Nelson Circuit Court Indictments, Feb. 17, 2016

indictmentMonday, Feb. 22, 2016 – The following people were indicted by a Nelson County grand jury on Wednesday, Feb. 17, 2016. They are scheduled for arraignment Thursday, March 3, 2016, unless otherwise indicated.

 

16-CR-33. KENNETH E. DOUGLAS JR., 32, manufacturing methamphetamine; possession of controlled substances, first-degree (methamphetamine); possession of precursors with intent to manufacture methamphetamine; possession of drug paraphernalia and complicity to the same; possession of marijuana and complicity to the same; persistent felony offender, second-degree.

According to the indictment, on Oct. 12, 2015, Douglas was allegedly found in possession of methamphetamine, possessed chemicals, equipment and meth precursors with the intent to manufacture methamphetamine. The indictment further alleges Douglas — acting alone or in concert with Tina R. Bailey — allegedly possessed marijuana and drug paraphernalia. The indictment cites Douglas’ prior felony conviction as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-34. HEATHER PENN, 24, Lexington, unlawful access to a computer, first-degree, and complicity to the same; theft by unlawful taking or disposition under $500 and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Jan. 5, 2016, Penn — acting alone or in concert with Shawn K. Bowery, Karla M. Wilson and Victoria B. Wylie — allegedly took Kroger gift cards from Kroger and used them to purchase other credit cards for the purpose of obtaining money, property or services by false pretenses. The indictment cites Penn’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-35. ZACHARY T. UPCHURCH, 24, Bardstown, unlawful access to a computer and complicity to the same; theft by unlawful taking or disposition-gasoline, $500 or more but under $10,000 and complicity to the same.

According to the indictment, between Aug. 26-Dec. 16, 2015, Upchurch — acting alone or in concert with Scott J. Lucas — unlawfully obtained and used a fuel card without authorization or consent having a value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.

16-CR-36. VICTORIA B. WYLIE, 21, Nicholasville, unlawful access to a computer, first-degree, and complicity to the same; theft by unlawful taking or disposition under $500 and complicity to the same.

According to the indictment, on Jan. 5, 2016, Wylie — acting alone or in concert with Heather Penn, Shawn K. Bowery and Karla M. Wilson — allegedly took gift cards from Kroger and used them to purchase other credit cards for the purpose of obtaining money, property or services by false pretenses. Bail will be set at the arraignment.

16-CR-37. SCOTT J. LUCAS, 28, Bardstown, unlawful access to a computer and complicity to the same; theft by unlawful taking or disposition-gasoline, $500 or more but under $10,000 and complicity to the same.

According to the indictment, between Aug. 26-Dec. 16, 2015, Lucas — acting alone or in concert with Zachary T. Upchurch — unlawfully obtained and used a fuel card without authorization or consent having a value of $500 or more but less than $10,000. Bail was set at $9,500 cash only, plus conditions.

16-CR-38. KARLA M. WILSON, 39, Glasgow, unlawful access to a computer, first-degree, and complicity to the same; theft by unlawful taking or disposition under $500 and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Jan. 5, 2016, Wilson — acting alone or in concert with Heather Penn, Shawn K. Bowery and Victoria B. Wylie — allegedly took gift cards from Kroger and used them to purchase other credit cards for the purpose of obtaining money, property or services by false pretenses. The indictment cites Wilson’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-39. MICHAEL D. CORNISH, 19, Bardstown, rape, second-degree (3 counts); unlawful transaction with a minor under 16 years of age, first-degree (3 counts).

According to the indictment, between July 1, 2015 and Jan. 1, 2016, Cornish allegedly had sex twice with one juvenile victim and once with a second juvenile victim. The indictment states both victims were under 14 years of age at the time. Bail was set at $100,000.

16-CR-40. SHAWN K. BOWERY, 38, Glasgow, unlawful access to a computer, first-degree, and complicity to the same; theft by unlawful taking or disposition under $500 and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on Jan. 5, 2016, Bowery — acting alone or in concert with Heather Penn, Karla M. Wilson and Victoria B. Wylie — allegedly took gift cards from Kroger and used them to purchase other credit cards for the purpose of obtaining money, property or services by false pretenses. The indictment cites Bowery’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-41. JUSTIN M. PARRISH, 22, Cox’s Creek, possession of controlled substances, first-degree (methamphetamine); possession of drug paraphernalia; trafficking in marijuana (less than 8 ounces); failure of owner to maintain required insurance; possession of marijuana; speeding, 20 mph over limit.

According to the indictment, on Dec. 30, 2015, Parrish was alleged found in possession of drug paraphernalia, methamphetamine, and less than 8 ounces of marijuana with the intent to sell. The indictment further alleges Parrish was driving 20 mph over the posted speed limit while not in possession of a valid insurance card. Bail was set at $9,500.

16-CR-42. ANTHONY DOUGLAS SMITH. 34, Willisburg, possession of controlled substances, first-degree (drug unspecified); tampering with physical evidence; theft of identity without consent; possession of drug paraphernalia; terroristic threatening, third-degree; resisting arrest; disorderly conduct, second-degree; persistent felony offender, first-degree.

According to the indictment, on Dec. 13, 2015, Smith was allegedly found in possession of methamphetamine and drug paraphernalia and gave a police officer a fake name. The indictment further alleges Smith kicked a metal capsule under a police cruiser in an attempt to conceal it from police, then used or threatened to use physical force against the arresting officer. The indictment cites Smith’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

16-CR-43. TINA R. BAILEY, 35, Boston, unlawful distribution of a methamphetamine precursor; possession of a controlled substance, first-degree (methamphetamine); possession of marijuana and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on Oct. 12, 2015, Bailey was found in possession of methamphetamine and sold or intended to sell a methamphetamine precursor. The indictment further alleges Bailey — acting alone or in concert with Kenneth E. Douglas Jr — possessed marijuana and drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

16-CR-044. TRAVIS W. CUNDIFF, 36, Bardstown, possession of a handgun by a convicted felon (2 counts); persistent felony offender, first-degree.

According to the indictment on Dec. 9, 2015, Cundiff was found in possession of a Beretta 9mm revolver and a Taurus .40 caliber revolved. The indictment cites Cundiff’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
