Nelson Circuit Court Indictments, Feb. 3, 2016

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentMonday, Feb. 29, 2016 – The following people were indicted by a Nelson County grand jury on Wednesday, Feb. 3, 2016. They were scheduled for arraignment on Thursday, Feb. 18, 2016, unless otherwise indicated.

15-CR-344 (AMENDED). CODY R. HENDRICKSON, 29, Bardstown, possession of drug paraphernalia; possession of marijuana.

According to the indictment, on Sept. 22, 2015, Hendrickson was allegedly found in possession of marijuana and drug paraphernalia. Bail was set as the same as the primary charge, plus conditions.

16-CR-10. STEPHEN HALSEY, 57, address unknown, failure to comply with sex offender registry; persistent felony offender, first-degree.

According to the indictment, on Jan. 5, 2016, Halsey, allegedly failed to register with local probation and parole as required by the law. The indictment cites Halsey’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-11. WILLIAM C. LUTES, 48, Bloomfield, trafficking in marijuana (less than 8 ounces).

According to the indictment, on Feb. 2, 2015, Lutes allegedly sold eight ounces or less of marijuana to a confidential source. Bail was set as the same as district court, plus conditions.

16-CR-12. STEPHEN K. HALSEY, 57, address unknown, address unknown, burglary, second-degree (four counts); criminal mischief, third-degree; persistent felony offender, first-degree.

According to the indictment, between Dec. 22, 2015 – Jan. 5, 2016, Halsey is alleged to have unlawfully entered the residence of four different people and a fifth person’s barn with the intent to commit a crime. The indictment further states Halsey alleged caused less than $500 damage at one of the residences. The indictment cites Halsey’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-13. JOSEPH R. NALLEY, a.k.a. JOEY NALLEY, 49, Bardstown, cultivating marijuana, five plants or more and complicity to the same; possession of a controlled substance, first-degree and complicity to the same; trafficking in controlled substances, first-degree (less than 4 grams cocaine) and complicity to the same; possession of drug paraphernalia and complicity to the same; trafficking in marijuana and complicity to the same; persistent felony offender, first-degree.

According to the indictment, on June 9, 2009, Nalley – acting alone or in concert with Kara S. Lewis —  allegedly cultivated five or more marijuana plants with the intent to sell or distribute it; possessed two or more grams of cocaine; and possessed drug paraphernalia. The indictment cites Nalley’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

16-CR-14. STEPHEN K. HALSEY, 57, address unknown, burglary, second-degree; persistent felony offender, first-degree.

According to the indictment, on Oct. 9, 2012, Halsey allegedly entered a person’s residence with the intent to commit a crime. The indictment cites Halsey’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-15. KARA S. LEWIS, a.k.a. KARA WHEELER, 40, Bardstown, cultivating marijuana, five plants or more and complicity to the same; possession of a controlled substance, first-degree and complicity to the same; trafficking in controlled substances, first-degree (less than 4 grams cocaine) and complicity to the same; possession of drug paraphernalia and complicity to the same; trafficking in marijuana and complicity to the same.

According to the indictment, on June 9, 2009, Lewis – acting alone or in concert with Joseph Nalley —  allegedly cultivated five or more marijuana plants with the intent to sell or distribute it; possessed two or more grams of cocaine; and possessed drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

16-CR-16. EVAN LYONS, 21, Bardstown, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; theft by unlawful taking or disposition, contents from vehicle under $500;

According to the indictment, on Oct. 14, 2015, Lyons — acting alone or in concert with Douglas P. Adams — is alleged to have unlawfully possessed methamphetamine; and between Oct. 11-17, 2015, Lyons is alleged to have taken items from an individual having a value of less than $500. Bail was set at $9,500 cash only, plus conditions.

16-CR-17. ALEX N. KEELING, 25, Bardstown, possession of controlled substances, first-degree (heroin); possession of controlled substances, third-degree; possession of drug paraphernalia; possession of marijuana.

According to the indictment, on Sept. 2, 2015, Keeling was allegedly found in possession of heroin, clonazepam pills, marijuana and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

16-CR-18. DOUGLAS P. ADAMS, 34, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of drug paraphernalia.

According to the indictment, on Oct. 14, 2015, Adams — acting alone or in concert with Evan Lyons — is alleged to have unlawfully possessed methamphetamine. He was also found in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

16-CR-19. DEANNA B. DAVIDSON, 41, Mount Washington, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment Davidson – acting alone or in concert with Patrick Bruce Davidson — is alleged to have unlawfully possessed methamphetamine and drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

16-CR-20. JOHNNA S. WIMSATT, 29, Shepherdsville, criminal mischief, first-degree; assault, fourth-degree.

