Nelson Circuit Court Indictments–July 6, 2011

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.
The following people were indicted by a Nelson County grand jury on Wednesday, July 6, 2011. They are set for arraignment in Nelson Circuit Court on July 21, 2011 unless otherwise indicated.
11-CR-179. Thomas R. Yocum, 30, Bardstown, theft by unlawful taking, tampering with physical evidence, persistent felony offender, first-degree.
According to the indictment, on June 3, 2011, Yocum allegedly took a 2011 14-foot utility trailer from Pat’s Appliance & Lawn Care. He also is alleged to have attempted to conceal or dispose of the trailer. Bail was set at $100,000 cash only plus conditions.
11-CR-180. Daniel Lee Taylor, 51, Cox’s Creek. Trafficking in marijuana (8 ounces to 5 lbs); cultivating marijuana, less than 5 plants; possession of drug paraphernalia; possession of marijuana. Bail was set at $2,500 cash only plus conditions.
11-CR-181. David M. Lucas, 27, Bardstown, first-degree trafficking in controlled substances and complicity to same; tampering with physical evidence and complicity to same; fleeing and evading police, first-degree (on foot); resisting arrest.
According to the indictment, on Jan. 30, 2011, Lucas, acting alone or in concert with Casey Bowling, Wesley Witt and Chevelle Allen, sold a controlled substance to another individual. Lucas, either acting alone or in concert with Bowling, Witt and Allen, allegedly attempted to conceal heroin. The indictment also alleges that Lucas fled or evaded police on foot, and resisted arrest. Bail was set at $50,000 cash only plus conditions.
11-CR-182. Vincent E. Keels, 20, theft by unlawful taking and complicity to same.
According to the indictment, sometime between Nov. 29 – Dec. 20, 2010, Keels, either acting alone or in concert with Martin Keels and Diana Kendrick, took a money order with a value of more than $500 but less than $10,000 belonging to another person. Bail was set at $5,000 cash only plus conditions.
11-CR-183. Casey J. Bowling, 22, Bardstown, first-degree trafficking in controlled substances and complicity to same; tampering with physical evidence and complicity to same; fleeing and evading police, first-degree; possession of prescription not in a property container, first offense.
According to the indictment, on Jan. 30, 2011, Bowling, acting alone or in concert with David Lucas, Wesley Witt and Chevelle Allen, sold a controlled substance to another individual. Bowling, either acting alone or in concert with Lucas, Witt and Allen, allegedly attempted to conceal heroin. The indictment also alleges that Bowling fled or evaded police on foot, and he was in possession of a prescription not in its proper container. Bail was set at $50,000 cash only plus conditions.
11-CR-184. Martin L. Keels, 19, Bardstown, theft by unlawful taking and complicity to same.
According to the indictment, sometime between Nov. 29 – Dec. 20, 2010, Keels, either acting alone or in concert with Vincent Keels and Diana Kendrick, took a money order belonging to another person with a value of more than $500 but less than $10,000. Bail was set at $5,000 cash only plus conditions.
11-CR-185. Wesley Witt, 32, Boston, first-degree trafficking in controlled substances and complicity to same; tampering with physical evidence and complicity to same; alcohol intoxication.
According to the indictment, on Jan. 30, 2011, Witt, acting alone or in concert with Casey Bowling, David Lucas and Chevelle Allen, sold a controlled substance to another individual. Witt, either acting alone or in concert with Bowling, Lucas, and Allen, allegedly attempted to conceal heroin. The indictment also alleges that Witt was under the influence of alcohol to the degree he might have endangered himself or others. Bail was set at $50,000 cash only plus conditions.
11-CR-186. Diana L. Kendrick, 38, Shoals, Ind., theft by unlawful taking and complicity to same.
According to the indictment, sometime between Nov. 29 – Dec. 20, 2010, Kendrick, either acting alone or in concert with Martin Keels and Vincent Keels, took a money order belonging to another person with a value of more than $500 but less than $10,000. Bail was set at $5,000 cash only plus conditions.
