Nelson Circuit Court Indictments — Dec. 19, 2018

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

indictmentWednesday, Dec. 19, 2018 — The following people were indicted by a Nelson County grand jury on Wednesday, Dec. 19, 2018. They are scheduled to be arraigned Thursday, Jan. 10, 2019, in Nelson Circuit Court.

18-CR-416. JOHN E. HALL, 29, Bardstown, trafficking in controlled substances, first-degree; possession of drug paraphernalia; possession of marijuana; persistent felony offender, second-degree.

According to the indictment, on Nov. 4, 2018, Hall allegedly distributed Heroin to another individual while in possession of drug paraphernalia and marijuana. The indictment cites Hall’s prior felony conviction as basis for the persistent felony offender charge. Bail was set at $25,000 cash only, plus conditions.

18-CR-417. THOMAS R. YOCUM, 37, Bardstown, burglary, third-degree; receiving stolen property; persistent felony offender, first-degree.

According to the indictment, between March 1, 2018 and May 2, 2018, Yocum allegedly entered in a building owned by another person with the intent to commit a crime and was in possession of a bow and archery accessories knowing the were stolen, having a value of more than $500 but less than $10,000. The indictment cites Yocum’s prior felony convictions as basis for the persistent felony offender charge. Bail was set at $9,500 cash only, plus conditions.

18-CR-418. KATIE J. DURBIN, 24, New Haven, possession controlled substance, first-degree (methamphetamine); possession drug paraphernalia.

According to the indictment, on Oct. 29, 2018, Durbin alleged was found in possession of methamphetamine and drug paraphernalia. Bail was set as the same as District Court, plus conditions.

18-CR-419. TYLER GENE MILES, 26, Bloomfield, possession controlled substance, first-degree (methamphetamine); possession of a firearm while committing an offense; possession of controlled substance, second-degree; possession of drug paraphernalia; possession of marijuana.

According to the indictment, on Nov. 12, 2018, Miles allegedly was found in possession of methamphetamine, suboxone, marijuana and drug paraphernalia while also in possession of 9mm handgun. Bail was set at $5,000 cash only, plus conditions.

18-CR-420. BETH RENEE YOUNG, 47, Bardstown, theft by unlawful taking; forgery, first-degree (58 counts).

According to the indictment, between Sept. 16, 2017 and Sept. 18, 2018, Young allegedly took and forged 58 separate checks on the account of Team Boone totalling $59,064.31. Bail was set at $9,500 cash only, plus conditions.

18-CR-421. DUSTIN STUMP, 26, Bardstown, wanton endangerment, first-degree (police officer); possession of a handgun by a convicted felon; receiving stolen property (firearm); tampering with physical evidence; resisting arrest; terroristic threatening, third-degree; carrying a concealed deadly weapon; disorderly conduct, second-degree; alcohol intoxication; persistent felony offender, second-degree.

According to the indictment, on Nov. 28, 2018, Stump was allegedly found in possession of a Springfield XD-9 9mm handgun knowing it was stolen and defaced. The indictment also alleges that Stump fired the weapon in the parking lot of the Wilson Motel and attempted to hide the weapon from police. The indictment alleges Stump resisted officers’ attempts to place him under arrest, threatened the officer with harm, and engaged in threatening behavior in a public place while under the influence of alcohol. The indictment cites his prior felony conviction as basis for the persistent felony offender charge. Bail was set at $20,000, cash only, plus conditions.

18-CR-422. TIM WILSON, age unknown, Bardstown, theft by failure to make required disposition of property, $500 or more.

According to the indictment, between Aug. 1, 2018 and Dec. 1, 2018, Wilson allegedly obtained money to purchase materials for a construction project for an individual in an amount greater than $500 and did not complete the improvements and treated the money as his own. Bail was set at $5,000 cash only, plus conditions.

18-CR-423. ROCKY BREEDLOVE, 55, Cox’s Creek, rape, first-degree (17 counts); incest, (17 counts).

According to the indictment, sometime between 2010 and 2018, Breedlove allegedly engaged in sexual intercourse by forcible compulsion with someone he knew to be a blood relative. Bail was set at $200,000 cash only, plus conditions.

18-CR-424. TODD S. HARRELL, 35, Bardstown, theft of vehicle registration decal.

According to the indictment, on Oct. 27, 2018, Harrell allegedly took a current vehicle registration decal belonging to another person. Bail was set at $5,000 cash only, plus conditions.

18-CR-425. KALEB SHEHAN, 22, Bardstown, trafficking in synthetic drugs, first-offense, possession of drug paraphernalia.

