Butler: 911 agreement under wraps to keep it away from Watts, magistrates

Wednesday, July 27, 2016, 1:30 p.m. (UPDATED with meeting video, July 27, 2016) — City Attorney Tim Butler told the Bardstown City Council Tuesday that he will have a draft of the E-911 interlocal agreement to share with them at next Tuesday’s council working session — and not a minute before.

Currently, the agreement governing the joint city-county dispatch is operating under an extension of the agreement that expired last September. The extension was to give the city and county time to come up with a new agreement.

When asked by Councilmen Francis Lydian and Fred Hagan if they will have a chance to review the draft agreement prior to Tuesday’s meeting, Butler said he would not send it to them beforehand because he did not want Judge Executive Dean Watts and members of Nelson Fiscal Court to get a copy before the council has a chance to review it.

“In my opinion, quite frankly, the magistrates and judge have gotten that information and have gotten to have their say before I have my say,” Butler said. “I want to be able to tell you why I wrote what I wrote before somebody tells me why I shouldn’t have written what I’ve written.”

Butler assured the council members he will attend the working session and can explain in detail his reasoning behind the provisions of the draft agreement. The council will have a chance to approve the agreement or seek changes as early as the Aug. 9 council meeting.

HISTORIC REVIEW BOARD RECOMMENDATIONS. The council approved the following recommendations from the Historic Review Board (HRB) on applications for certificates of appropriateness:

COA-16-45. Anthony Torres, 305 South Fifth St., proposed changes to landscaping.

COA-16-51. Rob Smotherman, 97 West Flaget., proposed changes to window, trim and door color.

COA -16-52. Jamie Sizemore, 110 West Stephen Foster Ave., remove concrete pad at rear of building and repave parking area.

COA-16-53. John and Luci Bradford, 104 East Broadway St., proposal to change the trim color of the windows and the house.

COA-16-54. Lewis and Paulette Korody, 512 North 3rd St., proposal to replace the basement windows.

COA -16-56. Clear Properties LLC, 511 511 ½ and 513 North Third St., proposal to alter landscape.

COA-16-57. Evan Kulsveen, 216 West Flaget., propose to remove trees and change the walkway to brick pavers.

COA-16-58. Tisha Davis, Louise Davis, 105 B East Flaget., proposal to paint the door and add signage.

COA -16-59. Mary Carey, 116 North Third St., design concept for a mural at the rear of the building; will return before HRB with a final design that meets the allowable dimensions.

COA-16-60. Bardstown Eye Care, 311 North Third St., proposal for new signage.

In other business, the council:

— approved the 2016-17 budget submitted by the Bardstown-Nelson County Human Rights Commission.

— approved a five-year tax assessment moratorium for the home at 207 North Fourth Street, located behind Hadorn’s Bakery. In order to qualify for the moratorium, the property owner must agree to invest in repairing or improving the property.

NEXT UP. The council will hold a working session at 5 p.m. on Tuesday, Aug. 2, 2016, in the council chambers on Xavier Drive next to Rec Center.