11-CR-187. Chevelle Allen, 36, address unknown, first-degree trafficking in controlled substances and complicity to same; tampering with physical evidence and complicity to same; terroristic threatening, third-degree; disorderly conduct, second-degree; menacing; failure to notify address change to Department of Transportation; persistent felony offender, first-degree.
According to the indictment, on Jan. 30, 2011, Allen, acting alone or in concert with David Lucas, Wesley Witt and Casey J. Bowling, sold heroin, a controlled substance, to another individual. Bowling, either acting alone or in concert with Lucas, Witt and Bowling, allegedly attempted to conceal heroin. The indictment further alleges that Allen threatened, curse and fought with Kentucky State Police Trooper Cory Nokes. Bail was set at $50,000 cash only plus conditions.
11-CR-188. Rickey Dale Spaw, 37, Bardstown, manufacturing methamphetamine; possession of drug paraphernalia. Bail was set at $50,000 cash only plus conditions.
11-CR-189. Joseph Irvin Hardin, 29, Bardstown, failure to comply with sex offender registry (two counts); prohibited use of electronic means to procure a minor/peace officers for sexual offenses (two counts); persistent felony offender, second-degree.
According to the indictment, sometime between March 1 – April 29, 2011, Hardin allegedly failed to comply with the Sex Offender Registry by using two different aliases for internet communications and failing to register these identities with the probation and parole office. The indictment further alleges that on March 8 and March 27, 2011, Hardin used his computer or other electronic means to procure or promote the use of a minor for a sexual activity. Bail was set at $100,000 cash only plus conditions.
11-CR-190. Frankie Allen Case Jr., 32, Bardstown, criminal abuse, second-degree; persistent felony offender, first-degree.
According to the indictment on Jan. 2 and Jan. 5, 2011, Case allegedly caused serious injury and/or placed someone in a situation that may cause serious injury, and/or causing torture, cruel confinement or cruel punishment to a child under 12 years of age. Bail was set at $50,000 cash only plus conditions.
11-CR-191. Charles Tyrone Poynter, 28, Bardstown, wanton endangerment, first-degree; criminal mischief, third-degree; persistent felony offender, first-degree.
According to the indictment, on May 14, 2011, Poynter allegedly shot a firearm at a vehicle parked in a driveway, breaking the rear window glass of a vehicle he did not own, causing damage of less than $500. Bail was set at $100,000.
11-CR-192. Louis Porter Curtsinger, 25, address unknown, first-degree trafficking in controlled substances; tampering with physical evidence; persistent felony offender, second-degree.
According to the indictment, on June 30, 2011, Curtsinger allegedly sold an unspecified controlled substance, and when he believed an official proceeding pending, hid Percocet pills in the driver’s seat. Bail was set at $50,000 cash only plus conditions.
11-CR-193. Joshua Michael Downs, 30, St. Francis, first-degree possession of controlled substance; tampering with physical evidence; possession of drug paraphernalia; obstructed vision and/or windshield.
According to the indictment, on May 26, 2011, Downs allegedly was in possession of crack cocaine. The indictment states he allegedly attempted to hide cocaine in a cellophane wrapper in his shoe, and that the vehicle he was operating had a windshield broken in three places. Bail was set at $5,000 cash only plus conditions.
11-CR-194. Zachory Taylor Kessinger, 19, Bardstown, second-degree burglary; theft by unlawful taking.
According to the indictment, on June 10, 2011, Kessinger allegedly entered a residence and took a laptop computer, a watch, cell phone and Xbox video game system and games belonging to another person, having a value of more than $500 but less than $10,000. Bail was set at $25,000 cash only plus conditions.
11-CR-195. Raymond Lee Thomas, 38, Bowling Green, receiving stolen property. Bail was set at $9,500 cash only plus conditions.
