Boston man indicted Wednesday on underage sex, rape and child porn charges

Wednesday, Dec. 7, 2016 — A Boston man was indicted Wednesday, Dec. 7, 2016, on charges he allegedly had intercourse, deviate intercourse, raped, and sexually abused a minor under 16 years of age between July and October 2016.

1_indictmentMichael Jordan Hicks, 31, of Boston, was indicted by a Nelson County grand jury on 11 counts of first-degree sexual abuse; eight counts of sodomy, third-degree; nine counts of rape, third-degree; 11 counts of possession of child pornography and one count of the use of a minor in a sexual performance. The indictment also charges Hicks with alleged unlawful transaction with a minor under 16 years old and third-degree unlawful transaction with a minor.

According to the indictment, between July and October 2016, Hicks allegedly masturbated in the presence of a minor under the age of 16; engaged in deviant sexual intercourse and sexual intercourse with a minor under the age of 16; and gave, sold or procured an alcoholic or malt beverage for a minor. The indictment also alleges that Hicks photographed the breasts of a minor under 16 while masturbating, and that he possessed multiple depictions of matter portraying a sexual performance by a minor.

Sodomy involves deviate sexual intercourse, defined as any act of sexual gratification involving the sex organs of one person and the mouth or anus of another.

Third-degree rape involves sexual intercourse by a individual over 21 years of age with a minor under the age of 16 years.

The sexual abuse, sodomy, rape and child pornography charges are Class D felonies, each punishable by one to five years in prison. The use of a minor in a sexual performance, and first-degree unlawful transaction with a minor are Class B felonies each punishable by 10 to 20 years in prison.

Bail was set at $100,000 cash only, plus conditions. Hicks’ arraignment in Nelson Circuit Court is Thursday, Dec. 22, 2016.