According to the indictment, on Dec. 16, 2015, Wimsatt allegedly punched another person in the mouth, and then damaged property belonging to another person causing a loss of $1,000 or more. Bail was set at $2,500 cash only, plus conditions.

16-CR-21. PATRICK B. DAVIDSON, 45, Bardstown, burglary, third-degree; possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of drug paraphernalia and complicity to the same; possession of burglary tools; carrying a concealed deadly weapon; receiving stolen property; persistent felony offender, first-degree.

According to the indictment, on Dec. 10, 2015, Davidson allegedly entered Maywood U-Store It with the intent to commit a crime while in possession of burglary tools and received, retained or disposed of several firearms and ammunition, bolt cutters, two-way radios, multi-ball towing hitch, cherry dresser, purse, wallet and dishes belonging to other persons having a value of less than $500 and had a knife concealed in his vehicle; and on Dec. 22, 2015, Davidson – acting along or in concert with Deanna B. Davidson – was in possession of methamphetamine and drug paraphernalia. The indictment cites his prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-22. JOSEPH M. SEPULVADO, 33, New Haven, trafficking in controlled substances, first-degree (2 grams or more methamphetamine);  possession of controlled substances, first-degree (methamphetamine); possession of drug paraphernalia.

According to the indictment, on Dec. 7, 2015, Sepulvado allegedly possessed drug paraphernalia and 2 or more grams of methamphetamine with the intent to sell or transfer it. Bail was set at $9,500 cash only, plus conditions.

16-CR-23. AMANDA G. BARNETT, 25, Bloomfield, assault, first-degree.

According to the indictment, on Jan. 28, 2016, Barnett allegedly stabbed another person causing serious physical injury. Bail was set at arraignment.

16-CR-24. CHARLES E. COTHERN, 54, Boston, manufacturing methamphetamine, first-degree; trafficking in controlled substances, first-degree (less than 2 grams methamphetamine); possession of marijuana; possession of drug paraphernalia.

According to the indictment, on Nov. 24, 2015, Cothern allegedly possessed and manufactured methamphetamine while in possession of marijuana and drug paraphernalia. Bail was set at $50,000 cash only, plus conditions.

16-CR-25. DAIMYN S. LINDSEY, 19, Bardstown, theft by unlawful taking/disposition – auto (less than $10,000).

According to the indictment,  on Dec. 26, 2015, Lindsey allegedly took a 2005 Chevrolet Impala belonging to another person having a value of less than $10,000. Bail was set at $5,000 cash only, plus conditions.

16-CR-26. CHRISTOPHER L. HEALEY, 33, Bardstown, possession of controlled substances, first-degree (methamphetamine); possession of drug paraphernalia.

According to the indictment, on Dec. 5, 2015, Healey was allegedly found in possession of methamphetamine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

16-CR-27. JAMES SCOTT MACKIN, 47, Bardstown, possession of controlled substances, first-degree (drug unspecified); possession of marijuana; possession of drug paraphernalia.

According to the indictment, on Nov. 10, 2015, Mackin allegedly possessed cocaine, marijuana and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

16-CR-28. DUSTIN L. VITTITOW, 33, Bardstown, wanton endangerment, first-degree; no insurance.

According to the indictment, on Dec. 19, 2015, Vittitow allegedly operated a motor vehicle without an insurance card, and in a manner that created a substantial danger of death or serious injury to a minor. Bail was set at arraignment, plus conditions.

16-CR-29. RALPH SOLOMON, 64, Bloomfield, failure to comply with sex offender registry; persistent felony offender, second-degree.

According to the indictment, on Sept. 10, 2015, Solomon allegedly failed to complete the address verification form as required by the Sex Offender Registry. The indictment cites his prior felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

16-CR-30. JAMES MICHAEL RUST, 37, Elizabethtown, possession of controlled substances, first-degree (heroin); possession of marijuana.

According to the indictment, on Nov. 16, 2015, Rust was allegedly found in possession of heroin and marijuana. Bail was set at $5,000 cash only, plus conditions.

16-CR-31. ZACHARY T. UPCHURCH, 24, Springfield, possession of controlled substances, first-degree (heroin); possession of drug paraphernalia; reckless driving;

According to the indictment, on Dec. 10, 2015, Upchurch allegedly possessed heroin and drug paraphernalia and operated his motor vehicle in a reckless manner. Bail was set at $5,000 cash only, plus conditions.

16-CR-32. STEVEN B. CARMICLE, 51, West Chester, Ohio, flagrant non-support; persistent felony offender, second-degree.

According to the indictment, from Oct. 1, 2014 through Dec. 31, 2015, Carmicle allegedly failed to  provide support he was ordered to pay, resulting in an arrearage of $5,368.20. The indictment cites his prior felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
