Nelson Circuit Court indictments — Dec. 15, 2010

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

The following people were indicted by a Nelson County grand jury on Wednesday, Dec. 15, 2010.  They are set for arraignment in Nelson Circuit Court Jan. 6, 2011.

David Jerome Willett, 26, New Hope, murder, second-degree persistent felony offender. On Dec. 2, Willett allegedly stabbed another person multiple times killing him. Bail was set at $1,000,000 cash only plus conditions.

David W. Phelps, 32, Bardstown, second-degree possession of a forged instrument, 10 counts. Between Sept. 22 and Nov. 18, Phelps allegedly passed 10 forged checks on the account of the Bardstown All Stars cheerleading team totaling $3,062.54.

Half of the checks – totaling $2,000 – were allegedly made out to Phelps. Three checks totaling $290 were allegedly passed at Handy Food Mart, and two checks totaling $872.54 were allegedly passed at Lowe’s Home Improvement Store in Bardstown. Bail was set at $4,500 cash only plus conditions.

Timothy Mitchell, 44, Louisville, theft by failure to make required disposition of property, $500 or more. According to the indictment, Mitchell failed to make payments or return a 65-inch TV he rented at a rental store in Bardstown. Bail was set at $5,000 cash only plus conditions.

Donald Scott Hibbs Jr., 20, Bardstown, first-degree assault. Sometime between Oct. 30-31, Hibbs allegedly stabbed another person in the chest with a knife. Bail was set at $100,000 cash only plus conditions.

Randy E. Cooper, Jr., 26, Bardstown, first-degree trafficking in controlled substances, second or greater offense; first-degree possession of controlled substance, second or greater offense; third-degree possession of controlled substance, first offense; first-degree persistent felony offender. On or about Oct. 28, Cooper allegedly possessed cocaine with the intent to sell or transfer it. He was also charged with possessing unidentified pills. Bail was set at $50,000 cash only plus conditions.

Robert Clay Gibson, 59, Bardstown, second-degree burglary, two counts. Bail was set at $9,500 cash only, plus conditions.

Gerald K. McNeal, 46, Birmingham, Ala., flagrant non-support; second-degree persistent felony offender. Bail was set at $9,500 cash only plus conditions.

George L. Walker, 36, Bardstown, flagrant non-support; second-degree persistent felony offender. Bail was set at $9,500 cash only plus conditions.

Andy G. Cornelius, 37, flagrant non-support. Bail was set at $5,000 cash only, plus conditions.

Anthony R. Boone, 33, Lawrenceburg, persistent felony offender, second-degree. Amended indictment 10-CR-212. Bail was same as primary charges plus conditions.

Philip McDaniel, 32, Bardstown, persistent felony offender, second-degree. Amended indictment 10-CR-302. Bail is same as primary charges plus conditions.
