bardstown, promoting contraband, first-degree.

According to the indictment, on Aug. 19, 2015, Gomez allegedly introduced tobacco into the Nelson County Jail. Bail was set at $5,000 cash only, plus condition.

15-CR-329. EUGENE BEAVERS, 76, New Haven, cultivating marijuana, five or more plants.

According to the indictment, on Sept. 9, 2015, Beavers allegedly cultivated five or more marijuana plants with the intent to see or transfer it. Bail was set at $5,000 cash only, plus conditions.

15-CR-330. JEREMIAH STOUT, 33, Mansfield, Ohio, flagrant non-support.

According to the indictment, between Feb. 1, 2006 and Oct. 31, 2015, Stout failed to provide support he was ordered to pay, resulting in an arrearage of $20,658.55. Bail was set at $5,000 cash only, plus conditions.

15-CR-331. JIMMY W. WHITE JR.,37, Elizabethtown, flagrant non-support.

According to the indictment, from March 1, 2009 through Aug. 31, 2015, White failed to pay support he was ordered to pay, resulting in an arrearage of $24,433.32. Bail was set at $5,000 cash only, plus conditions.

15-CR-332. THOMAS S. WOODS, 46, Summerville, S.C., flagrant non-support.

According to the indictment, from Jan. 1, 1994 through Oct. 31, 2015, Woods allegedly failed to pay support he was ordered to pay, resulting in an arrearage of $8,887.74. Bail was set at $5,000.
