Nelson Circuit Court Indictments–Sept. 21, 2011

Thursday, Sept. 24, 2011, 12:30 p.m. – The following people were indicted by a Nelson County grand jury on Wednesday, Sept. 21, 2011. They are set for arraignment on Oct. 6, 2011, unless otherwise indicated.

11-CR-240. Trevor S. Ballard, 24, Bardstown, robbery, second-degree and complicity to same; attempted theft by unlawful taking under $500 and complicity to same.

According to the indictment, on Nov. 2, 2009, Ballard, acting alone or in concert with Matthew Spalding and Nicholas Ballard, allegedly threatened to use physical force on an individual while attempting to take a bottle of Wild Turkey liquor belonging to Keystone Liquors having a value of less than $500. Bail was set at $5,000 cash only plus conditions.

11-CR-241. Jason R. Stansbury, 29, Bardstown, first-degree possession of controlled substances; tampering with physical evidence; possession of drug paraphernalia; failure to or improper signal; persistent felony offender, first-degree.

According to the indictment, on March 1, 2011, Stansbury was allegedly found with cocaine in his possession and attempted to hide it in his pants. He is also alleged to have had drug paraphernalia in his possession. The indictment further cites Stansbury’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $5,000 cash only plus conditions.

11-CR-242. Nicholas A. Ballard, 26, address unknown, robbery, second-degree and complicity to same; attempted theft by unlawful taking under $500 and complicity to same; persistent felony offender, first-degree.

According to the indictment, on Nov. 2, 2009, Ballard, acting alone or in concert with Matthew Spalding and Trevor Ballard, allegedly threatened to use physical force on an individual while attempting to take a bottle of Wild Turkey liquor belonging to Keystone Liquors having a value of less than $500. The indictment further cites Ballard’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $5,000 cash only plus conditions.

11-CR-243. Jason R. Stansbury, 29, Bardstown, trafficking in controlled substances, first-degree; tampering with physical evidence; disregarding stop sign; persistent felony offender, first-degree.

According to the indictment, on Feb. 11, 2011, Stansbury allegedly possessed cocaine with the intent to sell or transfer it. He also allegedly threw a marijuana cigarette out a car window when he saw a police officer approaching his vehicle. The indictment further cites Stansbury’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $5,000 cash only plus conditions.

11-CR-244. Matthew Ryan Spalding, 24, Bardstown, robbery, second-degree and complicity to same; attempted theft by unlawful taking under $500 and complicity to same.

According to the indictment, on Nov. 2, 2009, Spalding, acting alone or in concert with Trevor Ballard and Nicholas Ballard, allegedly threatened to use physical force on an individual while attempting to take a bottle of Wild Turkey liquor belonging to Keystone Liquors having a value of less than $500. Bail was set at $5,000 cash only plus conditions.

11-CR-245. David Jerome Lydian Jr., 31, Bardstown, possession of firearm by convicted felon; tampering with physical evidence and complicity to same; receiving stolen property (firearm) and complicity to same; persistent felony offender, first-degree.

According to the indictment, on May 20, 2011, Lydian was allegedly found in possession of a stolen .357 Magnum revolver after having previously been convicted of a felony. The indictment further alleges that between May 20-27, 2011, Lydian, acting alone or in concert with Angel Burton and Catherine V. Lydian, threw the stolen gun over a neighbor’s fence in an attempt to hide it. The indictment further cites Lydian’s previous felony convictions as the basis of the persistent felony offender charge. Bail was set $200,000 cash only plus conditions.

11-CR-246. Brandon Board, 21, Bardstown, theft by unlawful taking, fleeing and evading police, first-degree (on foot); persistent felony offender, second-degree.

According to the indictment, on July 6, 2011, Board allegedly took a 1992 Toyota Camry belonging to another person, the car having a value of more than $500 but less than $10,000. When confronted by officers, Board allegedly fled on foot. The indictment further cites Board’s previous felony convictions as the basis of the persistent felony offender charge. Bail was set at $9,500 cash only plus conditions.

11-CR-247. Angel F. Burton, 25, Bardstown, tampering with physical evidence and complicity to same; receiving stolen property (firearm) and complicity to same.

According to the indictment, between May 20-27, 2011, Burton, acting alone or in concert with David Lydian and Catherine V. Lydian, threw a stolen .357 Magnum revolver over the fence in a neighbor’s yard in order to hide it from police. Bail was set $9,500 cash only plus conditions.

11-CR-248. Roger Wayne Whitaker, 47, Boston, theft by unlawful taking, persistent felony offender, first-degree.

