City amends smoking ban, gives final approval of annexing US62/KY 245/US150 tracts

Tuesday, Dec. 13, 2011, 11 p.m. – With the end of the calendar year approaching, the Bardstown City Council took care of some financial housekeeping at its meeting Tuesday evening.

The council unanimously approved changes to the city’s budget in order to allocate grant money received and to include the $140,000 savings the city realized in this year’s liability and workers comp insurance premiums.

Mike Abell, chief financial officer, explained that the insurance savings were due to a variety of reasons, one of which includes the savings from not having claims in the past three years.

SMOKING BAN AMENDMENT. The council approved first reading of an amendment to the city’s smoking ban it passed in March 2010.

The amendment modifies Section 11 of the ordinance, which covers the penalty assessed a person or employer who retaliates against someone who reports or attempts to prosecute a smoking ban violation.

The original ordinance states the violation is a misdemeanor with a fine not to exceed $1,000. Kentucky law caps misdemeanor fines at no more than $500, City Attorney Tom Donan told the council.

Councilman Francis Lydian voted against the amendment.

ANNEXATION APPROVED. The council unanimously approved second and final reading of an ordinance to annex 563 acres of land that begins with the bourbon warehouses on Bloomfield Road near the railroad tracks and extends around the KY 245 bypass to US150, and includes the properties on US150 between Walmart and Marvin Downs Lane.

The first reading of the annexation took place at a special meeting held last Tuesday after the council’s regular working session.

In other business, the council:

  • Heard from city engineer Jeff Mills that Lebanon’s Channel 6 is now being broadcast on Channel 116 on the Bardstown Cable TV system.
  • Approved giving Sheckles authority to sign cable rebroadcast agreements with WAVE, WHAS, WLKY and WDRB. Sheckles negotiated the three-year agreements, which stipulate the fees the broadcasters collect from the city cable TV system.
  • Approved the Design Review Board’s recommendation for a building to be built in Kenmore Industrial Park.
  • Approved the re-appointment of Jess Riley to the Property Maintenance Board of Appeals, and Johnn Warren to the Bardstown-Nelson County Tourist and Convention Commission. Both are three-year appointments.

The council next meets 7 p.m. Tuesday, Dec. 27, 2011.
