Nelson County Circuit Court Indictments, Jan. 6, 2016

indictmentFriday, Jan. 8, 2016 – The following people were indicted by a Nelson County grand jury on Wednesday, Jan. 6, 2016. They are scheduled for arraignment Thursday, Jan. 21, 2016, unless otherwise indicated.

16-CR- 001. RYAN MALINKEY, 20, Bardstown, receiving stolen property and complicity to the same; fleeing and evading police, second-degree (on foot) and complicity to the same; resisting arrest and complicity to the same; alcohol intoxication and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Dec. 24, 2015, Malinkey — acting alone or in concert with Justin T. Rogers — allegedly received, retained or disposed of several items taken from vehicles located at Mammy’s Kitchen with a value of $500 or more but less than $10,000 and then fled from police on foot and resisted being arrested by Bardstown Police Chief Rick McCubbin while under the influence of alcohol. The indictment cites his previous felony conviction as basis for the the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-002. THOMAS L. JENT, 30, Bardstown, robbery, second-degree; persistent felony offender, first-degree.

According to the indictment, on March 30, 2015, Jent allegedly used physical force against an individual while robbing them. The indictment cites his previous felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-003. JUSTIN TYLER ROGERS, 19, Bardstown, receiving stolen property and complicity to the same; fleeing and evading police, second-degree (on foot) and complicity to the same; possession of controlled substances, third-degree; possession of a prescription not in a proper container; resisting arrest and complicity to the same; alcohol intoxication and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Dec. 24, 2015, Rogers — acting alone or in concert with Ryan Malinkey — allegedly received, retained or disposed of several items taken from vehicles located at Mammy’s Kitchen with a value of $500 or more but less than $10,000 and then fled from police on foot and resisted being arrested while under the influence of alcohol and in possession of Xanax, a prescription medicine not in the proper container. The indictment cites his previous felony conviction as basis for the the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-004. MARANDA L. COWLES, 26, Bardstown, trafficking in a controlled substance, first-degree (less than 2 grams methamphetamine) and complicity to the same; trafficking in a controlled substance, second-degree (less than 20 drug units of an unspecified drug) and complicity to the same; possession of controlled substances, first-degree (heroin) and complicity to the same; possession of drug paraphernalia and complicity to the same; trafficking in marijuana (less than 8 ounces) and complicity to the same; prescription not in proper container and complicity to the same.

According to the indictment, on Dec. 23, 2015, Cowles — acting alone or in concert with Gerald M. Tucker — was allegedly found in possession of less than 2 grams methamphetamine; fewer than 10 drug units of hydrochloride; heroin; less than 8 ounces of marijuana; drug paraphernalia; and a prescription not in its proper container. Bail was set at $9,500 cash only, plus conditions.

16-CR-005. NICHOLAS J. GORCZYCA, 27, homeless, robbery, second-degree; possession of a controlled substance, first-degree (methamphetamine); disorderly conduct, second-degree.

According to the indictment, on Sept. 17, 2015, Gorczyca allegedly threatened to use physical force and engaged in threatening behavior while committing a theft at Kroger while in possession of methamphetamine. Bail was set at $50,000 cash only, plus conditions.

16-CR-006. GERALD M. TUCKER, 31, Bardstown, trafficking in a controlled substance, first-degree (less than 2 grams methamphetamine) and complicity to the same; trafficking in a controlled substance, second-degree (less than 20 drug units of an unspecified drug) and complicity to the same; possession of controlled substances, first-degree (heroin) and complicity to the same; possession of drug paraphernalia and complicity to the same; trafficking in marijuana (less than 8 ounces) and complicity to the same; prescription not in proper container and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Dec. 23, 2015, Tucker — acting alone or in concert with Maranda L. Cowles — was allegedly found in possession of less than 2 grams methamphetamine; fewer than 10 drug units of hydrochloride; heroin; less than 8 ounces of marijuana; drug paraphernalia; and a prescription not in its proper container. The indictment cites his prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50.000 cash only, plus conditions.

16-CR-007. ALAN F. METCALFE, 53, Bardstown, possession of controlled substances, first-degree (methamphetamine); possession of drug paraphernalia.

According to the indictment, on Dec. 19, 2015, Metcalfe was allegedly found in possession of methamphetamine and drug paraphernalia. Bail was set at $5,000 cash, plus conditions.

16-CR-008. KENNETH W. BARNES, 33 Bardstown, sexual abuse, first-degree; assault, fourth-degree; sexual abuse, third-degree (five counts); failure to notify address change to Department of Transportation.

According to the indictment, on Oct. 17, 2015, Barnes allegedly engaged in sexual contact with another person by the use of forcible compulsion and without their consent and injured another person by bending their thumb backwards. The indictment alleges Barnes also failed to notify the Department of Transportation of his address change. Bail was set at $50,000 cash only, plus conditions.

16-CR-009. ROBIN G. TICHENOR, 40, Bardstown, trafficking in controlled substances, first-degree; possession of controlled substances, first-degree (less than 4 grams cocaine); possession of marijuana; possession of drug paraphernalia; possession of a controlled substance; possession of synthetic drugs; operating a motor vehicle under the influence of alcohol/drugs/etc.; driving without a license; operating a motor vehicle with a suspended operators license; possession of an open alcohol container in a motor vehicle; failure to illuminate rear license; persistent felony offender, first-degree.

According to the indictment, on Nov. 16, 2015, Tichenor possessed synthetic marijuana, buprenorphone, marijuana, drug paraphernalia, cocaine (4 grams or less) with the intent to sell or transfer it, while operating a motor vehicle under the influence of alcohol or drugs with a suspended operators license and possessing an open alcoholic beverage in his vehicle. The indictment cites Tichenor’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
