CVS plans OK’d; bank’s attorneys say they’ll enforce long-term lease

Tuesday, April 5, 2016, 3 p.m. — Attorneys representing Town & Country Bank and Trust put the Design Review Board on notice Tuesday morning that the bank is going to court to enforce the bank’s long-term lease it states it has cvsfor its bank branch located at the corner of West John Rowan and North Thirds Street.

Last month, Five Star Developers of Alabama had submitted plans for a 12,900 square foot retail building that will house a new CVS/Pharmacy store – which is proposed for the site the where bank branch currently is located.

A letter to the Development Review Board (DRB) from the bank’s attorneys — which include the local firm Saltsman, Willett, Deaton and Hamilton, and Wyatt, Tarrant & Combs — makes it clear that the bank intends to keep that branch open.

Locating the new pharmacy building on the site assumes the bank will vacate its property and the existing building razed.

“There is currently ongoing litigation to determine whether or not the lease is in effect and Town & Country has no plans to close the branch on the property until that litigation and any appeals are exhausted and the lease has expired.

The DRB members were given copies of the letter prior to the meeting. DRB Chairman David Mattingly praised Five Star Developers’ application for its completeness and attention to detail.

The legal action regarding the bank’s lease did not affect the DRB’s review of the proposed development plans — the board unanimously approved Five Star Developer’s plans for the site.
