Nelson Circuit Court Indictments–May 18, 2011

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

The following people were indicted by a Nelson County grand jury on Wednesday, May 18, 2011. They are set for arraignment in Nelson Circuit Court on June 2, 2011 unless otherwise indicated.

11-CR-140. Lashawn Tonge, 21, Bardstown, assault first-degree and complicity; intimidating a participant in a legal process and complicity to same; retaliating against a participant in a legal process and complicity to same.

According to the indictment, between May 12 and May 13, 2011, Tonge, acting alone or in concert with Randy E. Cooper Jr., allegedly assaulted a Bardstown man and then attempted to scare the victim who Tonge believed to be a participant in a legal process. The indictment states that Tonge allegedly also “engaged or threatened to engage in conduct causing or intended to cause bodily injury.” Bail was set at $50,000 cash only plus conditions.

11-CR-142. Randy E. Cooper Jr., 26, Bardstown, assault first-degree and complicity to same; intimidating a participant in a legal process and complicity to same; retaliating against a participant in a legal process and complicity to same; second-degree persistent felony offender.

According to the indictment, between May 12 and May 13, 2011, Cooper, acting alone or in concert with Lashawn Tonge, allegedly assaulted a Bardstown man and then attempted to scare the victim who Cooper believed to be a participant in a legal process. The indictment states that Cooper allegedly also “engaged or threatened to engage in conduct causing or intended to cause bodily injury.” Cooper was also indicted for being a persistent felony offender as he had prior felony convictions. Bail was set at $50,000 cash only plus conditions.

11-CR-141. Pascal “Pat” Jones, 51, New Hope, first-degree sodomy; first-degree unlawful transaction with a minor; first-degree sexual abuse (2 counts).

According to the indictment, between 2002 and August 2009, Jones alleged committed two counts of first-degree sexual abuse by engaging in sexual contact with another person under age 18 by forcible compulsion. The indictment states he also allegedly engaged in deviant sexual intercourse with another person by use of forcible compulsion, and allegedly caused a minor under age 18 to engage in sexual activity with another minor under the age of 18. Bail was set at $200,000 cash only plus conditions.

11-CR-143. William Cody Smith, 21, Bardstown, second-degree burglary and complicity to same; theft by unlawful taking and complicity to same.

According to the indictment on April 12, 1011 Smith, either acting alone or in concern with James A. Close, allegedly entered a residence unlawfully and took a laptop and wireless Internet stick having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only plus conditions.

11-CR-144. Terrance D. Montgomery, 32, Bloomfield, trafficking in marijuana (less than 8 ounces); possession of firearm by convicted felon; fleeing and evade police, first-degree; resisting arrest; first-degree persistent felony offender.

According to the indictment on April 2, 2011, Montgomery allegedly was in possession of 8 ounces of marijuana with the intent to sell it. The indictment states he was allegedly in possession of a chrome Colt. 38 Special; ran from police and disobeyed a direction to stop, and resisted arrest by Officer McKenzie Mattingly. Montgomery was also indicted for allegedly being a persistent felony offender as he had prior felony convictions. Bail was set at $100,000 cash only plus conditions.

11-CR-145. James Allan Close Jr., 21, Bardstown, second-degree burglary and complicity to same; theft by unlawful taking and complicity to same.

According to the indictment, on April 12, 1011 Close, either acting alone or in concert with William Cody Smith, allegedly entered a residence unlawfully and took a laptop and wireless Internet stick having a value of $500 or more but less than $10,000. Bail was set at $5,000 cash only plus conditions.

11-CR-146. Jonah D. Duke, 28, Bardstown, receiving stolen property; theft by unlawful taking; tampering with physical evidence.

According to the indictment, between July 16, 2010 and April 19, 2011, Duke allegedly received, retained or disposed of a 2008 Bobcat loader while knowing it was stolen and having a value of $10,000 or more. He was also indicted for allegedly removing the vehicle indentification number (VIN) plate from the Bobcat when he believed an official proceeding was pending. Between April 5 and April 19, 2001, Duke also allegedly removed cast steel water pipe belong to Charles D. Monin having a value of more than $500 but less than $10,000. Bail was set at $20,000 cash only plus conditions.

