Board of education approves changes in its agreement with ex-superintendent Orr

The Nelson County Board of Education approved an amended agreement with former district superintendent Anthony Orr at Thursday’s meeting.

Friday, Dec. 8, 2017 — The Nelson County Board of Education approved an amended agreement that replaces the one it approved earlier this year when superintendent Anthony Orr resigned his post as superintendent, but remained a certified district employee.

At the end of Thursday’s special-called board of education meeting, the board entered into an executive session to discuss “proposed or pending litigation.” After meeting behind closed doors with board attorney Terry Geoghegan for about 90 minutes, the board emerged and voted on the agreement without discussion.

According to Geoghegan, there had been complaints to the Office of Educational Accountability (OEA) regarding the original agreement Orr and the board agreed to in July. At the time, Orr was assigned to a new job the board created for him at the same meeting, Director of Process, Research, and Improvement, and the details of that new position and compensation were included in the agreement.

The OEA questioned the language in parts of the original agreement, prompting negotiations that led to the agreement the board approved Thursday evening.

The July 20 agreement acknowledged that Orr resigned  as superintendent, however, he was to remain a district employee per his employment contract when runs through the middle of next year.

Geoghegan said the new agreement removes language that was potentially objectionable and among other things, clarified language on Orr’s sick leave benefits.

WHAT CHANGED? The new agreement deletes a number of paragraphs from the original document that covered specific duties attached to Orr’s job as Director of Process, Research and Improvement.

The original agreement also contained specifics regarding Orr’s salary and compensation, sick pay and other benefits. The new agreement does not mention salary and compensation, but retains provisions regarding sick pay and district-paid moving expenses if he leaves the district’s employment.

After the meeting Geoghegan explained that the intent of the original agreement was to allow the district to benefit from having Orr’s knowledge and experience working in a new capacity that would be beneficial to the district while also fulfilling the terms of his employment contract.
