Nelson County Court Indictments–July 20, 2011

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

The following people were indicted by a Nelson County grand jury on Wednesday, June 20, 2011. They are set for arraignment in Nelson Circuit Court on Aug. 4, 2011 unless otherwise indicated.

11-CR-196. Jerry D. Nation, 31, Bloomfield, bail jumping, first-degree, two counts.

According to the indictment, on May 26, 2011, Nation allegedly violated the terms of his bond by failing to appear for a Nelson Circuit Court pre-trial conference regarding two indictments in which he was named. Bail was set at $50,000 cash only plus conditions.

11-CR-197. Laverna J. Scrogham, 25, Chaplin, cultivating marijuana, five or more plants and complicity to same and possession of a firearm while committing the offense; possession of drug paraphernalia and complicity to same, and possession of a firearm while committing the offense.

According to the indictment, on June 15, 2011, Scrogham, either acting alone or in concert with James A. Scrogham, possessed drug paraphernalia and cultivated five or more marijuana plants with the intent to sell or transfer the marijuana while also having possession of several firearms. Bail was set at $9,500 unsecured plus conditions.

11-CR-198. Brandon Board, 21, Bardstown, third-degree burglary; assault, third-degree; fleeing and evading police, second-degree; resisting arrest; criminal mischief, third-degree; giving police officer false name or address.

According to the indictment, on July 2, 2011, Board allegedly entered Keaney’s Rental Center with the intent to commit a crime, damaging property with a value of less than $500 that belonged to the business. The indictment further states that when Board was arrested, he allegedly fought with officers, fled on foot, resisted arrest and gave police officers a false name or address. Bail was set at $25,000 cash only plus conditions.

11-CR-199. James Scrogham, 27, Chaplin, cultivating marijuana, five or more plants, complicity to same and possession of a firearm while committing the offense; possession of drug paraphernalia and complicity to same, and possession of a firearm while committing the offense.

According to the indictment, on June 15, 2011, Scrogham, either acting alone or in concert with Laverna J. Scrogham, possessed drug paraphernalia and cultivated five or more marijuana plants with the intent to sell or transfer the marijuana while also having possession of several firearms. Bail was set at $9,500 cash only plus conditions.

11-CR-200. David W. Beavers, 49, Boston, flagrant non-support.

According to the indictment, between Sept. 1, 2009 and May 31, 2011, Beavers allegedly failed to provide support which he was ordered to pay, resulting in an arrearage of $16,077.06. Bail was set at $5,000 cash only plus conditions.

11-CR-201. John Keith Downs, 35, Boston, flagrant non-support.

According to the indictment, between May 1, 2007 and June 30, 2011, Downs allegedly failed to provide support which he was ordered to pay, resulting in an arrearage of $3,197. Bail was set at $5,000 cash only plus conditions.

11-CR-202. Kevin Dean Kerner, 40, Bardstown, theft by unlawful taking and complicity to same, persistent felony offender, second-degree.

According to the indictment, on June 6, 2011, Kerner, acting alone or in concert with Deanna Kerner, allegedly took antique farm equipment belonging to Donald Ellis Jr. having a value of more than $500 but less than $10,000. Kerner was also indicted on a charge of second-degree persistent felony offender for alleged prior felony convictions. Bail was set at $5,000 cash only plus conditions.

11-CR-203. Timothy Keith Johnson, 29, New Haven, fleeing and evading police, first-degree (on foot); resisting arrest; persistent felony offender, first-degree.

According to the indictment on March 4, 2011, Johnson allegedly fled on foot from a police officer and used or threatened to use physical force or violence while resisting arrest. Johnson was also indicted on a charge of first-degree persistent felony officer due to alleged prior felony convictions. Bail was set at $9,500 cash only plus conditions.

11-CR-204. Deanna G. Kerner, 47, Bardstown, theft by unlawful taking and complicity to same.

According to the indictment, on June 6, 2011, Kerner, acting alone or in concert with Kevin Kerner, allegedly took antique farm equipment belonging to Donald Ellis Jr. having a value of more than $500 but less than $10,000. Bail was set at $5,000 cash only plus conditions.

11-CR-205. Christopher C. Willett, 48, Bardstown, flagrant non-support.

According to the indictment, between Oct. 29, 2010 and July 15, 2011, Willett allegedly failed to provide support which he was ordered to pay, resulting in an arrearage of $2,412.24. Bail was set at $5,000 cash only plus conditions.

11-CR-206. Sara Kerr, 35, Bloomfield, flagrant non-support.

According to the indictment, between March 18 and July 15, 2011, Kerr allegedly failed to provide support which he was ordered to pay, resulting in an arrearage of $1,445.50. Bail was set at $5,000 cash only plus conditions.

11-CR-207. Ronnie Dale Nally, 32, New Haven, operating a motor vehicle under influence of alcohol/drugs/etc., fourth offense; possession of open container in vehicle; reckless driving.

According to the indictment, on June 8, 2011, Nally allegedly operating a motor vehicle while under the influence of alcohol and/or drugs, having been previously convicted three times for the offense in the five years prior. Nally allegedly had an open alcohol beverage container in his vehicle and was operating the vehicle in a reckless manner. Bail was set at $5,000 cash only plus conditions.

11-CR-208. Jacob M. Maschak, 21, Vine Grove, receiving stolen property over $300 (2 counts) and complicity to same; theft by unlawful taking and complicity to same (2 counts).

According to the indictment, on June 20, 2011, Maschak, acting alone or in concert with Ian Criner, allegedly received credit cards and a Kicker speaker in a gray carpeted box, each with a value of more than $500 but less than $10,000, while having a reason to believe each item was stolen. Bail was set at $5,000 cash only plus conditions.