11-CR-147. John Wesley Jackson, 41, Bardstown, fraudulent use of a credit card or debit card; theft; receipt of a stolen credit or debit card; and first-degree persistent felony offender.

According to the indictment between Apirl 9 and April 10, 2011, Jackson allegedly took a credit card that belonged to another person and used it to obtain money in the amount of $500 or more but less than $10,000. Jackson was also indicted for allegedly being a persistent felony offender as he had prior felony convictions. Bail was set at $100,000 cash only plus conditions.

11-CR-148. Catherine G. Leake, 24, Bardstown, first-degree possession of controlled substance; possession of controlled substance, second-degree; trafficking in marijuana (less than 8 ounces); possession of marijuana; possession of drug paraphernalia.

According to the indictment, on April 8, 2011, Leake allegedly possessed less than 8 ounces of marijuana with intent to sell it. The indictment states Leake also allegedly had possession of Opana, a schedule II narcotic, and Concerta, a non-narcotic schedule II controlled substance. Bail was set at $7,500 cash only plus conditions.

11-CR-149. Jason Anthony Hagan, 31, Bardstown, first-degree possession of controlled substance; criminal littering; possession of open container in vehicle. Bail was set at $5,000 cash only plus conditions.

11-CR-150. Anthony R. O’Hara, 30, Louisvlle, third-degree burglary and complicity to same (2 counts each); persistent felony offender, first-degree.

According to the indictment, on March 29 and April 2, 2011, Ohara, either acting alone or in concert with Jonathon Cummins, allegedly entered a two Nelson County businesses with the intent to commit a crime. Ohara was also indicted for allegedly being a persistent felony offender in the first-degree as he has prior felony convictions. Bail was set at $100,000 cash only plus conditions.

11-CR-151. Marshall L. Ashby, 49, Louisville, unlawful transaction with a minor, first-degree; sodomy, second-degree, first-degree sexual abuse.

According to the indictment, between June 2010 and February 2011, Ashby allegedly engaged in sexual contact with another person under the age of 16. He was also indicted for alleged deviate sexual intercourse with a person under the age of 14 by use of forcible compulsion, and allegedly causing a minor under the age of 16 to engage in sexual activity. Bail was set at $200,000 cash only plus conditions.

11-CR-152. Shannon Cane Hunter, 37, Vine Grove, first-degree burglary; first-degre robbery; fourth-degree assault; third-degree criminal mischief.

According to the indictment, on Oct. 29, 2010, Hunter allegedly entered a residence while armed with a deadly weapon, causing one of the residents injury, and taking another resident’s cell phone worth more than $500 but less than $10,000, and damaging the residence during the break-in. Bail was set at $50,000 cash only plus conditions.

11-CR-153. Jonathon T. Cummins, 27, Louisville, third-degree burglary and complicity to same (2 counts each); persistent felony offender, second-degree.

According to the indictment, on March 29 and April 2, 2011, Cummins, either acting alone or in concert with Anthony O’Hara, allegedly entered a two Nelson County businesses with the intent to commit a crime. Cummins was also indicted for allegedly being a persistent felony offender in the second-degree as he had prior felony convictions. Bail was set at $100,000 cash only plus conditions.

11-CR-154. Shane Hooper, 26, Cox’s Creek, criminal mischief, first-degree. Bail was set at $7,500 cash only plus conditions.

11-CR-155. Elvin Jujuan Jenkins, 33, Bardstown, sodomy, first-degree, 20 counts.

According to the indictment, between July 30, 2010 and April 22, 2011, Jenkins allegedly engaged in deviate sexual intercourse with another person by usef of forcible compulsion. Bail was set at $200,000 cash only plus conditions.

11-CR-156. Crystal Lynn Burman, 39, Bardstown, rape, third-degree.

According to the indictment, between October 2010 and Jan. 2, 2011, Burman allegedly engaged in sexual intercourse with another person under the age of 16. Bail was set at $5,000 cash only plus conditions.

11-CR-157. Vickie Lynn Ramos, 45, Hazelwood, Missouri, flagrant non-support.

According to the indictment, between Jan. 1, 2008 and April 30, 2011, Ramos allegedly failed to provide support which she knew she was ordered to pay resulting in an arrearage of $7,519.07. Bail was set at $5,000 cash only plus conditions.