According to the indictment, sometime in November 2010, Whitaker allegedly took copper wire belonging to another individual having a value of $500 but less than $10,000. The indictment further cites Whitaker’s previous felony convictions as the basis for the persistent felony offender charge. Bail was set at $100,000 cash only plus conditions.

11-CR-249. Catherine V. Lydian, 49, Bardstown, tampering with physical evidence and complicity to same; receiving stolen property (firearm) and complicity to same.

According to the indictment, between May 20-27, 2011, Lydian, acting alone or in concert with David Lydian and Angel Burton, threw a stolen .357 Magnum revolver over the fence in a neighbor’s yard in order to hide it from police. Bail was set $9,500 cash only plus conditions.

11-CR-250. Bradley Allen Johnson, 26, Bardstown, theft by failure to make required disposition of property, $500 or more.

According to the indictment, on Oct. 3, 2006, Johnson allegedly rented a camcorder, recliner and recliner sofa from American Rental and failed to make the required disposition of the property. Bail was set at $5,000 cash only plus conditions.

11-CR-251. Damon G. Huntt, 26, Bardstown, sexual abuse, first-degree; persistent felony offender, first degree.

According to the indictment, on Sept. 3, 2011, Huntt allegedly engaged in sexual contact with another person by the use of forcible compulsion. The indictment further cites Huntt’s previous felony convictions as the basis of the persistent felony offender charge. Bail was set at $100,000 cash only plus conditions.

11-CR-252. Anthony C. Kapetanios, 19, Bardstown, burglary, third-degree, (4 counts), and complicity to same (4 counts); theft by unlawful taking (3 counts) – auto, and complicity to same (3 counts); criminal mischief, third-degree (4 counts), and complicity to same (4 counts); unlawful transaction with a minor, second degree.

According to the indictment, Kapetanios, acting alone or in concert with a juvenile on June 22, 2011, broke into Riggs Carpet and Flooring, Joe Buckman Flooring, We Paint and  More and Joe Riggs Flooring with intent to commit a crime. Kapetanios, acting alone or in concert with a juvenile on the same date allegedly took a 1996 Ford Econoline van and a U-Haul truck belonging to Riggs Carpet and Flooring, and a 1995 Chevy van belonging to We Paint and More, causing damage to property owned by the businesses of less than $500. The indictment further alleges Kaptenios knowing caused a minor to engage in a felony as part of the listed incidents. Bail was set at $100,000 cash only plus conditions.

11-CR-253. Robert E. Taylor Jr., 25, Elizabethtown, sodomy, first-degree, victim under 12 years of age.

According to the indictment, on Aug. 24, 2011, Taylor engaged in deviate sexual intercourse with another person under 12 years of age by forcible compulsion. Bail was set at $200,000 cash only plus conditions.

11-CR-255. Trevor Walls, 21, Bardstown, criminal mischief, first-degree; theft by unlawful taking (attempted); possession of burglary tools; criminal trespass, third-degree.

According to the indictment, on Aug. 14, 2011, Walls allegedly damaged an air conditioning unit belonging to another person while attempting to take it from a residence on Boston Road. Bail was set at $5,000 cash only plus conditions.

11-CR-256. Brandon David Moss, 24, Bardstown, burglary, third-degree (2 counts) and complicity to same (2 counts); receiving stolen property (2 counts) and complicity to same (2 counts); criminal mischief, third-degree and complicity to same.

According to the indictment, between Aug. 25-26, 2011, Moss, acting alone or in concert with Charles Hood, allegedly entered a building on Springfield Road and a building on Dugan Lane, receiving, retaining or disposing of a number of items taking from the buildings, including a Sony CD player; chrome oil cap; four Mickey Thompson wheels and tires; a 2003 Honda dirt bike; a Polaris helmet; and a protective vest, the items having a value of $500 or more but less than $10,000. Bail was set at $2,500 cash only plus conditions.

11-CR-257. Trevor Walls, 21, Bardstown, burglary, third-degree.

According to the indictment, on Aug. 12, 2011, Walls allegedly entered a barn belonging to an individual with the intent to commit a crime. Bail was set at $5,000 cash only plus conditions.

11-CR-258. Charles R. Hood, 19, Bloomfield, burglary, third-degree (2 counts) and complicity to same (2 counts); receiving stolen property (2 counts) and complicity to same (2 counts); criminal mischief, third-degree and complicity to same.

According to the indictment, between Aug. 25-26, 2011, Hood, acting alone or in concert with Brandon Moss, allegedly entered a building on Springfield Road and a building on Dugan Lane, receiving, retaining or disposing of a number of items taking from the buildings, including a Sony CD player; chrome oil cap; four Mickey Thompson wheels and tires; a 2003 Honda dirt bike; a Polaris helmet; and a protective vest, the items having a value of $500 or more but less than $10,000.