According to the indictment, on Nov. 29, 2018, Shehan allegedly possessed synthetic marijuana with the intent to sell it, and was found in possession of drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

18-CR-426. SHAKEYTA HUGHES, 36, Bardstown, trafficking in controlled substances, first-degree (less than 4 grams cocaine) (2 counts); possession of drug paraphernalia (2 counts).

According to the indictment, on Oct. 31, 2017 and Sept. 19, 2017, Hughes allegedly sold 4 or fewer grams cocaine to a confidential informant while in possession of drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

18-CR-427. CHRISTOPHER M. BIVEN, 28, Bloomfield, possession of controlled substance, first-degree (methamphetamine); possession of a firearm while committing an offense; possession of drug paraphernalia.

According to the indictment, on Nov. 12, 2018, Biven allegedly was found in possession of methamphetamine, several firearms, and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

18-CR-428. JOSEPH SCOTT MATTINGLY, 50, New Hope, cultivating marijuana, five plants or more; possession controlled substance, first-degree (methamphetamine); trafficking in marijuana; possession of drug paraphernalia.

According to the indictment, on Oct. 24, 2018, Mattingly was allegedly found to be cultivating more than 5 marijuana plants with the intent to sell it; and in possession of methamphetamine and drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

18-CR-429. MICHAEL S. NEWTON, 29, New Haven, possession of controlled substance, first-degree (methamphetamine); possession of drug paraphernalia.

According to the indictment, on Oct. 29, 2018, Newton was found in possession of methamphetamine and drug paraphernalia. Bail was set at $5,000 cash only, plus conditions.

18-CR-430. JOSEPH SCOTT MATTINGLY, 50, New Hope, trafficking in controlled substances, first-degree (less than 2 grams methamphetamine) (2 counts); possession of drug paraphernalia (2 counts).

According to the indictment, on Jan. 9, 2018 and Feb. 5, 2018, Mattingly allegedly sold methamphetamine to a confidential informant while in possession of drug paraphernalia. Bail was set at $9,500 cash only, plus conditions.

18-CR-431. MICHAEL D. HUMPHREY, 56, New Haven, trafficking in controlled substances (less than 2 grams methamphetamine); tampering with physical evidence; operating a motor vehicle while under the influence of alcohol and/or drugs; failure to illuminate rear license; persistent felony offender, first-degree.

According to the indictment, on Nov. 21, 2018, Humphrey alleged possessed less than 2 grams methamphetamine with the intent to sell it. The indictment alleges he attempted to conceal a plastic container containing illegal controlled substances from police, and operated a motor vehicle under the influence of alcohol and/or drugs. The indictment cites Humphrey’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $20,000 cash only, plus conditions.

18-CR-432. KEVIN M. MUDD, 35, Bardstown, possession controlled substances, first-degree (opiates); receiving stolen property (firearm); possession controlled substances, third-degree; illegal taking/pursuit of a deer or wild turkey; prescription not in proper container; possession of marijuana.

According to the indictment, on Aug. 23, 2018, Mudd allegedly possessed a stolen, defaced .22-250 bolt action rifle and found in possession of Xanax and hydrocodone. The indictment alleges Mudd also illegal possessed or pursued a deer in a manner contrary to state law; possession a prescription not in its proper container; and was found in possession of marijuana. Bail was set at $5,000 cash only, plus conditions.

18-CR-433. ADAM LITTLE, 21, Bardstown, possession of controlled substance, first-degree (cocaine); possession of controlled substance, first-degree (drug unspecified); public intoxication.

According to the indictment, Aug. 11, 2018, Little allegedly was found in possession of cocaine and Xanx while under the influence of a controlled substance or other intoxicating substance in a public place. Bail will be set at arraignment, plus conditions.

18-CR-434. JEROME THOMAS MUDD, 54, Bardstown, burglary, second-degree; sexual abuse, first-degree.

According to the indictment, on Nov. 11, 2018, Mudd allegedly entered into another person’s residence with the intent to commit a crime. The indictment also alleges Mudd engaged in sexual contact with another person by forcible compulsion. Bail was set at $20,000 cash only, plus conditions.

18-CR-435. DAKOTA M. BARTLEY, 18, Bardstown, unlawful imprisonment, first-degree; unauthorized use of a motor vehicle; menacing.

According to the indictment, on Nov. 22, 2018, Bartley allegedly restrained and acted disorderly toward another person, and used a 2002 Mercury Sable without authorization. Bail was set at $5,000 cash only, plus conditions.
