Nelson Circuit Court Indictments-Jan. 18, 2012

Editor’s Note: The indictment of a person by a grand jury or otherwise is an accusation only and that person is presumed innocent until and unless proven guilty.

Thursday, Jan. 20, 2012, 11 p.m. – The following people were indicted by a Nelson County grand jury on Wednesday, Jan. 18, 2012. They are set for arraignment on Thursday, Feb. 2, 2012, unless otherwise indicated.

12-CR-019. Richard A. Foley, 37, LaGrange, possession of matter portraying sexual performance by a minor (28 counts).

According to the indictment, on June 17, 2008, Foley allegedly had in his possession or control material visually depicting an actual sexual performance by a minor. Bail was set at $50,000 cash only plus conditions.

12-CR-020. Sandra R. Gonzales, aka Shirley Martin, 41, Bardstown, first-degree trafficking in controlled substances (greater than 10 dosage units), and complicity to same.

According to the indictment, on Dec. 19, 2011, Gonzales – acting alone or in concert with others — allegedly sold Oxycodone pills in an amount equal to or greater than 10 dosage units. Bail was set at $50,000 cash only plus conditions.

12-CR-21. William Francis Auberry, 19, New Haven, theft of identity of another without consent; operating a motor vehicle while license is suspended; license to be in possession; failure of non-owner operator to maintain required insurance; giving police officer a false name or address.

According to the indictment, on Dec. 28, 2011, Auberry allegedly gave a state trooper another person’s name with the intent to avoid detection. The indictment further alleges Auberry’s license was suspended while he was driving, and that he was unable to produce proof of insurance. Bail was set at $5,000 cash only, plus conditions.

12-CR-22. Justin K. Lewis, aka Justin K. Noonan, 19, Bardstown, first-degree trafficking in controlled substances (greater than 10 dosage units) and complicity to same; second-degree trafficking in controlled substances (less than 20 dosage units) and complicity to same; first-degree trafficking in controlled substances, cocaine (less than 4 grams) and complicity to same; possession of drug paraphernalia and complicity to same.

According to the indictment, on Dec. 19, 2011, Lewis – acting alone or in concert with others – allegedly sold Oxycodone pills in an amount equal or greater than 10 dosage units. The indictment further alleges that:

On Dec. 30, 2011, Lewis – acting alone or in concert with others — allegedly sold Hydrocodone pills in an amount less than 20 dosage units;

On Jan. 9, 2012, Lewis — acting alone or in concert with others — sold less than 4 grams of cocaine and possessed drug paraphernalia. Bail was set at $50,000 cash only plus conditions.

12-CR-023. Brian Keith Boone, 37, Bardstown, first-degree trafficking in controlled substances; first-degree possession of controlled substance; tampering with physical evidence; possession of drug paraphernalia.

According to the indictment, on Jan. 9, 2012, Boone possessed heroin in an amount equal or greater than 2 grams with the intent to sell or traffic; on Dec. 29, 2011, sold herion in an amount less than 2 grams; on Jan. 9, 2012, was unlawfully in possession of Methadone pills and drug paraphernalia. The indictment further alleges Boone attempted to throw evidence from his pockets.  Bail was set at $50,000 cash only plus conditions.

12-CR-024. Kenneth M. Martin, 24, Bardstown, first-degree trafficking in controlled substances, more than 10 dosage units and complicity to same; second-degree trafficking in controlled substances, fewer than 20 dosage units and complicity to same; first-degree trafficking in controlled substances, less than 4 grams cocaine, and complicity to same; possession of drug paraphernalia and complicity to same; operating a motor vehicle while license suspended.

According to the indictment, on Dec. 19, 2011, Martin – acting alone or in concert with others – allegedly sold Oxycodone pills in an amount equal or greater than 10 dosage units. The indictment further alleges that:

On Dec. 30, 2011, Martin – acting alone or in concert with others — allegedly sold Hydrocodone pills in an amount less than 20 dosage units;

On Jan. 9, 2012, Martin — acting alone or in concert with others — sold less than 4 grams of cocaine and possessed drug paraphernalia. Bail was set at $50,000 cash only plus conditions.

The indictment further alleges that on Dec. 19, 2011, Martin was operating a motor vehicle while his license was suspended. Bail was set at $50,000 cash only plus conditions.

12-CR-025. Aaron Blake Chavolla, 27, Bardstown, first-degree trafficking in controlled substances, greater than 10 dosage units; first-degree trafficking in controlled substances, less than 10 dosage units; possession of a firearm while committing an offense; trafficking in marijuana, less than 8 oz; possession of a controlled substance, second-degree; possession of drug paraphernalia.

According to the indictment, sometime between Dec. 5-Dec. 12, 2011, Chavolla allegedly unlawfully possessed and sold Opana ER pills in an amount equal to or greater than 10 dosage units; on Jan. 3, 2012, allegedly sold Opana ER pills in an amount less than 10 dosage units; on Jan. 3, 2012, allegedly trafficked in marijuana by unlawfully possessing 8 oz or less of marijuana; on Jan. 3, 2012, allegedly in unlawful possession of Suboxone strips, a Schedule III narcotic and drug paraphernalia. The indictment also alleges these offenses were committed while Chavolla allegedly was in possession of a multi-caliber long gun. Bail was set at $100,000 cash only plus conditions.

12-CR-026. Keith A. Godsey, 45, Joliet, Ill., first-degree rape; kidnapping; wanton endangerment, first-degree.

According to the indictment, on Jan. 14, 2012, Godsey allegedly engaged in sexual intercourse by the use of forcible compulsion. The indictment further alleges Godsey unlawfully restrained the victim and pointed a load gun at her in her residence. Bail was set at $250,000 cash only plus conditions.

12-CR-027. Edward “Eddie” William O’Bryan, 58, Bardstown, assault, first-degree; tampering with physical evidence; possession of firearm by convicted felon.

According to the indictment, on Dec. 31, 2011, O’Bryan allegedly shot Roger Cahoe in the stomach with a hand gun and hid the weapon behind a wooden fence. The indictment further alleges that as a convicted felony, O’Bryan was unlawfully in possession of a H & R .22 caliber hand gun. Bail was set at $50,000 cash only plus conditions.

12-CR-28. Stacey Gale Ford, 30, Radcliff, first-degree trafficking in controlled substances; first-degree possession of controlled substance (methamphetamine); possession of drug paraphernalia; carrying a concealed deadly weapon; possession of marijuana; persistent felony offender, first-degree.

According to the indictment, on Nov. 14, 2011, Ford allegedly possessed methamphetamine with the intent to sell it. The indictment alleges Ford was also in possession of marijuana, drug paraphernalia, and was carrying brass knuckles in his pants pocket. The indictment cites Ford’s prior felony convictions as the basis for the persistent felony offender charge. Bail was set at $50,000 cash only plus conditions.

12-CR-29. Christopher H. Wilhelm, 19, Bardstown, first-degree possession of controlled substance and complicity to same; possession of firearm while committing an offense.

According to the indictment, on Nov. 8, 2011, Wilhelm – alone or in concert with others – was in possession of cocaine. The indictment alleges Wilhelm was in possessing of a 12-gauge Mossburg shotgun while committing the offense. Bail was set at $9,500 cash only, plus conditions.
