Nelson Circuit Court Indictments — July 6, 2016

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentWednesday, July 6, 2016 – The following people were indicted by a Nelson County grand jury on Wednesday, July 6, 2016. They are scheduled for arraignment Thursday, July 21, 2016, unless otherwise indicated.

16-CR-179. JUSTIN M. PARRISH, 24, Bardstown, trafficking in marijuana (less than 8 ounces); possession of drug paraphernalia; no operators license; no insurance; expired Kentucky registration plates; no Kentucky registration receipt.

According to the indictment, on May 19, 2016, Parrish alleged possessed drug paraphernalia and less than 8 ounces of marijuana with the intent to sell it. He was also found without an operators license, insurance or a valid vehicle plate and registration. Bail was set at $5,000 cash only, plus conditions.

16-CR-180. DUSTIN L. VITTITOW. 32, Boston, possession of controlled substances, first-degree (methamphetamine); possession of controlled substances, first-degree (heroin); possession of drug paraphernalia; no insurance; expired Kentucky registration plates; expired Kentucky registration receipt.

According to the indictment, on May 25, 2016, Vittitow allegedly was found in possession of methamphetamine, heroin and drug paraphernalia. He was also found without insurance or valid vehicle registration or plates. Bail was set at $5,000 cash only, plus conditions.

16-CR-181. MICHAEL R. PRICE, 47, Bardstown, flagrant non-support; persistent felony offender, first-degree.

According to the indictment, from March 1, 2008 through Sept. 30, 2015, Price failed to provide support he was ordered to pay, resulting in an arrearage of $28,273.22. The indictment cites Price’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.

16-CR-182. JOSEPH DARREN BARTLEY, 34, Nelson County at-large, receiving stolen property.

According to the indictment, between May 10-24, 2016, Bartley allegedly received, retained or disposed of a Bushnell Scout 1000 Range finder and an Echo CS-3450 chain saw belonging to another person having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only, plus conditions.

16-CR-183. KYLE B. ROBINSON, 34, Bloomfield, operating a motor vehicle under the influence of alcohol/drugs/etc., fourth offense.

According to the indictment, on March 12, 2016, Robinson was operating a motor vehicle under the influence of alcohol/drugs/etc. Bail was set at $9,500 cash only, plus conditions.

16-CR-184. JAMIE HARDIN, 42, Bloomfield, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on May 21, 2016, Hardin – acting alone or in concert with Gina Hardin – allegedly possessed methamphetamine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

16-CR-185. DAIMYN LINDSEY, 20, Bardstown, possession of controlled substances, first-degree (heroin); possession of drug paraphernalia.

According to the indictment, on June 9, 2016, Lindsey allegedly possessed heroin and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

16-CR-186. GINA HARDIN, 43, Bloomfield, possession of controlled substances, first-degree (methamphetamine) and complicity to the same; possession of drug paraphernalia and complicity to the same.

According to the indictment, on May 21, 2016, Hardin – acting alone or in concert with Jamie Hardin – allegedly possessed methamphetamine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

16-CR-187. KATHY BROWN, 39, Bardstown, tampering with physical evidence and complicity to the same; fraudulent firearms transaction.

According to the indictment, on June 21, 2016, Brown – acting alone or in concert with William Brandon Hall – allegedly hid a Taurus 9 mm handgun at her father’s house when she believed an official proceeding was pending. The indictment also alleges Brown provided false information to a firearms dealer for the purchase of a Taurus PT111G2 9 mm handgun. Bail was set at $9,500 cash only, plus conditions.

16-CR-188. FRANCISCO RODRIGUEZ-PENA, 18, Bardstown, trafficking in controlled substances, first-degree, and complicity to the same (more than 2 grams methamphetamine); trafficking in controlled substances, first-degree (more than 2 grams cocaine); possession of a firearm while committing an offense.

According to the indictment, on June 22, 2016, Rodriguez-Pena – acting along or in concert with Vincent Rodriguez-Pena — possessed more than 2 grams of methamphetamine and cocaine with intent to sell or transfer it while in possession of a firearm. Bail was set at $500,000 cash only, plus conditions.

16-CR-189. William Brandon Hall, 38, Bardstown, assault, first-degree; tampering with physical evidence and complicity to the same.

According to the indictment, on June 21, 2016, Hall intentionally shot Michael Patrick Young causing serious physical injuries. The indictment further alleges Hall – acting alone or in concert with Kathy Brown – hid a Taurus 9 mm handgun when he believed an official proceeding was pending. Bail was set at $100,000 cash only, plus conditions.

16-CR-190. VINCENT RODRIGUEZ-PENA, 22, Bardstown, trafficking in controlled substances, first-degree, and complicity to the same (more than 2 grams methamphetamine); trafficking in controlled substances, first-degree (more than 2 grams cocaine); possession of a firearm while committing an offense.

According to the indictment, on June 22, 2016, Rodriguez-Pena – acting along or in concert with Francisco Rodriguez-Pena — possessed more than 2 grams of methamphetamine and cocaine with intent to sell or transfer it while in possession of a firearm. Bail was set at $500,000 cash only, plus conditions.

16-CR-191. JIMMY L. JACKSON, 71, Cox’s Creek, possession of a firearm by a convicted felon.

According to the indictment, on Sept. 15, 2015, Jackson allegedly possessed a 12-gauge shotgun after having previously been convicted of a felony. Bail was set at $5,000 cash only, plus conditions.

16-CR-192. KYLE E. BAETENS, 30, Frankfort, wanton-endangerment, first-degree; operating a motor vehicle while under the influence of alcohol/drugs/etc.; possession of controlled substances, third-degree; failure owner to maintain required insurance; possession of prescription not in a proper container; possession of an open alcohol container in a motor vehicle; persistent felony offender, second-degree.

According to the indictment, on June 9, 2016, Baetens allegedly drove the wrong way on the Bluegrass Parkway while under the influence of alcohol/drugs/etc. and struck another vehicle while in possession of suboxone and an open alcohol container in his motor vehicle. The indictment further alleges Baetens did not possess insurance and had prescription medication that was not in its original container. The indictment cited Baetens’ prior felony conviction as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.
