Nelson Circuit Court Indictments-Aug. 3, 2011

Friday, Aug. 5, 2011, 1:30 a.m. — The following people were indicted by a Nelson County grand jury on Wednesday, Aug, 3, 2011. They are set for arraignment in Nelson Circuit Court on Aug. 18, 2011, unless otherwise indicated.
11-CR-209. Jackie E. Allen III, 30, Bardstown, tampering with physical evidence; promoting contraband, first-degree and complicity to same (three counts); possession of controlled substance, third-degree and complicity to same; possession of marijuana and complicity to same; persistent felony offender, second-degree.
According to the indictment, on July 7, 2011, Allen – acting alone or in concert with Natasha Mosier – allegedly brought cigarettes, marijuana and Xanax into the Nelson County Jail. The indictment further cites Allen’s previous convictions in connection with the persistent felony offender charge. Bail was set at $50,000 cash only, plus conditions.
11-CR-210. Shawn N. Edlin, 22, New Haven, criminal mischief, first-degree; unauthorized use of a motor vehicle; operating a motor vehicle while license suspended; failure of non-owner operator to maintain required insurance; expired Kentucky registration plates; failure to wear seatbelt.
According to the indictment, on Jan. 13, 2009, Edlin allegedly operated and caused damage of more than $1,000 to a 1998 Pontiac Grand Am belonging to another person without authorization while his license was suspended, without insurance or current registration plates or wearing a seat belt. Bail was set at $5,000 unsecured, plus conditions.
11-CR-211. Natasha M. Mosier, 27, Bardstown, promoting contraband, first-degree and complicity to same (three counts); possession of controlled substance, third-degree and complicity to same; possession of marijuana and complicity to same.
According to the indictment, on July 7, 2011, Mosier – acting alone or in concert with Jackie E. Allen II, Mosier – allegedly brought cigarettes, marijuana and Xanax into the Nelson County Jail. Bail was set at $25,000 cash only, plus conditions.
11-CR-212. Harry S. Houck, 24, Bardstown, possession of matter portraying sexual performance by a minor.
According to the indictment, between Jan. 27 – June 13, 2011, Houck allegedly possessed materials that visually depicted an actual sexual performance by a minor. Bail was set the same as the case involving Houck in Nelson District Court.
11-CR-213. Erin Nicole Barnes, 29, Bardstown, first-degree robbery; assault, first-degree; possession of marijuana; possession of controlled substance, third-degree; possession of legend drugs.
According to the indictment, on July 22, 2011, Barnes allegedly threatened to use force in order to take a wallet belonging to an individual at a home on Sunset Drive in Bardstown. Barnes is allegedly to have struck and knocked an individual to the ground with her vehicle during the incident. She was also allegedly found in possession of marijuana, alprazolam and tramadol hydrochloride. Bail was set at $250,000 cash only plus conditions.
11-CR-214. Trevor Ballard, 23, Bardstown, robbery, second-degree.
According to the indictment, on July 28, 2011, Ballard allegedly threatened the use of physical force against a store employee while committing a theft at the Bardstown Kroger store. Bail was set at $20,000 cash only plus conditions.
11-CR-215. Jacob Browning, 18, Bradenton, Fla., unlawful transaction with a minor, second-degree (two counts); criminal mischief, third-degree (nine counts).
According to the indictment, on June 24, 2011, Browning allegedly caused two minors to engage in criminal activity. Browning is also alleged to have caused damage of less than $500 to property owned by nine different owners. Bail to be set at arraignment, plus conditions.
11-CR-216. James Devin Howard, 18, Bardstown, robbery, first-degree and complicity to same.
According to the indictment, on July 29, 2011, Howard — acting alone or in concert with two other juvenile males – allegedly threatened to use physical force in order to take a drum set and Nintendo Wii game system from its owner. Bail was set at $20,000 cash only, plus conditions.
11-CR-217. Steven J. Ramos, 44, Bardstown, wanton endangerment, first-degree; operating motor vehicle under influence of alcohol and/or drugs; operating motor vehicle while license suspended; failure of owner to maintain required insurance; no/expired Kentucky registration receipt.
According to the indictment, on June 13, 2011, Ramos allegedly operated a motor vehicle in a reckless manor and drove into an apartment building wall. Ramos is alleged to have been under the influence of alcohol and/or drugs at the time, and was operating the vehicle with a suspended drivers license while also not having insurance and registration receipt. Bail was set at $9,500 cash only plus conditions.
11-CR-218. Francis C. Mattingly, 49, address unknown, fleeing and evading police, first-degree (motor vehicle).
According to the indictment, on July 2, 2011, Mattingly allegedly attempted to elude and flee and knowingly or wantonly disobeying a direction to stop his vehicle by police. Bail was set at $5,000 cash only, plus conditions.
11-CR-219. Michael Wayne Underwood, 30, Bardstown, trafficking in marijuana, 8 ounces to five pounds.
According to the indictment on April 28, 2011, Underwood allegedly possessed more than eight ounces of marijuana but less than five pounds with the intent to sell it. Bail was set at $9,500 cash only, plus conditions.
11-CR-220. Emma Elizabeth Davis, 51, Louisville, trafficking in controlled substances, second-degree.
According to the indictment on April 8, 2011, Davis allegedly sold oxycodone, a Schedule II controlled substance, to a confidential informant. Bail was set at $9,500 cash only, plus conditions.
11-CR-221. Michael Wayne Underwood, 30, Bardstown, trafficking in marijuana, 8 ounces to five pounds.
According to the indictment on May 27, 2011, Underwood allegedly possessed more than eight ounces of marijuana but less than five pounds with the intent to sell it. Bail was set at $9,500 cash only, plus conditions.
11-CR-222. Emma Elizabeth Davis, 51, Louisville, trafficking in controlled substances, second-degree.
According to the indictment on May 10, 2011, Davis allegedly sold oxycodone, a Schedule II controlled substance, to a confidential informant. Bail was set at $9,500 cash only, plus conditions.
11-CR-11-224. Emma Elizabeth Davis, 51, Louisville, trafficking in controlled substances, first-degree; trafficking in controlled substances, third-degree.
According to the indictment on July 8, 2011, Davis allegedly sold unknown drugs and Xanax, a Schedule IV controlled substance, to a confidential informant. Bail was set at $9,500 cash only, plus conditions.
